AQMD Rule 1403: Asbestos Survey, Removal, and Penalties

South Coast Air Quality Management District Rule 1403 sets the mandatory steps for anyone demolishing or renovating a building in the district when asbestos-containing materials may be present. Before work starts, you need a certified asbestos survey, an online notification submitted at least 10 working days ahead with the correct fee, a qualified abatement contractor using one of five prescribed removal procedures, and leak-tight labeled disposal at an approved facility.1South Coast AQMD. Asbestos Demolition and Removal Because the EPA has delegated federal asbestos NESHAP enforcement to SCAQMD, Rule 1403 is the single framework that covers both federal and local compliance inside the district.

What Buildings and Projects Are Covered

The rule reaches any institutional, commercial, public, industrial, or residential structure in the district, regardless of age or current use. Apartment buildings, strip malls, warehouses, schools, and single-family homes all qualify. Two kinds of work trigger it: renovation, meaning altering or removing any building component, and demolition, meaning removing load-supporting structural members or intentionally burning a structure.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

Two narrow carve-outs exist. If you own and personally live in a single-family home, you can renovate it yourself without the full notification and training requirements. The exemption disappears the moment you hire a contractor, accept help from family or friends, use the home as a rental, or move from renovation into demolition.3South Coast AQMD. Owner Separately, renovations that disturb less than 100 square feet of ACM do not require notification, and planned programs of smaller jobs keep the exemption as long as the yearly total stays under that threshold. All demolitions require notification regardless of size.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

The Required Asbestos Survey

A Certified Asbestos Consultant licensed by Cal/OSHA must inspect the building and sample suspect materials before any work begins.1South Coast AQMD. Asbestos Demolition and Removal For demolitions and major renovations, the survey is fully intrusive: the consultant needs access to concealed areas behind walls, above ceilings, and under floors to find anything that could be disturbed.

Samples are analyzed by a lab accredited through the National Voluntary Laboratory Accreditation Program using SCAQMD Method 300-91 or the EPA’s polarized light microscopy method.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities The resulting report documents sampling locations, methods, lab results, and classification of each material as friable, Class I non-friable, or Class II non-friable. Classification drives which removal procedure applies, and getting it wrong can lead to a rejected notification or workers using controls that are not protective enough. Keep the report on site for the duration of the project; inspectors can request it on the spot.

Rule 1403 does not put an expiration date on surveys. An older report can still be valid if the building has not changed, but any damage, partial renovation, or alteration since the original inspection points toward a fresh survey of the affected areas.

Notification and Fees

You must submit the Notification of Demolition or Asbestos Removal form through the SCAQMD online portal at least 10 working days before work starts, which comes out to roughly 14 calendar days.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities The clock starts when the system timestamps your submission. Since November 2016, all notifications and payments go through the Rule 1403 Web Application, which accepts credit cards, debit cards, and electronic checks.4South Coast Air Quality Management District. Rule 1403 Notification Web Application

The form asks for the building’s address, square footage, floor count, age, and type; the Certified Asbestos Consultant who performed the survey; the abatement contractor’s name, license number, and contact information; and the quantity of ACM to be disturbed in linear or square feet, along with whether that material is friable or non-friable.5South Coast Air Quality Management District. Fees scale with building size for demolitions and with the amount of asbestos removed for renovations:6South Coast Air Quality Management District. Rule 1403 Asbestos Notification Fees

  • Up to 1,000 sq ft: $81.61
  • 1,001 to 5,000 sq ft: $249.59
  • 5,001 to 10,000 sq ft: $584.26
  • 10,001 to 50,000 sq ft: $916.15
  • 50,001 to 100,000 sq ft: $1,327.75
  • Over 100,000 sq ft: $2,212.92

Add-on charges apply for revising a submitted notification ($30.22), for a notification arriving less than 14 calendar days before the project start date ($81.61), and for a Procedure 4 or 5 plan evaluation ($916.15).6South Coast Air Quality Management District. Rule 1403 Asbestos Notification Fees Paying the special handling fee does not satisfy the 10-working-day advance requirement. A late notification can still bring enforcement.

