Alabama Paid Family Leave: Eligibility, FMLA, and Disability Pay

Alabama paid family leave is guaranteed only to state and public employees, and only for the arrival of a child. A law effective July 1, 2025 gives qualifying government workers paid parental leave after a birth, stillbirth, miscarriage, or adoption.1Alabama State Department of Education. FY25-1008 Paid Parental Leave Private employers in Alabama are not required to provide any paid family or medical leave, so workers in the private sector have to assemble their own coverage from employer benefits, short-term disability insurance, and the unpaid job protection the federal FMLA provides.

Paid Parental Leave for State and Public Employees

The Alabama Public Employee Paid Parental Leave Act of 2025 pays 100 percent of base salary during the leave and does not require you to use or burn through accrued sick leave, annual leave, or any other paid time off first.2Alabama Legislature. Alabama Code 36-6A-3 – Administration of Parental Leave The weeks you take run concurrently with any FMLA leave, meaning the same time counts against both entitlements rather than stacking.1Alabama State Department of Education. How much time you get depends on your sex and the qualifying event:

The statute defines miscarriage as the loss of an unborn child at or after twelve weeks of gestation, confirmed in writing by a licensed healthcare professional.4Alabama Legislature. Alabama Code 36-6A-1 – Short Title; Definitions Foster care placements are not covered. The law also does not cover leave to care for a sick family member or to recover from your own non-pregnancy illness; for those, FMLA job protection is what you have.

Who Qualifies

You must have at least 12 consecutive months of service with a qualifying employer immediately before the qualifying event. Three categories of workers are eligible:4Alabama Legislature. Alabama Code 36-6A-1 – Short Title; Definitions

  • State employees, including legislative personnel, court officials and employees of the Unified Judicial System, Administrative Office of Courts employees, permanent hourly employees, and members of the classified, unclassified, and certain exempt services.
  • Certified and noncertified employees of local school systems, including employees of the Alabama Institute for Deaf and Blind.
  • Employees of the Alabama Community College System or any of its institutions.

Service is measured across any qualifying agency within the same category. A teacher who spent seven months at one district and five at another meets the threshold because both are local education agencies.4Alabama Legislature. Alabama Code 36-6A-1 – Short Title; Definitions

Private-Sector Workers in Alabama

No Alabama law requires private businesses to provide paid family or medical leave. Whether you get any paid time off for childbirth, caregiving, or your own serious illness depends entirely on what your employer chooses to offer, so your first stop is your employment contract, employee handbook, or benefits summary.

Since August 2023, insurance carriers have been authorized to sell paid family leave insurance products in Alabama that employers can purchase on a voluntary basis. These policies can cover events like the birth or adoption of a child and caring for a family member with a serious health condition. If your employer has not set up a paid leave program on its own, ask whether it carries one of these policies or would consider doing so.

Short-Term Disability When You Need Paid Time

For a pregnancy recovery or your own medical condition, short-term disability insurance is often the main way private-sector workers in Alabama get income during an absence. Policies generally replace 40 to 70 percent of base salary, with coverage lasting from a few weeks to six months depending on the plan. Alabama does not require employers to offer it, so coverage is usually either through an employer-sponsored group plan or bought individually. Individual policies typically run $20 to $200 per month, with premiums varying by age, occupation, benefit amount, and the length of the elimination period before benefits start.

If your employer offers short-term disability, read the plan documents for notification deadlines. Many plans require you to file a claim within a set number of days after your disability begins, and missing that window can delay or forfeit benefits. Your healthcare provider will need to complete certification paperwork documenting the condition and the expected recovery timeline.

Federal FMLA Job Protection

The Family and Medical Leave Act gives up to 12 weeks of unpaid, job-protected leave per year for qualifying reasons. FMLA does not pay you, but it prevents your employer from firing you for taking covered time off. For many Alabama workers, it is the only thing standing between a family emergency and a lost job.

To qualify, you must have worked for your employer for at least 12 months and logged at least 1,250 hours in the previous 12-month period, and your employer must have at least 50 employees within 75 miles of your worksite.5Office of the Law Revision Counsel. 29 U.S. Code 2611 – Definitions Workers at smaller companies are not covered.

Qualifying reasons include the birth or adoption of a child, caring for a spouse, child, or parent with a serious health condition, and a serious health condition that prevents you from doing your job.6Office of the Law Revision Counsel. 29 U.S. Code 2612 – Leave Requirement The Department of Labor publishes optional certification forms (WH-380-E for your own condition, WH-380-F for a family member’s), and employers can accept equivalent documentation from your healthcare provider.7U.S. Department of Labor. Military Family Leave

FMLA adds two protections for military families. Employees can take up to 12 weeks of leave for qualifying situations that arise when a spouse, child, or parent is on active duty or called to active duty, including short-notice deployments, military ceremonies, and family support briefings.8U.S. Office of Personnel Management. Family and Medical Leave Qualifying Exigency Leave Employees caring for a current servicemember or recent veteran with a serious injury or illness can take up to 26 weeks in a single 12-month period. Keeping Your Health Insurance During FMLA Leave

Your employer must maintain your group health coverage during FMLA leave on the same terms as if you were still working. Family coverage stays family coverage, and any plan changes that apply to other employees apply to you.10U.S. Department of Labor. Fact Sheet 28A – Employee Protections Under the Family and Medical Leave Act You still owe your share of the premiums. When FMLA overlaps with paid leave (such as Alabama’s state parental leave), premiums come out of your paycheck as usual. During unpaid FMLA leave, your employer must give you written notice explaining how and when to pay.11U.S. Department of Labor. Family and Medical Leave Act Advisor Set up a payment method before leave starts, because missed premiums can eventually cost you coverage.

If Your Leave Is Denied

State and public employees who believe parental leave was improperly denied can file through their agency’s grievance process. Strict time limits apply at each step, and failing to appeal within the specified window is treated as abandoning the grievance.12Alabama Administrative Code. For FMLA violations in either sector, the U.S. Department of Labor’s Wage and Hour Division investigates complaints, and you can also file a private lawsuit against an employer that interferes with your FMLA rights or retaliates against you for using them. Alabama’s parental leave statute guarantees job restoration to the same or an equivalent position, so an adverse action tied to your use of leave is worth pursuing through formal channels rather than letting it stand.3Alabama Legislature.
