Alabama Gun Laws for Travelers: Vehicles, Permits, and Police Stops

If you are traveling to Alabama with a firearm, the state’s rules are among the most permissive in the country: anyone 19 or older who is not legally prohibited from possessing a firearm can carry concealed or openly, on their person or in their vehicle, without a permit, and that right applies equally to visitors. Alabama gun laws for travelers still leave several traps, though, mostly around federal school zones, restricted buildings, and one specific rule about touching your handgun during a traffic stop. Can Out-of-State Visitors Carry in Alabama

Yes. Alabama does not require reciprocity, and it does not require a home-state permit. You need to be at least 19 and legally allowed to possess a firearm under state and federal law. Active-duty military, honorably discharged veterans, and law enforcement officers can carry at 18. If your own state bans permitless carry, that does not affect your right to carry in Alabama once you cross the line.

Both concealed and open carry are legal. Alabama law specifically provides that carrying a holstered pistol in public, without brandishing it, does not constitute disorderly conduct.2Alabama Legislature. Alabama Code Title 13A Criminal Code Section 13A-11-7

The categories of people forbidden from possessing a pistol under Section 13A-11-72 are broader than travelers often expect:3Alabama Legislature. Alabama Code 13A-11-72 – Certain Persons Forbidden to Possess Pistol

  • Anyone convicted of a felony within the past five years, or with three or more felony convictions at any time
  • Anyone convicted of a crime of violence or a misdemeanor domestic violence offense, whenever it occurred
  • Anyone subject to a valid domestic abuse protection order
  • Anyone adjudicated as being of unsound mind
  • Anyone who is a habitual drunkard or has a drug addiction
  • Anyone unlawfully in the United States or present on a nonimmigrant visa, with narrow federal exceptions

Carrying a concealed handgun while falling into any of those categories is a Class B misdemeanor, punishable by up to six months in jail.4Alabama Legislature. Alabama Code 13A-11-50 – Carrying Concealed Weapons Check your status before you travel. A disqualifying conviction or order you had forgotten about is not a defense.

Carrying a Firearm in Your Vehicle

The old permit requirement for a vehicle carry under Section 13A-11-73 was repealed outright by HB 272.5Alabama Legislature. Alabama Code 13A-11-73 – Permit to Carry Pistol in Vehicle You can keep a loaded handgun anywhere in your car, truck, or RV: in the console, glove box, door pocket, or on your person. Residents and visitors are treated the same, so long as you are legally allowed to possess the firearm. Alabama also has no specific restrictions on transporting a loaded rifle or shotgun in your vehicle.

One rule surprises almost everyone. Once a law enforcement officer begins approaching your vehicle during a stop, you cannot touch a loaded handgun with your hands or fingers until the officer ends contact, unless the officer specifically directs you to.6Alabama Legislature. If your handgun is somewhere your hand might drift while you reach for a wallet or a registration, move it now.

Where You Still Cannot Carry

Permitless carry is not carry-everywhere. State and federal restrictions both apply.

State-Restricted Locations

Section 13A-11-61.2 bans firearms in the following places without express permission from whoever controls the premises:8Alabama Legislature. Alabama Code 13A-11-61.2 – Possession of Firearms in Certain Places

  • Police stations, sheriff’s offices, and highway patrol stations
  • Prisons, jails, halfway houses, and other detention facilities
  • Inpatient psychiatric or mental health treatment facilities
  • Courthouses, courthouse annexes, and district attorney offices
  • Buildings where a county commission or city council is holding a meeting
  • Any building with continuous security screening at entrances, such as magnetometers, key cards, or armed guards controlling access

Violating this section is a Class C misdemeanor, up to three months in jail and up to a $500 fine, and your firearm can be seized on the spot.8Alabama Legislature. Alabama Code 13A-11-61.2 – Possession of Firearms in Certain Places

Private Property

A “no firearms” sign, by itself, does not create a criminal charge in Alabama. The mechanism is trespass: an owner or manager can ask you to leave because you are armed, and if you refuse, that refusal is what turns criminal. Signs are still worth respecting. Pushing past one is the fastest way to convert a lawful carry into a trespass arrest.

Federal Buildings

Under 18 U.S.C. § 930, knowingly possessing a firearm in any federal facility is a crime.9Office of the Law Revision Counsel. 18 USC 930 – Possession of Firearms and Dangerous Weapons in Federal Facilities That covers any building owned or leased by the federal government where federal employees regularly work: post offices, Social Security offices, VA buildings, federal courthouses. These facilities have to post notices at public entrances, but you can still be convicted if you had actual knowledge of the restriction without a posted sign.