Emergency Work

The 10-working-day window can be compressed in two situations. An emergency demolition is one a government agency orders to eliminate a safety peril from collapse, fire, crime, disease, or toxic contamination. An emergency renovation is unplanned work caused by a sudden, unexpected event that creates unsafe conditions, such as earthquake damage or a non-routine equipment failure. Economic pressure alone does not qualify.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

In either case, you still submit a notification as soon as possible but before any work begins, and you include the date and hour of the emergency along with a description of what happened. The survey and the proper removal procedures still apply. The emergency provision shortens the notice period and nothing else.

The Five Removal Procedures

Rule 1403 numbers five removal procedures, and the one that applies depends on the material, the site, and whether wetting the material is feasible. Your abatement contractor usually picks, but it helps to recognize what they are proposing.

  • Procedure 1 (HEPA Filtration): the work area is sealed with plastic sheeting, air handling is shut down, and negative air pressure is maintained through a HEPA filter while the material is kept wet. Standard approach for friable ACM in occupied buildings.
  • Procedure 2 (Glovebag): sealed-glove enclosure around the material, used for smaller contained jobs like pipe insulation.
  • Procedure 3 (Adequate Wetting): allowed only for non-friable materials, with wet cutting, drop cloths, and non-powered hand tools.
  • Procedure 4 (Dry Removal): reserved for situations where wetting would damage equipment or create a safety hazard. Requires written pre-approval from the SCAQMD Executive Officer’s designee.
  • Procedure 5 (Approved Alternative): a custom combination of techniques and controls, also requiring written pre-approval.

The baseline across every procedure is no visible emissions. If dust or particles can be seen leaving the work zone, the project is in violation. For demolitions specifically, all ACM over one percent asbestos must come out before any structural members come down.7South Coast AQMD. Rule 1403 Frequently Asked Questions This is where projects go sideways. A demolition crew starts before abatement is finished, non-friable material gets pulverized into friable dust, and a routine teardown turns into an enforcement case.

When Work Uncovers Asbestos the Survey Missed

If ACM is accidentally disturbed outside the containment or work area, all renovation and demolition activity has to stop. The owner or operator must secure and stabilize the affected areas, survey them, and submit a Procedure 5 plan to SCAQMD for approval before cleanup starts.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities Wetting the material down and continuing is not an option. The plan evaluation carries a $916.15 fee, and expedited review in under 14 calendar days adds another $458.06.6South Coast Air Quality Management District. Rule 1403 Asbestos Notification Fees

Waste Labeling, Storage, and Disposal

Asbestos-containing waste must go into transparent, leak-tight containers or wrapping while adequately wet. The rule does not set a minimum plastic thickness; the container has to be leak-tight so no fibers escape during storage or transport.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

Each container must carry a warning label reading either “CAUTION — Contains Asbestos Fibers — Avoid Opening or Breaking Container — Breathing Asbestos is Hazardous to Your Health” or the OSHA danger variant. Containers leaving the site must also display the generator’s name and the street address where the waste was produced.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

On-site storage is allowed only in leak-tight containers kept inside an enclosed, locked area that the public cannot reach. Disposal has to go to a facility that meets Rule 1403’s operational standards: a separate section for asbestos waste, at least six inches of non-asbestos cover at the end of each business day, and a minimum of 30 additional inches of compacted cover before final closure.2South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities The disposal site provides documentation confirming the waste reached its destination. Keep that paperwork. Project records and disposal manifests are subject to inspection.

Penalties

Common Rule 1403 violations include starting demolition before removing ACM, skipping notification, running dry removal without approval, producing visible emissions, and improper disposal. Because EPA delegated federal NESHAP enforcement to SCAQMD, one violation can draw penalties under both state and federal frameworks.1South Coast AQMD. Asbestos Demolition and Removal Fines run per day of violation and, for significant or willful noncompliance, climb into tens of thousands of dollars per day. SCAQMD can also issue stop-work orders, require corrective action at the violator’s expense, and refer cases for criminal prosecution.
