Alabama Online Insurance Verification System: Lapses and Appeals

Alabama’s Online Insurance Verification System is an electronic database the state uses to confirm, in real time, whether your vehicle carries active liability coverage. Created by the Department of Revenue under Legislative Act 2011-688, it links directly to insurance company records so law enforcement officers, county tag offices, and ADOR can check your coverage during traffic stops, at registration renewal, and through random audits.1Alabama Department of Revenue. How the System Checks Your Coverage

Every insurance company licensed to write auto policies in Alabama must give the state electronic access to its policyholder records. When you register a vehicle, renew tags, or get pulled over, OIVS queries your insurer’s database and returns a coverage status. If the system verifies your policy, nothing else is needed. If it can’t, you may be asked for a physical or digital insurance card, a declarations page, or a letter from your insurer.2Alabama Legislature. ADOR also runs periodic random verification checks. When the system flags a vehicle, ADOR mails a notice to the last known address asking the owner to prove continuous coverage on a specific verification date.3Alabama Legislature. Alabama Code 32-7A-11 – Online Insurance Verification System

The Coverage OIVS Is Looking For

Alabama law prohibits operating, registering, or keeping registration on any vehicle designed for public roads without liability coverage.4Alabama Legislature. Alabama Code 32-7A-4 – Liability Insurance Required The minimum limits the system is verifying against are:

  • $25,000 for bodily injury or death to one person per accident
  • $50,000 for total bodily injury or death when two or more people are hurt in one accident
  • $25,000 for property damage per accident

A combined single-limit policy of at least $75,000 per accident also satisfies the requirement.5Alabama Department of Revenue. What Are the Insurance Requirements? What Happens at a Traffic Stop

When an officer pulls you over, they can query OIVS on the spot. If the system confirms coverage, you’re fine even without a physical card. If OIVS can’t verify coverage and you can’t produce proof of insurance, the response depends on your history within a two-year registration period:

  • First violation: the officer directs you to move the vehicle to a safe location off the roadway.
  • Second violation: an approved towing service is called to tow the vehicle to a location you choose. You get it back by showing proof of insurance and paying towing fees.
  • Third or subsequent violation: the vehicle is impounded until you prove valid coverage and pay towing, impoundment, and storage fees.

Officers also have general discretion to impound any vehicle whose operator can’t provide evidence of registration and insurance. Handing over a fraudulent insurance card is a separate traffic violation on top of the underlying charge.

Penalties When OIVS Confirms a Lapse

Operating a vehicle without liability coverage is a Class C misdemeanor. When OIVS confirms a lapse, ADOR suspends the vehicle’s registration, and reinstatement requires both proof of current insurance and a fee:

During the mandatory-filing period, your insurer files documentation with the state confirming your coverage is active. If the policy lapses or is canceled, the insurer notifies the state and your registration faces immediate suspension again. Switching insurers during that period is allowed, but the new company has to take over the filing without a gap.

Responding to a Verification Notice

A verification notice arrives by mail after OIVS flags your vehicle during a random check. You get 30 calendar days from the date on the notice to respond, and the deadline is what determines whether your registration gets suspended.3Alabama Legislature. If you had coverage on the verification date, send documentation showing it: a current insurance card, a declarations page with effective dates, or a letter from your insurer confirming coverage on that specific date. The Stored or Inoperable Vehicle Exemption

If coverage lapsed because the vehicle was parked or otherwise not being driven, a narrow exemption exists. All four conditions have to be true:

  • You surrender the registration and license plate to your county licensing official within 30 days of the verification notice.
  • You haven’t already claimed the exemption during the current registration period for that vehicle.
  • The vehicle wasn’t involved in an accident on a public road during the lapse.
  • Neither you nor anyone else received a citation while driving the vehicle during the lapse.

Meet all four and your current registration is revoked for the rest of the registration period rather than suspended, and the $200 or $400 reinstatement fee doesn’t apply.3Alabama Legislature. When OIVS Is Wrong

The system sometimes flags a vehicle as uninsured even when the policy is valid. The usual causes are reporting delays after you switch insurers, a data entry error at the insurance company, or a timing mismatch between when your policy started and when the insurer transmitted it to OIVS.

Two habits reduce the risk. When you switch companies, confirm with your new insurer that the policy has been reported to OIVS before the old policy’s cancellation date, and carry a declarations page or insurance card during any lag. When you sell or transfer a vehicle, notify ADOR promptly and surrender the plate to your county licensing official, because the insurance obligation can follow the registration until it’s formally closed out.

If a notice arrives and the fault lies with your insurer, call them and ask for a corrected electronic filing to OIVS. Most reporting mistakes clear up quickly. If a suspension has already been issued because of an insurer error, you may still need to go through formal reinstatement and then seek a refund of fees paid in error.

Appealing a Suspension

Appeals do not go back to ADOR. You file a notice of appeal with the Alabama Tax Tribunal within 30 days of the date ADOR mailed the suspension notice.10Alabama Department of Revenue. The 30-day deadline is firm. Missing it forfeits the right to appeal that suspension. Before filing, gather insurance cards, declarations pages, payment receipts, and any correspondence with your insurer or ADOR. The clearer the record of continuous coverage on the disputed date, the stronger the appeal.
