If you got a ticket in Alameda County, traffic school lets you keep the violation off your public driving record by paying your full bail, paying a court administrative fee, and finishing an eight-hour approved course within 90 days. The Alameda County Superior Court can approve this under California Vehicle Code 42005 as long as your citation is an eligible moving infraction and you haven’t used traffic school for another violation in the past 18 months.1California Legislative Information. California Code Vehicle Code 42005 The school files your completion certificate electronically with the court and the DMV, and the conviction is held confidential so no point is added to your record.
Who Qualifies
Three things have to be true before a clerk can approve your request. You held a valid driver’s license when you were cited. The citation is a moving infraction, not a misdemeanor. And you have not attended traffic school for a violation committed within the previous 18 months, measured from violation date to violation date rather than from the date you took the course.2Superior Court of California. Several categories of violations are ineligible by statute or court policy:
- Speeding 25 mph or more over the limit, which carries two violation points.1California Legislative Information. California Code Vehicle Code 42005
- Alcohol or drug-related offenses, including DUI and violations involving substance possession.2Superior Court of California. Traffic School
- Hit-and-run and reckless driving.1California Legislative Information. California Code Vehicle Code 42005
- Violations where the ticket itself requires a mandatory court appearance. A clerk cannot approve traffic school in those cases.2Superior Court of California. Traffic School
If your case has a failure to appear, an outstanding warrant, or a civil assessment from a missed deadline, you have to clear those first and pay what you owe before the court will consider a traffic school request.2Superior Court of California. Traffic School
What Traffic School Actually Does to Your Record
Traffic school does not dismiss your ticket. Under Vehicle Code 41501, the court enters a conviction but orders the DMV to hold it confidential.4California Legislative Information. California Code Vehicle Code 41501 The practical effect is that the conviction does not appear on your public driving record, and no violation point is counted against you under Vehicle Code 1808.7.3California Legislative Information. California Code Vehicle Code 1808.7 Insurance companies pulling your record through standard channels will not see it.
The conviction still exists in the court’s internal records. It uses up your one eligible visit for the next 18 months, so a second ticket within that window cannot be kept confidential the same way.4California Legislative Information. California Code Vehicle Code 41501
How to Request Traffic School
You should receive a courtesy notice from the court about four weeks after your citation. If it doesn’t come, bring your ticket to the Traffic Division window at any of the three Alameda County locations: the Fremont Hall of Justice, the Wiley W. Manuel Courthouse in Oakland, or the East County Hall of Justice in Dublin.5Superior Court of California. Traffic You can also look up and pay the ticket online through the court’s traffic payment portal, and when you pay, you select the traffic school option so the court registers your intent to attend.6Superior Court of California, County of Alameda. What It Costs
The total breaks into three separate payments. First is the full bail amount for your offense. Under Vehicle Code 42007, the traffic school fee equals the total bail on the countywide bail schedule, including all assessments and surcharges, so the number depends on what you were cited for.8California Legislative Information. California Code Vehicle Code 42007 Second is a non-refundable court administrative fee; Alameda County doesn’t publish the exact amount online, but it appears on your courtesy notice and the Traffic Division can give it to you by phone.2Superior Court of California. Traffic School Third is tuition to the school you choose, which varies by provider and format.
If paying it all at once is hard, the court can accept at least 10 percent down with a written agreement to pay the balance within 90 days, with a processing fee of up to $35 for the installment plan.8California Legislative Information. California Code Vehicle Code 42007 You can also ask the court to reduce your bail amount based on financial hardship.
The 90-Day Deadline
You have exactly 90 days from the date of payment to finish the course and have your certificate filed with the court. Miss it and three things happen together: your bail is forfeited, the violation is reported to the DMV as a standard conviction, and a point lands on your driving record.2Superior Court of California. Traffic School At that point you have paid the bail, the admin fee, and your tuition, and you still get the point. If something comes up, contact the court before the 90 days run out to ask about an extension. Courts have some discretion to grant more time, but asking after the deadline is a much weaker position.
Ignoring the ticket entirely is worse. Failing to appear or pay can be charged as a misdemeanor under Vehicle Code 40508, and the court can tack on a civil assessment of up to $100.9California Legislative Information. Verify that the filing landed. The court’s eCourt Public Portal does not cover traffic cases, so use the court’s traffic ticket lookup page or call the Traffic Division (Monday through Friday, 8:00 a.m. to 3:00 p.m.) a week or two after you finish.12Superior Court of California, County of Alameda. Commercial License Holders
If you hold a Class A, Class B, or commercial Class C license, the rules are different. Since September 2012, the Alameda County court has allowed commercial license holders to attend traffic school when the violation happened in a non-commercial vehicle, and completing the course prevents the point from counting toward a negligent-operator determination.2Superior Court of California. What traffic school will not do for a CDL holder is make the conviction confidential. It stays visible on your DMV record whether or not you complete the course.3California Legislative Information. California Code Vehicle Code 1808.7 That matches the federal rule at 49 CFR 384.226, which prohibits states from masking or deferring traffic convictions for anyone holding a commercial learner’s permit or CDL, regardless of the vehicle involved.