National parks in Alabama follow state carry law, so you can carry inside the park. You cannot bring a firearm into any federal building within the park, including visitor centers, ranger stations, and gift shops. Secure the firearm in your locked vehicle before you go in.

School Zones

The federal Gun-Free School Zones Act makes it illegal to knowingly possess a firearm within 1,000 feet of the grounds of any public or private school.10Bureau of Alcohol, Tobacco, Firearms and Explosives. Gun Free School Zone Notice There is an exemption for individuals who hold a concealed carry license issued by the state where the school zone is located.11Office of the Law Revision Counsel. 18 USC 922 That creates a real gap for travelers relying on permitless carry. If you do not actually hold an Alabama permit, the federal exemption may not cover you, even though Alabama itself does not require the permit. School zones are unavoidable on most trips through populated areas, and this is the strongest single reason to think about a permit.

Talking to Officers

Alabama has a statute requiring anyone carrying a concealed firearm to inform an officer when directly asked.12Alabama Legislature. Alabama Code 13A-11-95 – Duty to Inform Law Enforcement Officer Upon Request When in Possession of Concealed Pistol or Firearm The Attorney General’s office has said the provision carries no penalty and is unenforceable, and no one has been charged solely for failing to answer. Lying is a different matter and can bring a false-information charge, so honesty is the safer approach. Volunteering the information tends to make the encounter shorter.

Keep your hands visible, do not reach toward the firearm, and follow instructions. Remember the vehicle rule above: touching a loaded handgun during contact with an officer is a Class A misdemeanor.6Alabama Legislature. Alabama Code 13A-11-96 – Driver or Occupant of Motor Vehicle Stopped for Law Enforcement Purpose Prohibited from Knowingly Touching Loaded Handgun Except as Directed An officer may temporarily secure your firearm during the stop and return it once the stop ends without violations.

Why a Permit Still Helps

Alabama continues to issue optional concealed carry permits. Two reasons make one useful even though it is not required:

  • The federal Gun-Free School Zones Act exemption applies to license holders from the state where the school sits. Without an Alabama permit, every drive within 1,000 feet of a school is exposed.
  • Many states without permitless carry still honor Alabama permits. If your trip continues past Alabama’s borders, the permit may be what keeps you legal in the next state.

Alabama does not issue permits to non-residents, so a visitor cannot pick one up on arrival. You can carry a permit from your home state, and that may satisfy the school zone exemption if your home state’s licensing process includes the required law enforcement verification.11Office of the Law Revision Counsel. 18 USC 922

Flying and Amtrak

TSA rules govern firearms at every commercial airport, no matter what state law allows. Firearms travel unloaded, in checked baggage only, in a locked hard-sided container. Ammunition also goes in checked baggage in the original box or a container designed for it. Bringing a firearm to a TSA checkpoint triggers civil penalties starting at $3,000 for a loaded firearm and reaching $17,062 for repeat violations, plus a criminal referral to local law enforcement.14Transportation Security Administration. Civil Enforcement TSA counts a firearm as loaded any time the gun and ammunition are both accessible to the passenger, even in separate pockets of the same bag. Most checkpoint violations happen when someone forgets a handgun is in a carry-on that was in the car. Search every bag before you leave for the airport.

Amtrak allows firearms in checked baggage only, and the process needs advance planning. Call Amtrak at least 24 hours before departure to declare the firearm; online booking has no option for it. The firearm is unloaded, in a locked hard-sided container no larger than 62 by 17 by 7 inches and no heavier than 50 pounds. A handgun in a smaller locked case has to go inside a piece of checked luggage. Ammunition stays in its original packaging or an approved container and cannot exceed 11 pounds total. At check-in you sign a declaration form at least 30 minutes before departure.15Amtrak. Firearms in Checked Baggage The service is only available at stations with staffed ticket offices and checked baggage facilities, which narrows the Alabama options. Firearms are never permitted in Amtrak carry-on.

Driving Through Alabama to Another State

The federal Firearm Owners Protection Act gives you safe passage if you are transiting Alabama on the way to a state where you can also lawfully possess the firearm. Under 18 U.S.C. § 926A, you can move a firearm through any state, even a restrictive one, provided you can legally possess it at both ends of the trip and the firearm is unloaded and not readily accessible from the passenger compartment.16Office of the Law Revision Counsel. 18 USC 926A In a vehicle without a separate trunk, the firearm goes in a locked container that is not the glove compartment or the console.

This protection covers transit only. Stop in a restrictive state for anything beyond fuel or a rest break and courts have held the safe-passage defense may no longer apply. Inside Alabama the protection is largely academic, since state law already allows loaded carry in your vehicle. FOPA matters most for the legs of your trip before and after Alabama.
