The Alabama agricultural tax exemption is really a bundle of breaks: farm and timber land is assessed at Current Use value instead of market value under Class III, most farm inputs are exempt from state sales tax, farm equipment is kept off the personal property tax rolls, and qualifying farms can claim a sizable federal estate tax reduction when the owner dies. The property tax piece is the biggest money-saver, and the one that requires you to file paperwork by a hard deadline.
Current Use Valuation Cuts Your Property Tax
Alabama Code Section 40-8-1 puts agricultural, forest, and residential property into Class III, which carries a 10 percent assessment rate. Commercial property sits at 20 percent and utility property at 30 percent, so Class III is already the lowest tier before any other break applies.1Alabama Legislature. Alabama Code 40-8-1 – Classification of Property; Assessment Rate
The real savings come from Current Use valuation. Instead of taxing your land on what a developer would pay for it, the state taxes it on what the soil can produce. The Alabama Department of Revenue publishes standard per-acre values each year based on crop and timber productivity, and county assessors apply those values to qualifying land. On parcels near growing towns, the Current Use figure can be a small fraction of fair market value.2Alabama Legislature. Alabama Code 40-7-25.1 – Current Use Value of Class III Property
The statute defines qualifying use broadly. It covers raising and selling crops, breeding and selling livestock (cattle, sheep, swine, horses, poultry, fish, honeybees), dairying, and growing timber for sale. It also sweeps in “any other agricultural or horticultural use or animal husbandry and any combination thereof,” so nurseries, orchards, and similar operations qualify.1Alabama Legislature. Alabama Code 40-8-1 – Classification of Property; Assessment Rate
If part of your parcel is used for something else, only the agricultural or forest portion gets Current Use treatment. The rest is assessed at fair market value under whatever class fits.
How to Apply and Keep the Status
Current Use is not automatic. You file an Application for Current Use Valuation with your county tax assessor on or before January 1 of the tax year you want the lower valuation to apply. Miss that date and your land stays at fair market value for the year.3Alabama Department of Revenue. Division Directive CU – 2023 – Current Use Valuation and Procedures
The application needs the parcel identification number from your tax receipt or deed, a legal description with township, range, and section, and a breakdown of how many acres go to each qualifying use. The assessor uses that breakdown to apply the correct per-acre values. On parcels of five acres or less, the assessor may ask for additional documentation such as a site management plan from the Alabama Forestry Commission.4Alabama Department of Revenue. Current Use
Once the assessor processes the application, you’ll get a notice showing the computed Current Use values. If something is wrong, you have 30 days to submit a written statement spelling out the error.2Alabama Legislature. Alabama Code 40-7-25.1 – Current Use Value of Class III Property
You don’t need to refile every year once approved, but the assessor can request updated information to confirm the land still qualifies. Keep records of timber harvests, livestock counts, and crop sales. If classification is ever questioned, those records are the first line of defense.
The Rollback Tax if the Land Changes Use
Current Use is not permanent. Under Section 40-7-25.3, if you convert the land to a non-qualifying use, or if you sell it and the buyer converts it within two years, Alabama imposes a rollback tax. The rollback recalculates taxes for the three years before the October 1 following the conversion, using the higher of the sale price or fair market value instead of Current Use value. If the land was enrolled for fewer than three years, the rollback only covers the years it was actually in the program.4Alabama Department of Revenue. Current Use
One detail worth knowing: the recalculation still uses the Class III 10 percent assessment rate, not the Class II commercial rate. The rollback captures the valuation gap, not a reclassification. Even so, three years of back taxes at market value can be a serious bill on land near development. Tell the county assessor as soon as the use of your land changes to avoid penalties on top of the rollback.4Alabama Department of Revenue. Current Use
Sales Tax Exemptions on Farm Inputs
Alabama exempts several categories of farm supplies from the state’s 4 percent sales tax. The exemptions apply at purchase, so there’s no refund paperwork later.5Alabama Legislature. Alabama Code 40-23-4 – Exemptions
- Fertilizer used for agricultural purposes is exempt. Cottonseed meal sold on its own, not mixed with other materials, does not count as fertilizer under the statute.
