Albany, NY Noise Ordinance: Prohibited Acts, Permits & Penalties

The Albany, NY noise ordinance, set out in Chapter 255 of the city code, bans “unreasonable, unnecessary or unusual noise” that would disturb a reasonable person, and it applies a tougher standard between 8:00 PM and 6:00 AM than during the day. There are no decibel limits written into the code. First-offense fines run up to $250, climb to $500 for a second conviction, and reach $1,000 for a third, with up to 15 days in jail possible at any step.

What Counts as a Noise Violation

Under § 255-24, it is illegal to make or allow any unreasonable, unnecessary, or unusual noise that annoys, disturbs, or endangers the comfort, health, or safety of a reasonable person with normal sensitivities.1City of Albany, NY. Albany Code 255 – Peace and Good Order – Section: 255-24 General Restrictions Whether a sound crosses the line depends on how loud it is relative to the surroundings, how long it goes on, and whether a typical neighbor would find it disruptive.

The code splits the day in two. From 6:00 AM to 8:00 PM, the sound has to be unreasonable, unnecessary, or unusual to count. From 8:00 PM to 6:00 AM, any noise that annoys or endangers a reasonable person’s comfort, health, or safety is enough, whether or not it would be considered unusual.1City of Albany, NY. It just has to bother someone reasonable next door.

Activities the Code Specifically Prohibits

Vehicle Horns, Sirens, and Gongs

A car, motorcycle, or bus horn may only be used as a reasonable danger warning. Honking to greet someone or vent frustration violates § 255-30. Section 255-27 separately bars anyone from mounting or using a siren or gong on a private vehicle; those are reserved for police, fire, and ambulance use.2City of Albany, NY. Barking Dogs

Section 255-28 holds dog owners responsible when their animal causes serious annoyance through frequent or habitual barking, howling, or yelping. The test is the same reasonable-person standard. One bark at a passing squirrel isn’t a violation. Hours of barking on a regular basis can be.3City of Albany, NY. Albany Code 255 – Peace and Good Order – Section: 255-28 Harboring of Dogs

Buffer Zones Around Schools, Hospitals, Courts, and Places of Worship

Section 255-26 bars deliberately making noise on public or private grounds on or next to a school, hospital, court, or place of worship if it disrupts the activities inside.4City of Albany, NY. Street and Public-Place Noise

Section 255-25 covers ringing bells, banging pans, blowing whistles, or hawking goods in ways that are distinctly and loudly audible on any street or public place.5City of Albany, NY. Albany Code 255 – Peace and Good Order – Section: 255-25 Public Places

Construction Hours

Running heavy equipment such as pile drivers, pneumatic hammers, derricks, or steam and electric hoists between 10:00 PM and 7:00 AM is illegal under § 255-32 unless the Commissioner of Buildings gives written permission, and only in an emergency. During the day, construction is still subject to the general reasonableness rule in § 255-24. Building inspectors and code enforcement inspectors can issue warnings and appearance tickets for construction noise, so enforcement does not rely on police alone.6City of Albany, NY. When You Need an Amplified Sound Permit

Section 255-29 requires a permit from the Chief of Police before you use any sound amplification device outside a building, through an open window or doorway, on a public street, or on a vehicle. That includes speakers at an outdoor event, a PA system at a street fair, or amplified music on a patio.7City of Albany, NY. Albany Code 255 – Peace and Good Order – Section: 255-29 Sound-Producing Devices

The Chief of Police can deny a permit if there is reasonable cause to believe it would lead to a noise violation. A permit also cannot issue for amplified sound within 250 feet of a school, hospital, court, or place of worship if it would disrupt the activities inside.7City of Albany, NY. What the Ordinance Does Not Cover

Two categories are exempt from § 255-24. Noise needed to protect or preserve life or property, like a car alarm during a break-in or someone shouting a warning. And noise tied to government functions or activities carried out for public health, safety, welfare, or convenience, which covers emergency sirens, snowplows, and city maintenance.1City of Albany, NY. Penalties

A noise offense under Chapter 255 is classified as a violation under New York law, one step below a misdemeanor. Penalties climb with repeat convictions:8City of Albany, NY. Albany Code 255 – Peace and Good Order – Section: 255-35 Penalties

  • First conviction: a fine of up to $250, up to 15 days in jail, or both.
  • Second conviction: a fine of up to $500, up to 15 days in jail, or both.
  • Third and subsequent convictions: a fine of up to $1,000 per conviction, up to 15 days in jail, or both.

How to Report a Noise Problem

For noise happening right now, call the Albany Police Department’s non-emergency dispatch at (518) 438-4000. Officers generally need to witness the disturbance to act, so calling while it is going on matters.9City of Albany, NY. Neighborhood and Community Services

For a dog that will not stop barking, the city directs residents to call police dispatch at (518) 434-4000 so officers can respond while the noise is happening. Do not file noise complaints through the city’s SeeClickFix app; the city specifies that loud noises or music audible beyond a property line should not be reported that way.9City of Albany, NY. Neighborhood and Community Services

Keep a written log with dates, times, and descriptions of each disturbance. That record helps if the matter reaches court or a formal code enforcement complaint. Audio or video recorded from your own property can also help, though it does not replace an officer witnessing the noise in person.

Tenant Options When the Noise Is Inside the Building

Renters in Albany have protections beyond the city ordinance. New York Real Property Law § 235-b creates an implied warranty of habitability in every residential lease, written or oral, and requires landlords to keep the premises fit to live in and free from conditions dangerous or detrimental to a tenant’s life, health, or safety.10New York State Senate. New York Real Property Law 235-B – Warranty of Habitability

Chronic noise that a landlord knows about and refuses to address, whether a neighbor playing music nightly, construction in the building at unreasonable hours, or failed sound insulation, can breach that warranty.10New York State Senate. New York Real Property Law 235-B – Warranty of Habitability Put every complaint to your landlord in writing, keep copies, and record the date and nature of each disturbance. Any lease clause that tries to waive these rights is void under New York law.
