Alaska Sales Tax Nexus: Physical, Economic, and Marketplace Rules

Your business has Alaska sales tax nexus when it either sets up a physical presence in an Alaska municipality that levies a sales tax or delivers at least $100,000 in gross sales into the state during the current or previous calendar year. Alaska has no statewide sales tax, so nexus is always with a specific city or borough, not with the state itself. Roughly 110 local jurisdictions impose their own sales taxes at rates between 1% and 7%,1Division of Community and Regional Affairs. Sales Tax and whether you owe anything turns on how your business connects to those jurisdictions.

Why Alaska’s System Changes the Nexus Question

Each taxing city or borough passes its own ordinance with its own rate, exemptions, and rules.2Department of Commerce, Community, and Economic Development. Alaska Sales Tax Information To keep that patchwork workable for sellers outside Alaska, the Alaska Remote Seller Sales Tax Commission (ARSSTC) was created in 2019 through an intergovernmental agreement.3Alaska Remote Seller Sales Tax Commission. About Member jurisdictions follow a uniform tax code, and remote sellers deal with a single online portal instead of filing with every town individually.

Not every taxing municipality has joined. If you sell into an Alaska city that charges sales tax but has not adopted the uniform code, you still owe that tax and file directly with the municipality on its own forms.4Alaska Remote Seller Sales Tax Commission. FAQs for Sellers Before assuming the ARSSTC portal covers all your Alaska obligations, check the member jurisdiction list against the full roster of taxing municipalities.

Physical Presence Nexus

Section 280 of the Uniform Alaska Remote Seller Sales Tax Code defines what counts as physical presence in a jurisdiction:5Alaska Remote Seller Sales Tax Commission. Uniform Code 2024 Revisions

  • Any place of business, including a distribution house, sales office, or warehouse.
  • Employees, agents, or sales representatives soliciting business or providing services within the jurisdiction.
  • Inventory held in a warehouse, fulfillment center, or any other storage location inside the jurisdiction.
  • Real or tangible personal property that you rent or lease located in the jurisdiction.

A seller that establishes physical presence in a jurisdiction during any calendar year is treated as having nexus there for the following calendar year as well.5Alaska Remote Seller Sales Tax Commission. Uniform Code 2024 Revisions That carryover matters for seasonal pop-ups, trade show inventory, and other short-term setups. The obligation outlasts the visit.

Physical presence also changes where you file. For sales tied to that physical location, you register and remit directly to the municipality, not through the ARSSTC portal.6Alaska Remote Seller Sales Tax Commission. Business/Sellers Your remote sales into ARSSTC member jurisdictions still go through the commission. If you have both, you separate the two revenue streams and file each through the correct channel.

One boundary worth stating: Alaska does not recognize click-through nexus. Paying commissions to an in-state affiliate who refers customers through a website link does not, by itself, create a tax collection obligation.

Economic Nexus for Remote Sellers

You do not need any physical footprint in Alaska to owe local sales tax. If your statewide gross sales of products or services delivered into Alaska meet or exceed $100,000 in the current or previous calendar year, you have economic nexus and must register with the ARSSTC.6Alaska Remote Seller Sales Tax Commission. Business/Sellers The commission also used to recognize a 200-transaction alternative trigger, but that was repealed effective January 1, 2025. Only the dollar threshold remains.7Streamlined Sales Tax. Alaska Remote Seller Sales Tax Commission – Threshold Change for Sellers

How the $100,000 Threshold Is Calculated

The number is gross, not taxable. Every sale delivered into Alaska counts, including sales into non-taxing communities and sales of exempt items.4Alaska Remote Seller Sales Tax Commission. FAQs for Sellers It is a statewide figure across all Alaska jurisdictions, not a per-municipality test. $60,000 into Juneau plus $50,000 into Anchorage puts you over, even though neither city on its own would.

