Texas does not publish an amended petition form. To amend a petition in a Texas civil or family case, you draft a complete replacement of your original petition, file it with the clerk under Texas Rules of Civil Procedure 62 through 65, and give the other side notice in the manner the rules require. The new document must stand on its own: anything you leave out is dropped from the case.
Why There Is No Form
TexasLawHelp.org, the state’s main self-help legal site, says plainly that its family law forms are not built for amendments and that no template is provided.1TexasLawHelp. Amended Petitions in Family Law Cases The Texas State Law Library makes the broader point that Texas publishes very few official legal forms and that litigants frequently have to draft their own documents from templates or guides.2Texas State Law Library. Child Custody and Support – Legal Forms
Two practical paths are common. You can mark up a clean copy of the form you originally filed, so long as the final result reads as a single complete document. Or you can draft a new petition from scratch, using an annotated template such as those found in the Texas Family Law Practice Manual or O’Connor’s Texas Family Law Forms.
What the Document Must Say
Under Rule 62, an amendment adds to, withdraws from, or corrects a prior pleading. Under Rule 64, the amended pleading must be “complete in itself” and replaces the original entirely; once filed, the original drops out of the record except to establish the original filing date.3Texas Courts. Texas Rules of Civil Procedure
That rule is where self-represented litigants most often slip. If your original petition asked for property division, child support, and conservatorship, and your amended petition addresses only conservatorship, the other requests are no longer before the court. Restate every claim and allegation you still want decided.
Formatting conventions that courts expect:
- A descriptive title that identifies both the amendment and the case type, such as “Petitioner’s First Amended Original Petition for Divorce” or “Petitioner’s Amended Original Petition in Suit Affecting the Parent-Child Relationship.” Number the amendment (First, Second, Third) based on how many you have filed in the case.1TexasLawHelp. Amended Petitions in Family Law Cases4TexasLawHelp. Motions and Requests
- Reference to the pleading being amended, without incorporating it. The document itself must contain every allegation you want the court to hear.
- The same cause number, court, and parties as the original.
When You Can File
Rule 63 lets a party amend pleadings at any time, with one real cutoff: seven days before trial. More than seven days out, you can file freely without asking the judge. Inside the seven-day window, you need the court’s leave, which the judge must grant unless the opposing party shows the late amendment would cause surprise.3Texas Courts. Texas Rules of Civil Procedure To ask for leave, file a Motion to Amend Pleading alongside the proposed amended petition.4TexasLawHelp. Motions and Requests Courts tend to be lenient, but a last-minute filing that introduces a new cause of action or theory of damages is harder to get past the surprise objection.
During trial, Rule 66 lets the judge allow a pleading amendment on the spot when evidence is objected to as outside the pleadings. The rule directs the court to allow amendment “freely” when doing so serves the merits, unless the opposing party shows actual prejudice.3Texas Courts. Texas Rules of Civil Procedure
How To Serve the Amended Petition
How you deliver the amended petition depends on whether the other party has already appeared in the case. This step is where the biggest consequences hide.
Respondent Has Not Filed an Answer
If the opposing party has never responded, you must formally serve the amended petition the same way you served the original. Ask the clerk to reissue citation, attach the amended petition, and arrange delivery by a constable, sheriff, or private process server.1TexasLawHelp. Amended Petitions in Family Law Cases Skipping this will put any future default judgment at risk.
Respondent Has Already Answered
Once the opposing party has filed an answer or other responsive pleading, new citation is generally unnecessary. You still have to give notice by sending a copy via registered or certified mail, return receipt requested.1TexasLawHelp. Amended Petitions in Family Law Cases Rule 21a also permits personal delivery, commercial delivery service, fax, or email when directed by the court.3Texas Courts. Texas Rules of Civil Procedure Attach a certificate of service to the filed document.
Original Was Never Served
If you file the amended petition before the original is served on the respondent, both documents go out together with a single citation. No separate reissued citation is required for the amendment.5FindLaw. In the Interest of E.A. and D.A., Children
Deadlines That Reset, and One That Doesn’t
- Answer deadline. If the amended petition is served before the respondent’s deadline to answer the original, the respondent gets a fresh window: until 10:00 a.m. on the first Monday after 20 days from the date of service of the amended petition.1TexasLawHelp. Amended Petitions in Family Law Cases
- Return of service. Any reissued citation’s return must be on file for at least 10 days (not counting the day of filing or the day of hearing) before the case can be finalized.
- Divorce 60-day waiting period. Filing an amended petition does not restart the mandatory 60-day cooling-off period. That clock runs from the original filing date and keeps running.
Default Judgment Risk If Service Is Botched
The Texas Supreme Court addressed amended-petition service in In re E.A., 287 S.W.3d 1 (Tex. 2009). A father had filed an amended petition in a suit affecting the parent-child relationship seeking sole managing conservatorship and credit on child support arrearages, making the amended petition more onerous than the original. The Court held that new formal citation is not required for an amended petition, even one seeking a more onerous judgment, but the petitioner must still comply with Rule 21a by sending the document to the respondent’s last known address by certified or registered mail. The default judgment in that case was set aside because the amended petition lacked a certificate of service, the mailing was returned “unclaimed,” and there was no evidence the respondent had deliberately avoided delivery.5FindLaw. In the Interest of E.A. and D.A., Children Keep the green card, the certificate of service, and any returned envelope. An envelope marked “unclaimed” rebuts the presumption that the other side received the document.
E-Filing an Amended Petition
Most Texas courts require electronic filing. Submit through an Electronic Filing Service Provider via eFileTexas.gov. Do not select “new case.” Enter the existing cause number or search for your case and file into it.6Leon County. E-Filing Instructions
Pick the right filing code. Harris County uses “AP/” for an amended petition, “2AP/” for a second amended petition, and “3AP/” for a third, incrementing with each new amendment.7Harris County Clerk. Filing Codes Other counties use their own codes, so check with the local clerk if you are unsure. Put the full title of the document in the filing description. A document submitted before midnight on the filing date counts as timely.
Amended Petition or Supplemental Petition
These are not interchangeable. An amended petition under Rules 62–65 replaces your prior pleading. A supplemental petition under Rules 69, 78, and 80 adds material in response to something the other side has raised, such as a new defense, and leaves the earlier pleading in place alongside it.3Texas Courts. Texas Rules of Civil Procedure If you need to fix, change, or expand your own claims, file an amended petition. If you need to respond to something new in the other side’s pleading, file a supplemental petition.
Check the Local Rules
County-level rules and standing orders add requirements on top of the statewide rules. Harris County publishes separate local rules for its civil and family trial divisions.8Harris County District Courts. Local Rules Dallas County publishes local rules for both its civil and family courts.9Dallas County. Civil Guidelines Bexar County requires that certain standing orders be attached to all new petitions in divorce and parent-child relationship suits.10Bexar County. Where To Get Help
Because there is no form and the service rules carry real consequences, TexasLawHelp.org suggests limited scope representation: hiring an attorney to handle a specific task, such as drafting or reviewing the amended petition, while you manage the rest of the case yourself.11TexasLawHelp. Limited Scope Representation Attorneys who offer this arrangement can be located through the State Bar of Texas Lawyer Referral and Information Service, local bar referral programs, or FreeLegalAnswers.org, which lets qualifying users post questions and upload documents for free attorney review.12Texas State Law Library.
