A federal 501(c)(3) determination does not, by itself, give your organization a 501(c)(3) sales tax exemption in New York. You have to apply separately to the New York Department of Taxation and Finance, and only after the state issues Form ST-119, the Exempt Organization Certificate, can your nonprofit stop paying sales tax on its purchases or stop collecting it on mission-related sales.1Department of Taxation and Finance. Which Nonprofits Qualify
New York Tax Law Section 1116(a)(4) sets the eligibility rules. The organization must be a corporation, association, trust, community chest, fund, foundation, or limited liability company, organized and operated exclusively for religious, charitable, scientific, public-safety testing, literary, or educational purposes, for fostering amateur sports competition, or for preventing cruelty to children or animals.2New York State Senate. Three restrictions sit alongside the purpose test and catch organizations more often than they should. No part of the net earnings can benefit any private individual or shareholder. Lobbying cannot be a substantial part of the organization’s activities. And the organization cannot intervene in any political campaign for or against a candidate for public office. New York reads the political activity ban the same way the IRS reads it.2New York State Senate. New York Tax Law 1116 – Exempt Organizations
The state looks at your founding documents, not just your actual conduct. If the articles of incorporation are drafted too broadly, or authorize non-exempt activities beyond an insubstantial level, the application can fail the organizational test even where day-to-day operations have been fully charitable.3New York Codes, Rules and Regulations. Using the Certificate at Purchase
The certificate itself is not what you hand to a vendor. For each tax-exempt purchase, give the seller a completed Form ST-119.1, the Exempt Organization Exempt Purchase Certificate. That form arrives in the mail with your ST-119 and is not available for download from the Tax Department’s website.5Department of Taxation and Finance. Sales Tax Exemption Documents
Two mechanics matter. First, the organization has to be the direct buyer and the direct payer. A board member who pays personally and seeks reimbursement cannot use the certificate at the register; payment must come from the organization’s own bank account or a credit card issued in its name. Second, the vendor needs the completed ST-119.1 in its possession within 90 days of the sale. Miss that window and both the vendor and the purchaser share the burden of proving the sale was exempt.6Boston University. The exemption runs in both directions. Section 1116 exempts “any sale or amusement charge by or to” a qualifying organization, so an approved nonprofit avoids sales tax on its own purchases and does not collect sales tax on items it sells in furtherance of its mission.2New York State Senate. What the Exemption Does Not Cover
Some purchases stay taxable even with an approved certificate. Motor fuel and diesel motor fuel are the main exclusion. Section 1115(j) keeps sales tax on gasoline and diesel for exempt organizations, and there is no workaround for road-use fuel.7New York State Senate. Hotel occupancy taxes also apply in many situations. Unless the stay is directly connected to the organization’s exempt activities and the organization pays for the room directly, expect those charges on the bill. The limits exist to keep individuals from using the certificate for personal benefit.
Keeping the Exemption
Misusing the certificate is one of the fastest ways to lose it. New York regulations let the Tax Department revoke the exemption for any misuse of the certificate, for misleading information in the original application, or for a change in the organization’s purposes or structure that the state was never told about.8New York Codes, Rules and Regulations. Revocation is not the only risk. Anyone who fails to pay sales tax because of an unauthorized use of an exemption certificate is personally liable for the unpaid tax, penalties, and interest. Willfully filing a false exemption certificate can bring criminal charges under Tax Law Section 1817 and the New York Penal Law.8New York Codes, Rules and Regulations. Sales and Use Tax Regulations – Exempt Organizations A board member or employee charging personal purchases to the organization’s certificate exposes both themselves and the organization to real financial and criminal liability.
The state exemption also rides on your federal status. Lose the 501(c)(3), and the New York certificate goes with it. The most common path to losing federal recognition is simple inaction: three consecutive years without filing an annual return triggers automatic revocation on the due date of the third missed return, with no warning letter and no hearing.9Internal Revenue Service.
