Alameda County Marriage Ceremony: Formats, License, and Fees

An Alameda County marriage ceremony can be arranged three ways through the Clerk-Recorder’s office: a scheduled civil ceremony in Oakland, a walk-in express ceremony at the Oakland or Tri-Valley office, or a virtual ceremony over video conference. A public marriage license plus a civil ceremony runs $156 total. California has no waiting period, and the license stays valid for 90 days from the date it’s issued.1Alameda County Auditor-Controller/Clerk-Recorder. Marriage Services – Virtual

Which Ceremony Format Fits Your Situation

All three options are performed by a county deputy marriage commissioner and all three cost the same $75 for the ceremony itself. What differs is where you go, how many people you can bring, and whether you need an appointment.

Scheduled In-Person Ceremony

A standard civil ceremony happens by appointment at the Clerk-Recorder’s main office, 1106 Madison Street in Oakland. You can bring up to 25 guests into the building, and at least one witness has to attend.2Alameda County Auditor-Controller/Clerk-Recorder. Marriage Ceremonies

Express Marriage Ceremony

The express option lets you walk in without an appointment, apply for your license, and marry at the service counter during the same visit. It’s the only ceremony type offered at both the Oakland and Tri-Valley offices. Space is tight: two guests besides the couple, plus at least one witness. Arrive before the 4:00 PM cutoff.3Alameda County Auditor-Controller/Clerk-Recorder. Express Marriage Ceremony

Virtual Ceremony

Alameda County will perform the entire process by video conference, from license application through the ceremony itself. Both partners must be physically together and physically in California during the call. You cannot join from separate locations, and you cannot join from another state.1Alameda County Auditor-Controller/Clerk-Recorder. Marriage Services – Virtual

Public or Confidential License

Before any ceremony, you need a marriage license, and Alameda County issues two types. A public license costs $81 and becomes part of the public record after filing. At least one witness (and no more than two) must sign the license during the ceremony.4Alameda County Auditor-Controller/Clerk-Recorder. Marriage Services – In Person

A confidential license costs $90 and is available only to couples who are already living together. The record isn’t open to public inspection; a court order is required for anyone else to view it. Confidential licenses don’t require a witness signature.5California Legislative Information. California Code FAM 500

Either license is good for 90 days, is only valid in California, and expires unused if the ceremony doesn’t happen in that window. If it expires, you apply and pay again.1Alameda County Auditor-Controller/Clerk-Recorder. Marriage Services – Virtual

What to Bring

Both partners must appear together, whether in person or by video, with valid unexpired government-issued photo identification. A driver’s license, state ID, passport, military ID, or consular card all work. If your photo ID doesn’t display your full legal name, bring a certified birth certificate or court-ordered name change document as well.1Alameda County Auditor-Controller/Clerk-Recorder. You must be at least 18 and currently unmarried. The application asks for each parent’s full name, including maiden names, and birthplace, so have that ready before you fill out the form.

If either of you was previously married or in a state-registered domestic partnership, you’ll need the exact date it ended and how it ended (divorce, annulment, or death). When the dissolution happened within the last 30 days, bring a certified copy of the final court judgment; the date alone won’t be enough.1Alameda County Auditor-Controller/Clerk-Recorder. Having a Friend or Family Member Officiate

Alameda County’s One-Time Deputy Marriage Commissioner program lets a friend or relative get temporary authority to marry you. Your designee has to be at least 18 and a U.S. citizen, and you need to already have a valid marriage license before they apply.7Alameda County Auditor-Controller/Clerk-Recorder. One-Time Deputy Marriage Commissioner Program

The fee is $75, paid by check or money order to the Alameda County Clerk-Recorder. Submit the application four to six weeks before the wedding. The office does not accommodate rush requests or walk-ins for this program. Your designee can either take the oath in person at the office or complete a notarized oath by mail, provided the notarized paperwork reaches the office at least a month before the ceremony. You can also be married by any member of the clergy authorized by their denomination, or by a California state court judge or retired judge. Getting Your Certified Marriage Certificate

Once the signed license reaches the Clerk-Recorder, recording takes roughly two weeks. Certified copies can’t be ordered until the recording is complete.8Alameda County. Ordering a Marriage Certificate

A certificate doesn’t arrive automatically. You submit a separate request and pay $21 per certified copy, plus a $2 convenience fee for online card orders. Online payments accept only Visa and MasterCard.8Alameda County. Ordering a Marriage Certificate Order two or three at once. You’ll want them for insurance updates, bank accounts, passport changes, and employer records, and each later request means paying the fee and waiting again.

Changing Your Name at the Same Time

California lets you change your middle or last name as part of the marriage license application, but the change has to be made on the license before the ceremony. You can’t add a name change to the license after you’re married. Miss the window and the alternative is a separate court-ordered name change, which costs more and takes longer.9California Courts | Self Help Guide. Change Your Name When You Get Married

For your last name, the options are your spouse’s last name, either partner’s birth surname, or a hyphenated or combined version of both. For your middle name, you can take your spouse’s last name, either partner’s birth surname, or combine your current middle name with a current last name. First names cannot be changed through this process.9California Courts | Self Help Guide. Change Your Name When You Get Married

Once you have a certified marriage certificate reflecting the new name, update your Social Security card first. Most other agencies and institutions require the Social Security change to be processed before they’ll update their records. The Social Security Administration recommends waiting at least 30 days after the marriage date before applying, and you can start the process at ssa.gov.10Social Security Administration.
