Alabama Laws and Codes: Penalties, Lawsuits, and Consumer Rules

How the Code Is Organized

Criminal Penalties by Class

Alabama sorts offenses into felonies, misdemeanors, and violations. A felony carries a possible prison sentence of more than one year, a misdemeanor tops out at one year, and a violation caps at 30 days. Felony sentencing ranges are set by class, and firearms increase the mandatory minimum:

  • Class A felony: 10 to 99 years or life; minimum jumps to 20 years if a firearm was used.
  • Class B felony: 2 to 20 years; minimum jumps to 10 years with a firearm.
  • Class C felony: 1 year and 1 day to 10 years.
  • Class D felony: 1 year and 1 day to 5 years.

Prior Felonies Multiply Everything

Alabama’s Habitual Felony Offender Act pushes every new felony up the ladder based on prior convictions. One prior felony bumps a new Class C conviction up to Class B punishment. Two priors push it to Class A. Three or more prior felonies can mean 15 to 99 years or life for a mid-level offense. Drugs and Firearms

Under the Uniform Controlled Substances Act, possessing a controlled substance in Schedules I through V without authorization is a Class D felony punishable by one to five years.7Alabama Legislature. People convicted of violent felonies are barred from possessing firearms, and using a firearm during a Class A or Class B felony triggers the higher mandatory minimums shown above.

Civil Lawsuits and the Contributory Negligence Trap

Circuit courts hear civil cases where the amount in controversy exceeds $20,000. District courts handle claims up to $20,000 and share jurisdiction with circuit court from $6,000 to $20,000.8Alabama Legislature. The rule that trips up more Alabama plaintiffs than any other is contributory negligence. Alabama is one of only four states (plus the District of Columbia) where any share of fault by the injured person defeats the entire claim. If you are one percent at fault for the accident, you recover nothing. Most states reduce your recovery by your percentage of fault; Alabama does not. In Golden v. McCurry (1980), the Alabama Supreme Court acknowledged the harshness of the doctrine but left any change to the legislature.10Justia Law. Filing Deadlines That End Cases

Miss the statute of limitations and a court will dismiss the case regardless of its merits. The clock generally starts when the injury or breach occurs, though Alabama applies a discovery rule to some claims, starting the clock when you knew or should have known about the harm.

  • Personal injury: two years from the date of injury.
  • Fraud: two years from discovery.

Marriage, Divorce, and Custody

Title 30 governs family law in Alabama.12Justia Law. Since August 29, 2019, Alabama has not issued marriage licenses through probate courts. Divorce

Alabama allows both fault-based and no-fault divorce. Fault grounds such as adultery, abandonment, or substance abuse can influence property division and alimony. Marital property is divided under an equitable-distribution standard, meaning the court divides it in a way it considers fair given the circumstances, which is not necessarily a 50/50 split.

Custody and Child Support

Courts must consider joint custody in every case and presume it serves the child’s best interests when both parents request it. Factors include the parents’ ability to cooperate, any history of abuse, and the geographic distance between homes. Joint custody cannot be denied without specific findings explaining why.15Alabama Legislature. Buying, Selling, and Renting Property

Deeds, mortgages, and liens must be recorded in the county where the property sits. In counties that use electronic storage and indexing, any courthouse or annex in the county can accept the filing.17Alabama Legislature. Skip it, and a later buyer who records first can take priority over you.

Alabama has no general home-seller disclosure statute. Residential real estate is largely caveat emptor. If you’re buying a house in Alabama, an inspection by a qualified inspector before closing is how you find out what you’re buying.

Landlord-Tenant Rules

Under Alabama’s Uniform Residential Landlord and Tenant Act, security deposits are capped at one month’s rent for unfurnished units and two months’ rent for furnished units. After a tenant moves out, the landlord has 35 days to return the deposit in full or provide a written, itemized list of deductions. Miss that 35-day window and the landlord loses the right to withhold anything.

