Anaheim Municipal Code: Zoning, Nuisances, and Permits

The Anaheim Municipal Code is the city’s full set of local laws, organized into numbered titles and chapters that cover property maintenance, zoning, building standards, noise, short-term rentals, business licensing, and enforcement. Property Maintenance Rules That Get Residents Cited

Chapter 6.44 lists what the city treats as a public nuisance. The definitions are broader than most homeowners assume, and this is where routine code enforcement usually starts.

Fire hazards head the list: any dead shrub, dried palm frond, or combustible waste near a building or neighboring property qualifies. Refuse left on any property for more than three consecutive days is a nuisance, and “refuse” covers rubble, concrete, scrap metal, building materials, and plant trimmings.2American Legal Publishing. Even hanging laundry on a clothesline or fence in a front or side yard visible from the street is technically a violation.

Inoperable Vehicles

Keeping an inoperable, abandoned, wrecked, or dismantled vehicle, or vehicle parts, on any property for more than ten consecutive days is a nuisance under Section 6.44.010. The code also prohibits parking motor vehicles, trailers, campers, or boats in front yard areas outside of a driveway.2American Legal Publishing. The Parkway In Front of Your House

You, not the city, are responsible for landscaping the parkway strip between the sidewalk and the street next to your lot. Dead landscaping has to be replaced, and if the Planning and Public Works Director determines your parkway doesn’t meet the city’s ground cover standards, you can be required to replant it.3American Legal Publishing. What Happens If You Ignore a Nuisance Notice

The city doesn’t just keep mailing letters. The City Council has authority to abate the nuisance itself and bill you for the work. Those abatement costs can be recorded as a special assessment lien against the property, meaning the debt attaches to the land and stays there until paid.4City of Anaheim. That is how a maintenance violation becomes a title problem at resale.

Zoning and Setbacks

Title 18 divides Anaheim into single-family residential (RH and RS zones), multiple-family residential, commercial, industrial, mixed-use, and several overlay zones.5American Legal Publishing. Setbacks vary sharply. In the RS-1 zone, the front setback is 30 feet or 25% of lot depth, whichever is less; side setbacks are 10% of lot width, with a five-foot minimum and ten-foot maximum; and the rear setback is 25 feet or 25% of lot depth. In the more compact RS-3 zone, the front setback drops to an average of 15 feet and the rear to 15 feet.6American Legal Publishing. Accessory Dwelling Units

Anaheim allows ADUs under state law with local standards layered on top. A detached ADU on a single-family lot can be up to 1,200 square feet, with side and rear setbacks of just four feet. Maximum height is 18 feet plus two more feet for a pitched roof, or the height of the main house, whichever is greater.7American Legal Publishing. Converting a legal existing structure like a garage into an ADU is treated favorably. Conversions are exempt from lot coverage, setback, height, and building separation requirements. You can even demolish and rebuild a legally established accessory structure as an ADU without increasing setbacks, as long as the new structure keeps the same footprint and dimensions.7American Legal Publishing. Building Permits and Construction Standards

Title 15 governs construction. Anaheim adopts the statewide California Building Codes and adds local amendments. As of January 1, 2026, new project submittals must comply with the 2025 California Building Codes; projects submitted before that date follow the 2022 codes.8Anaheim, CA – Official Website. Working without a permit is one of the more expensive mistakes a homeowner can make. A stop-work order is the immediate risk, but the longer-term risk is resale: a buyer’s inspector or appraiser who spots unpermitted additions can derail the transaction, and unpermitted work can affect refinancing and insurance claims. Retroactively permitting the work, when the city allows it, usually costs more than doing it right the first time.

Noise Limits

Chapter 6.70 sets sound pressure level standards, and Chapter 6.73 specifically targets loud and unreasonable noise between 10:00 PM and 7:00 AM.9American Legal Publishing. Decibel thresholds vary by zone and time of day, and residential areas carry lower limits than commercial or industrial zones. Code enforcement officers can measure sound with calibrated meters. Running power tools or heavy equipment late at night in a residential neighborhood is a reliable way to draw both complaints and penalties.

Short-Term Rental Rules

Chapter 4.05 makes Anaheim’s short-term rental regime one of the strictest in Southern California. The city originally moved to phase out STRs in 2016 and later reversed course: existing permitted STRs can keep operating under tight regulations, but opening a new STR is not allowed.10Anaheim, CA – Official Website. How Permitted Rentals Have to Operate

Every rental has to be at least three consecutive nights. The owner or a designated local contact must be reachable by phone 24 hours a day, seven days a week, and must be able to arrive at the property within 45 minutes if contacted by police or code enforcement. Occupancy caps scale with bedroom count: 2 occupants for a studio, 4 for a one-bedroom, 7 for two bedrooms, 9 for three, 11 for four, and continued scaling up to a maximum of 19 occupants regardless of bedroom count. Guest vehicles have to park in the driveway or garage. Owners can buy one parking permit from the city that allows a single guest vehicle to park on a public street where parking is otherwise legal. Total vehicles at the property can’t exceed available off-street spaces, and there must be at least two. STR operators also have to collect and remit Anaheim’s transient occupancy tax at 15% of the rent charged for each stay.12American Legal Publishing. Anaheim Municipal Code 2.12.010 Transient Occupancy Tax Imposed Some platforms collect it automatically, but the legal obligation sits with the owner, and unpaid tax can trigger separate penalties under the city’s tax code.

Business Licensing

Anyone conducting business inside Anaheim’s city limits needs an Anaheim business license, even if the business itself is based somewhere else. That covers contractors working in the city, mobile vendors, and businesses with no local storefront that still serve Anaheim customers. Running a business from your home requires a business license with a home occupation designation. There’s no extra fee beyond the standard license cost, but the operational limits are real: only people who live in the home can work in the business, the business can’t generate a noticeable increase in traffic, and no exterior changes can alter the home’s residential appearance. Fines, Enforcement, and Appeals

When the city finds a violation, it typically issues a notice describing the problem and giving you a window to fix it. If you don’t, administrative fines follow. Fine amounts are set by City Council resolution rather than by the code itself, so they can change without a formal ordinance amendment. Fines can accrue daily for continuing violations, which is how a minor property maintenance issue turns into a bill in the thousands.

Parking citations use a three-level appeal process. The initial review must be requested within 21 calendar days of the citation date. If that review goes against you, you have another 21 calendar days to request an administrative hearing. A final civil appeal can be filed in court within 30 calendar days of the hearing decision.15Anaheim Police, CA. For the administrative hearing, you have to pay the full citation amount before the hearing; the payment is refunded if you win.

For non-parking violations like property maintenance and zoning infractions, the appeal runs through the city’s administrative hearing system. The consistent lesson from Anaheim’s enforcement structure is that ignoring notices makes everything worse: fines compound, abatement liens attach to the property, and the cost to resolve keeps climbing.
