Annulment Time Frame in Washington: Grounds, Filing, and Deadlines

The annulment time frame in Washington is not set by a calendar. State law gives no fixed number of days or years to file a petition for a declaration of invalidity. Instead, for most grounds the window stays open only until you voluntarily resume living with your spouse after you were free to walk away. Two grounds, bigamy and prohibited family relationships, have no such cutoff and can be raised at any point while both parties are alive.1Washington State Legislature. The Real Deadline Is Behavioral, Not a Date

RCW 26.09.040 does not say “file within 90 days” or “file within two years.” It asks a different question: once the disqualifying condition ended, did the couple voluntarily live together as spouses? If the answer is yes, the court treats the marriage as ratified and will not void it.1Washington State Legislature. RCW 26.09.040 Petition to Have Marriage or Domestic Partnership Declared Invalid

That is the deadline. Not a date on the calendar, but a line in your own conduct. The moment you knowingly keep sharing a home as a married couple after the problem is gone, the right to annul generally goes with it.

When the Clock Starts for Each Ground

The triggering event, the moment that opens the window and begins the ratification analysis, depends on why the marriage is invalid in the first place.

  • Fraud involving the essentials of marriage: The window opens when you discover the fraud. Continuing to live with your spouse after you learn the truth counts as ratification.
  • Force or duress: The window opens once the coercion stops. Voluntarily remaining in the home afterward ratifies the marriage.
  • Lack of capacity (mental incapacity, intoxication, or other incapacitating substances at the time of the ceremony): The window opens when the affected party regains the ability to consent. Voluntary cohabitation after that point ratifies.
  • Underage marriage: The window opens when the underage party turns 18. Voluntarily living together as a couple after that birthday ratifies the marriage. Separately, Washington law since 2024 makes every marriage void if either person was under 18 at the ceremony.2Washington State Legislature. Washington Code Chapter 26.04 – Marriage

In each of these, there is no running clock before the triggering event. If you were coerced into the marriage and have never been free of that coercion, the window has not even opened yet. What matters is what you do once it does.

Bigamy and Consanguinity Have No Cutoff

Two grounds sit outside the ratification framework. If one spouse was already legally married to someone else, or if the spouses are more closely related than second cousins, the ratification trigger has nothing to attach to.3Washington State Legislature. RCW 26.04.020 Prohibited Marriages A prior undissolved marriage either exists or it does not. A blood relationship does not change. These marriages cannot be ratified by cohabitation, and a petition can be brought at any point while both parties are living.1Washington State Legislature. RCW 26.09.040 Petition to Have Marriage or Domestic Partnership Declared Invalid

In bigamy cases, standing is also broader than for other grounds. Along with either spouse, the legal spouse from the prior marriage or a child of either party may file the petition.1Washington State Legislature. RCW 26.09.040 Petition to Have Marriage or Domestic Partnership Declared Invalid

Both Parties Must Be Alive

Washington does not allow a posthumous annulment. The “any time” rule for bigamy and consanguinity still requires that both spouses are living when the petition is filed.

Timing After You File

The front-end deadline is behavioral, but once a petition is on file, ordinary civil deadlines take over. The responding spouse has:

No 90-Day Waiting Period

Divorce cases in Washington require a 90-day cooling-off period after the petition is filed and the other party is served before a final decree can be entered.6Washington State Legislature. RCW 26.09.030 Petition for Dissolution of Marriage or Domestic Partnership Annulment cases carry no equivalent waiting period. If both sides agree the marriage is invalid and have worked out property and parenting issues, the court can finalize the matter as soon as the response deadline passes and a hearing is on the calendar.

Contested cases run longer. When the other spouse disputes the grounds, or the parties disagree about property division, support, or custody, the process can stretch to several months or more while the court holds hearings and reviews evidence.

Practical Takeaway on Timing

If you believe you have grounds to annul your Washington marriage, the question to ask is not “how many months do I have left?” It is “am I still living with my spouse as a couple after I learned about the fraud, escaped the coercion, regained capacity, or turned 18?” If the answer is yes, your window may already be closed. If the answer is no, and you want to keep the annulment option open, continuing to live together as spouses is the step most likely to close it. Bigamy and prohibited-relationship cases are the exceptions where delay does not forfeit the claim, but every other ground rewards acting before conduct does the deciding for you.