If a tenant violates the lease or fails to pay rent, the landlord must give written notice and at least seven business days to cure the problem before terminating the lease.18Alabama Legislature. Zoning is set locally. If a property will be used for a home business, rental, or commercial purpose, checking the zoning classification before closing avoids being told after the fact that the planned use isn’t allowed.

Wills and What Happens Without One

When someone dies with a valid will, probate court oversees the document and distributes assets under its terms. When there’s no will, intestacy statutes decide. The surviving spouse’s share depends on who else survives:

  • No children and no surviving parents: the spouse inherits the entire estate.
  • No children, but parents survive: the spouse receives the first $100,000 plus half the remaining balance.
  • All surviving children are also the spouse’s: the spouse receives the first $50,000 plus half the remaining balance.

These default shares often do not match what people would actually choose, which is the practical case for having a will.

Courts appoint guardians to manage the personal and financial affairs of minors or incapacitated adults. Conservatorships require court approval and ongoing oversight. Alabama also recognizes living wills and advance directives, letting you record healthcare decisions ahead of incapacity.

Alabama imposes no state estate tax. Federal estate tax still applies to larger estates. Starting and Running a Business

Title 10A covers formation, operation, and dissolution for sole proprietorships, partnerships, LLCs, and corporations. LLCs are the common choice for small businesses because they combine flexible management with personal liability protection. Corporations and limited liability entities doing business in Alabama owe corporate income tax at 6.5% on net income, whether the entity was formed in Alabama or another state.21Atlas Alabama. Employee or Independent Contractor

Misclassifying employees as independent contractors leads to back taxes, penalties, and unpaid benefits liability. The IRS weighs three categories: behavioral control (whether the business directs what work is done and how), financial control (who provides tools, how the worker is paid, whether expenses are reimbursed), and the relationship (written contracts, benefits, permanence). Working in Alabama

Alabama is a strictly at-will employment state. An employer can terminate a worker at any time, for any reason or no reason, without advance notice. Employees can quit on the same terms. The exceptions are the important part.

Federal antidiscrimination law overrides the at-will default. An employer cannot fire someone based on race, color, national origin, religion, sex (including pregnancy, sexual orientation, and gender identity), disability, age (40 and older), or genetic information.23U.S. Equal Employment Opportunity Commission. A written employment contract or union agreement limiting termination to specific grounds overrides at-will as well.

Alabama has no state minimum wage, so the federal Fair Labor Standards Act sets the floor. The federal minimum wage is $7.25 per hour. The federal salary threshold for exempt employees in 2026 remains $35,568 per year ($684 per week) after courts blocked a planned increase by the Department of Labor. Workers earning below that threshold are generally entitled to overtime at 1.5 times their regular rate for hours worked over 40 in a week.

Consumer Protection Rules to Know

Alabama’s Deceptive Trade Practices Act gives the state attorney general authority to investigate and prosecute businesses for false advertising or fraudulent sales practices. Lemon Law

Alabama’s Lemon Law covers new motor vehicles when warranty repairs fail. If a new vehicle has a defect covered by the manufacturer’s express warranty and the manufacturer cannot fix it after reasonable attempts, the buyer can choose a replacement vehicle or a full refund covering purchase price, sales tax, registration fees, finance charges incurred after reporting the defect, and the cost of alternative transportation. Three or more repair attempts for the same problem within 24 months or 24,000 miles (whichever comes first) creates a presumption that the manufacturer has had a reasonable chance to fix it.25Alabama Legislature. Payday Lending

Alabama permits payday lending and regulates it through a fee structure rather than a traditional interest cap. Lenders may charge $17.50 per $100 borrowed, which on a typical two-week loan works out to roughly 456% APR. Borrowers who roll loans over repeatedly can pay many times the original loan in fees.

Debt Collection

The federal Fair Debt Collection Practices Act applies in Alabama. Debt collectors cannot contact you before 8 a.m. or after 9 p.m., cannot call your workplace if they know your employer prohibits personal calls, and cannot harass you by phone, text, or email.
