Alabama does not use a single Alabama lien release form. The document depends on the type of lien: a mortgage or other real estate lien is cleared by recording a satisfaction with the county probate office, while a vehicle lien is released by the lienholder signing the certificate of title or, if the title is unavailable, submitting form MVT 5-63. Both tracks carry statutory deadlines, and Alabama gives you specific remedies when a lienholder fails to file the release.1Alabama Legislature. Releasing a Mortgage or Other Real Estate Lien
Alabama’s Residential Mortgage Satisfaction Act governs the release of mortgage liens on residential property.2Alabama Legislature. Alabama Code 35-10-90 – Short Title; Application; Definitions Once the loan is paid in full, the secured creditor must prepare and submit a satisfaction document for recording in the probate office within 30 days.1Alabama Legislature. Alabama Code 35-10-92 – Submission of a Satisfaction of a Security Instrument for Recording There is no statewide standard form. Lenders typically prepare a written instrument of satisfaction, though Alabama also allows the older method of entering satisfaction directly in the margin of the recorded mortgage book at the probate office. Either approach clears the encumbrance once recorded.
What the Satisfaction Document Must Include
The release has to match the original lien precisely so the probate judge’s office can locate and cancel it. Include:
- The full legal names and current addresses of the lienholder and the borrower.
- The original recording information: the date, book number, and page number where the original mortgage was filed.
- A legal description of the property sufficient to identify it without ambiguity.
- An explicit statement that the underlying debt has been paid in full and the lien is released.
Recording the Release
The notarized satisfaction gets filed with the probate judge’s office in the county where the original mortgage was recorded. Recording fees vary by county; Jefferson County, for example, charges a flat $16.00, plus $1.00 for each additional mortgage satisfied on the same document.3Probate Court of Jefferson County, Alabama. Recording Costs Call the local probate office before filing to confirm the current fee. Keep the stamped copy you receive back; that is your permanent proof the lien is gone.
Releasing a Vehicle Lien
Vehicle lien releases go through the county licensing official (the tag office), not the probate office. The default process is simple: the lienholder signs the release section of the existing certificate of title, and the owner takes the signed title to the county office for a clean title.
When the Title Is Lost or Unavailable
If the paper title has been lost, stolen, or damaged, the lienholder completes form MVT 5-63 (Application for Lien Release). The MVT 5-63 then supports an application for a replacement title. The release must identify the vehicle by its complete Vehicle Identification Number.4Alabama Administrative Code. Electronic Lien and Title
Alabama runs an Electronic Lien and Title (ELT) program. If the lender is a designated ELT agent, the title is issued electronically instead of on paper, and the release happens electronically through the system when the loan is satisfied. The first printed physical title from an ELT is free; a replacement after that requires a separate replacement title application.5Alabama Department of Revenue. Mechanic’s Lien Releases
A mechanic’s lien for unpaid contractor or subcontractor work must be enforced by lawsuit within six months after the secured debt matures. If no suit is filed in that window, the lien expires. Even so, the lienholder should record a formal release, because the expired lien will keep clouding title until it is cleared from the record.
If you need to sell or refinance before the six-month enforcement period ends, Alabama lets you transfer the mechanic’s lien off the real property and onto a cash deposit or surety bond. File a copy of the recorded lien with the court along with a deposit or bond equal to the lien amount plus three years of interest at eight percent, plus $100 for court costs. Once the court certifies the transfer, the real property is released from the lien.7Alabama Legislature. Signing and Notarization
Every lien release must be signed by the lienholder or someone with actual authority to act on the lienholder’s behalf. When the lienholder is a bank or corporation, the signer typically needs authority granted through a corporate resolution. Probate offices reject releases signed by someone who cannot show that authority.
Real estate releases going to the probate office also need the signature acknowledged before a notary public. Without proper notarization, the probate office will not accept the document.
Remote Online Notarization
Alabama permits remote online notarization. The signer can appear through two-way audio-video communication, provided the notary is physically located in Alabama and records the session. That recording must be maintained for seven years.8Alabama Legislature. Deadlines and Penalties for Late Release
A residential mortgage lender must submit the satisfaction for recording within 30 days of receiving full payment.1Alabama Legislature. Alabama Code 35-10-92 – Submission of a Satisfaction of a Security Instrument for Recording Equity lines of credit are not considered paid in full until the line has been formally closed and all obligations satisfied.
Under Alabama’s older mortgage statutes, which apply to non-residential mortgages and the marginal-entry method, a mortgagee who fails to enter satisfaction within 30 days after a written request forfeits $200 to the aggrieved party, unless there is a good and sufficient reason for the delay.9Code of Alabama. For vehicles, the Department of Revenue can require electronic lien releases within 10 days of satisfaction.6Alabama Legislature. Alabama Code 32-8-64.2 – Release of Certain Liens If your vehicle lienholder hasn’t released within a reasonable time after payoff, the practical leverage is a written demand followed by a complaint to the Department of Revenue.
When a Lienholder Won’t File the Release
This is where most people get stuck. You paid the loan off, maybe years ago, and the release was never filed. Now the old lien is blocking a sale or refinance.
Written Demand and Satisfaction Agent
For residential mortgages, if the lender misses the 30-day recording deadline, a satisfaction agent can force the issue. Only a title insurance company or an attorney licensed in Alabama qualifies.10Alabama Legislature. Alabama Code 35-10-93 – Service as a Satisfaction Agent The agent sends notice by certified mail to the lender alerting them that they’ve failed to record the satisfaction.9Code of Alabama. Alabama Code Title 35 Chapter 10 – Mortgages For non-residential mortgages, the older statutory remedy still applies: send a written demand by certified mail, return receipt requested, to the mortgagee or their agent. If the entry is not made within 30 days, you are entitled to the $200 statutory forfeiture.
Defunct or Unreachable Lienholders
When the lienholder has gone out of business, been absorbed by another company, or simply cannot be found, the statutory demand route fails because there is nobody to demand from. The standard remedy then is a quiet title action, a lawsuit in circuit court asking the judge to declare your title free of the old lien. You have to make reasonable efforts to notify anyone with a potential interest, and if nobody contests, the court can enter a default judgment clearing the title. That order is recorded in the probate office to remove the cloud. Quiet title actions generally require an attorney and can take several months, but they are sometimes the only path when the lienholder has vanished.
Confirm the Release Was Actually Recorded
Don’t assume the lienholder handled it. After the final payment, request written confirmation that the lien will be released, and within 45 days check the probate office record or your vehicle title status to verify. Keep the payoff confirmation letter, the final payment receipt, and any correspondence from the lender indefinitely. Those documents are what you fall back on if a release dispute surfaces years later.