- Seeds for planting, along with baby chicks and poults, are exempt. Nursery stock, plants, and floral products are not, unless the seedlings, plants, shoots, or slips are specifically destined for vegetable gardens, truck farms, or other agricultural use.
- Insecticides and fungicides used for agricultural purposes are exempt.
- Livestock and poultry feed is exempt. Prepared dog and cat food is not.
- Antibiotics, vaccines, hormones, vitamins, minerals, and medications used in producing fish, livestock, or poultry are exempt.
Farm machinery, equipment, and parts used for planting, cultivating, and harvesting are not fully exempt. They are taxed at a reduced state rate of 1.5 percent instead of 4 percent, with local taxes still applying on top.6Alabama Department of Revenue. Guidelines Regarding Agricultural Related Sales
Sales of livestock, poultry, or other farm products in their original condition are also exempt from sales tax when the sale is made by the producer, immediate family members, or employees who helped produce the goods.5Alabama Legislature. Alabama Code 40-23-4 – Exemptions
Farm Equipment Is Off the Personal Property Rolls
Separate from the land valuation, Alabama exempts farm tractors, farm implements (anything drawn by a tractor and used for planting, growing, or harvesting), and the tools used to maintain that equipment from personal property tax entirely. You don’t list or assess them, as long as you use them exclusively in connection with agricultural or forest property.7Alabama Department of Revenue. 810-4-1-.13 Exemption of Personal Property Associated with Farms
“Exclusively” has some give. Incidental non-farm use does not disqualify the equipment, as long as you’re not renting it out or using it for hire.7Alabama Department of Revenue. 810-4-1-.13 Exemption of Personal Property Associated with Farms
Federal Estate Tax Reduction for Farm Heirs
If you’re thinking about passing the farm to the next generation, Internal Revenue Code Section 2032A lets heirs value qualifying farm property at its agricultural use value instead of fair market value for federal estate tax purposes. For estates of people dying in 2026, the maximum reduction is $1,460,000.8Office of the Law Revision Counsel. 26 USC 2032A – Valuation of Certain Farm, Etc., Real Property
Two thresholds have to be met. At least 50 percent of the adjusted gross estate must consist of real or personal property that was being used for farming or another qualified use at the time of death, and at least 25 percent must be qualifying real property. The deceased must have owned the land and used it for farming for at least five of the eight years before death, and either the deceased or a family member must have materially participated in the farming operation during that period.8Office of the Law Revision Counsel. 26 USC 2032A – Valuation of Certain Farm, Etc., Real Property
Material participation means actual involvement in running the farm. Collecting rent, reviewing a crop plan once a year, or putting up capital does not count.9eCFR. 26 CFR 20.2032A-3 – Material Participation Requirements for Valuation of Certain Farm and Closely-Held Business Real Property
The benefit comes with a 10-year string. If the heir sells the property to someone outside the family or stops using it for farming within 10 years of the decedent’s death, the IRS imposes an additional estate tax that recaptures the benefit.8Office of the Law Revision Counsel. 26 USC 2032A – Valuation of Certain Farm, Etc., Real Property
Income Tax Still Applies to Farm Earnings
Property and sales tax breaks don’t eliminate the obligation to report farm income to the IRS. Sole proprietors report income and expenses on Schedule F. Partnerships, corporations, and trusts that farm use the same form. Payments from USDA conservation programs, including the Conservation Reserve Program, count as taxable farm income and are reported to the IRS on Form 1099.10Farm Service Agency. Tax Resources for USDA Program Participants
Custom services like contract harvesting, trucking commodities to market, or processing farm products into retail goods such as cheese, wine, or packaged meat are not farming for Schedule F purposes, even if you also run a farm. That income goes on Schedule C.
