To buy goods in Alabama without paying the state’s 4% sales tax, a qualifying organization files the Alabama tax-exempt form, officially Form ST: EX-A1, through the My Alabama Taxes portal at no cost.1Alabama Department of Revenue. Who Qualifies for a Certificate
Alabama grants exemptions two ways: based on who is buying, and based on what is being bought.
Entity-Based Exemptions
The federal government, the State of Alabama, Alabama counties, and incorporated municipalities are exempt from paying sales and use tax on their purchases.3Legal Information Institute. Private schools offering conventional courses of study similar to public schools are included; nurseries, day care centers, and home schools are not.4Alabama Legislature. Nonprofits can qualify, but not automatically. Holding federal 501(c)(3) status does not by itself create an Alabama sales tax exemption. The organization must identify a specific Alabama statute that grants the exemption, apply for a certificate, and be approved before making tax-free purchases.
Product-Based Exemptions
Wholesalers and manufacturers can obtain a certificate covering raw materials or goods that become ingredients or components of products they sell.5Alabama Administrative Code. Alabama Administrative Code 810-6-5-.02 – State Sales and Use Tax Certificate of Exemption (Form STE-1) Issued for Wholesalers, Manufacturers and Other Product Based Exemptions Sales tax is designed to reach the final consumer, not every link in the supply chain.
Straight resale purchases work differently. A licensed retailer buying inventory to resell generally provides the vendor with its Alabama sales tax license rather than an exemption certificate; the license itself shows the retailer will collect tax from the end buyer.
How to Apply Through My Alabama Taxes
All applications go through the My Alabama Taxes (MAT) portal at myalabamataxes.alabama.gov. There is no filing fee, and the Department publishes a step-by-step guide.6Alabama Department of Revenue. - Create or log into a MAT account. If you don’t have one, click “Register a business/Obtain a new tax account number” under the Businesses panel.
- Enter identifying information and select “Sales Tax Exemption” as the tax type.
- Complete the taxpayer and contact sections, then answer the preliminary questions. Your answers determine which application appears next.
- Choose the exemption type from the drop-down. For product-based exemptions, describe what you manufacture or sell.
- Select the county of your primary Alabama business location, or check the out-of-state box.
- Upload the required supporting documents.
- Review, submit, and save the confirmation number for status tracking.
Results are delivered through the portal, and you can download the finalized certificate there once it’s approved.
Documents to Attach
The required attachments depend on the entity type. Missing or incorrect documents are the most common reason applications stall.7Alabama Department of Revenue. Application for Sales Tax Certificate of Exemption (Form ST EX-A1)
- Corporations: a certified copy of the certificate of incorporation, amended certificate of incorporation, certificate of authority, or articles of incorporation.
- LLCs and LLPs: a certified copy of the articles of organization.
- All applicants: names, titles, home addresses, and Social Security numbers or FEINs for each officer, partner, or member. Sole proprietors and partnerships also need a valid Alabama driver’s license or other citizenship documentation.
- Multiple locations: attach a schedule listing each one.
Every applicant needs a Federal Employer Identification Number. The application must also cite the specific Alabama statute or regulation that grants the exemption; the Department uses that citation to confirm a statutory basis actually exists. Nonprofits should point to the exact section of Alabama law that makes their purchases exempt, not just an IRS determination letter. The Certificate Lasts One Year
Alabama certificates expire one year from the date of issuance, and renewal must happen before the end of the month in which the certificate expires. Miss that deadline and the ability to make tax-exempt purchases stops immediately; it does not come back until you file a renewal and the Department reinstates the certificate.2Alabama Administrative Code. A certificate issued on March 15 expires the following March. If it isn’t renewed by the end of that March, every purchase made after that date is taxable, even for organizations that have been exempt for years. Set a calendar reminder at least 30 days out. Renewals use the same MAT portal as the original application.
Using the Certificate With Vendors
Once approved, provide a copy of the certificate to each vendor. For ongoing purchasing relationships you usually only need to furnish it once; the vendor keeps it on file and applies the exemption to qualifying purchases going forward, as long as the nature of your purchases doesn’t change.5Alabama Administrative Code. The certificate only covers purchases tied to the exempt purpose. A nonprofit with an exemption for educational materials cannot use the same certificate to buy office furniture for an unrelated side business. If an auditor later decides a purchase didn’t qualify, the exemption won’t hold and the tax becomes due.
The certificate covers both sales tax on in-state purchases and use tax on goods bought out of state and used in Alabama. If your organization is exempt from sales tax, the same categories of purchases are exempt from use tax.
Contractors on Government Projects File Differently
Licensed contractors and subcontractors working on government construction projects don’t use the general annual certificate. They apply on a per-project basis for a certificate covering the building materials, construction supplies, and other tangible property that will become part of the structure.9Alabama Legislature. The exemption applies to contracts with governmental entities and covers state, county, and municipal sales and use taxes. The contractor gives the Department an estimated dollar amount of tax-exempt purchases for the project, and the Department issues a project-specific certificate to present to suppliers. Highway, road, and bridge projects are included. A contractor working on several government projects needs a separate certificate for each.10Alabama Administrative Code. Penalties for Filing a False Certificate
Filing a fraudulent exemption certificate is a misdemeanor in Alabama. A conviction carries a fine of $25 to $500. On top of the criminal penalty, the person who filed the false certificate is personally liable to the Department of Revenue for all sales and use taxes that should have been collected on the affected purchases, plus interest and penalties.11Alabama Administrative Code.