A useful nuance: if you cross the $100,000 threshold but only deliver into communities that do not levy a sales tax, you are not required to register until you actually make a sale into a taxing jurisdiction.4Alaska Remote Seller Sales Tax Commission. FAQs for Sellers Sellers below the threshold can also register and collect voluntarily if they want to.

Sales Through Marketplaces

If you sell through a platform like Amazon, Etsy, or eBay, the marketplace facilitator is generally the one responsible for collecting and remitting the tax. Under the Uniform Code, a marketplace facilitator is treated as the remote seller for each sale it facilitates and must collect, report, and remit to the commission.8Alaska Remote Seller Sales Tax Commission. The $100,000 threshold still matters for the individual third-party seller. Sales made through a registered marketplace facilitator that is already collecting the tax count toward your own statewide gross sales figure.8Alaska Remote Seller Sales Tax Commission. Alaska Remote Seller Sales Tax Code If every Alaska sale you make runs through a facilitator that is already handling tax, you may not need a separate registration. If you also sell directly through your own website, those direct sales require their own registration and filings.

Registering Once You Have Nexus

Remote sellers and marketplace facilitators that cross the economic nexus threshold register through the ARSSTC’s online portal.9Alaska Remote Seller Sales Tax Commission. Welcome to the Alaska Remote Sellers Sales Tax Commission Portal The form asks for your business’s legal name, Federal Employer Identification Number, entity type, primary tax contact, the nature of what you sell, and the date of your first sale into an Alaska jurisdiction. Pull that information together before starting.

ARSSTC registration only covers remote sales into member jurisdictions. If you also have physical presence in a specific municipality, that location needs a separate registration directly with the municipality for the sales originating there.6Alaska Remote Seller Sales Tax Commission. Business/Sellers And if you sell into a non-member taxing city, that is another direct registration.

Filing Deadlines

Returns go through the ARSSTC portal. The default schedule is monthly, with each return due by the last day of the month following the reporting period. January sales are due by the end of February. Sellers can apply for quarterly filing with commission approval, in which case the due dates are April 30, July 31, October 31, and January 31. If a due date falls on a weekend or federal or state holiday, the deadline moves to the next business day.10Alaska Municipal League. Uniform Alaska Remote Seller Sales Tax Code

What Non-Compliance Costs

The Uniform Code stacks several penalties on late filers and non-filers:8Alaska Remote Seller Sales Tax Commission. Alaska Remote Seller Sales Tax Code

  • A late filing fee of $25 per month or partial month, capped at $100. An incomplete return is treated as no return at all.
  • Interest on delinquent tax at 15% per year until paid in full.
  • A delinquent tax penalty of 5% per month or partial month, capped at 20% total. This penalty does not itself accrue interest.
  • An additional $50 per month if the commission has to estimate what you owe because you did not file, on top of the standard interest and penalty.

Payments are applied first to fees, penalties, and interest, then to the underlying tax. The commission can file a sales tax lien against your real and personal property and recover its audit and collection costs, including attorney’s fees, from sellers that fail to comply.8Alaska Remote Seller Sales Tax Commission. Exemptions and Records

The Uniform Code starts from the presumption that all sales and services by a business are taxable.8Alaska Remote Seller Sales Tax Commission. Alaska Remote Seller Sales Tax Code Exemptions exist, but they are defined by each member jurisdiction’s local code, not by the commission. An item exempt in one borough may be fully taxable in the city next door. The code requires that exemptions be read narrowly against the person claiming them, so if you are unsure, treat the sale as taxable.

You are responsible for documenting any valid exemption through certificates or other authorized means, and for keeping all records related to sales and exempted transactions for at least three years.6Alaska Remote Seller Sales Tax Commission. Business/Sellers If an audit comes and you cannot produce the documentation for a claimed exemption, you will owe the tax along with any applicable penalties and interest. Organize exemption certificates by jurisdiction and transaction date and the audit becomes a records request rather than a bill.
