Annuities are protected from creditors in California, but only partially, and the strength of the shield depends on what kind of annuity you own. Payments from a matured annuity are exempt only to the extent a court finds them reasonably necessary to support you and your dependents. An unmatured annuity’s loan value is exempt up to $17,525 per person. Annuities held inside a qualified retirement plan get the strongest protection and are generally exempt without any need-based test. Certain debts override every one of these protections.
Matured Annuities and the Support Test
Once your annuity is paying out, California Code of Civil Procedure 704.100(c) protects those payments to the extent “reasonably necessary” for the support of you, your spouse, and your dependents.1California Legislative Information. California Code of Civil Procedure 704.100 A court decides where that line falls, and anything above it is reachable.
The judge looks at your full financial picture: income from all sources, reasonable monthly expenses, and other resources available to you and the people you support. If a $5,000 monthly annuity payment sits against a household the court finds needs $3,200 to live on, the extra $1,800 is exposed. There is no fixed dollar line; judges have wide discretion.
Unmatured Annuities and the $17,525 Cap
If your annuity hasn’t started paying yet, a different rule applies. The policy itself is exempt without any claim, but its loan value, meaning the cash surrender value you could borrow against, is only partially protected.1California Legislative Information. California Code of Civil Procedure 704.100 The current exemption is $17,525 per person.2Judicial Council of California. Current Dollar Amounts of Exemptions From Enforcement of Judgments Married spouses each get a separate $17,525, combinable up to $35,050 regardless of whose name is on the policies.
A single person with $50,000 of loan value in an unmatured annuity has $17,525 protected and $32,475 exposed. The figure adjusts every three years with the California CPI. The current amount took effect April 1, 2025 and runs through March 31, 2028.3California Legislative Information. California Code of Civil Procedure 703.150
Annuities Inside Retirement Plans
An annuity held inside a qualified retirement plan gets much stronger protection than a standalone commercial annuity. Under CCP 704.115, amounts held by a private retirement plan, IRA, 401(k), 403(b), or similar tax-advantaged account for payment as an annuity, pension, or retirement allowance are exempt from creditor claims.4California Legislative Information. California Code of Civil Procedure 704.115 No showing of need is required.
There is one caveat for self-employed retirement plans and IRAs: the exemption applies only up to the maximum amounts exempt from federal income taxation. If you’ve over-contributed to an IRA beyond legal limits, the excess isn’t protected.4California Legislative Information. California Code of Civil Procedure 704.115 Employer-sponsored plans with no contribution-cap issue are fully covered.
If you’re choosing between a standalone annuity and funding retirement through an IRA or employer plan, the retirement-plan route is the stronger shield in California.
Claiming the Exemption
Protection on paper does nothing unless you assert it on time. When a creditor levies, you file a claim of exemption with the levying officer within 15 days of personal service of the notice of levy, or 20 days if you were served by mail.5California Legislative Information. California Code of Civil Procedure 703.520 Miss the deadline and you can lose the exemption even for an annuity that fully qualifies.
Your claim must be sworn and must include:
- A description of the annuity, and for unmatured policy exemptions, disclosure of all other life insurance or annuity policies you or your spouse own and their values.
- The specific statute you rely on: CCP 704.100 for standalone annuities, CCP 704.115 for retirement-plan annuities.
- The facts that support the exemption, including a financial statement when the exemption depends on what’s reasonably necessary for support.
The creditor can oppose, and a hearing may follow. Late filings are technically possible on personal debts, but once the deadline passes the levying officer can release your funds to the creditor.5California Legislative Information. California Code of Civil Procedure 703.520 By the time a late claim is processed, the money may already be gone. Treat the deadline as firm.
What Changes in Bankruptcy
In bankruptcy you must pick one of two California exemption sets and cannot combine them.
System 1, under CCP 704, mirrors the rules above: matured annuity benefits exempt to the extent reasonably necessary for support, unmatured loan value exempt to $17,525 per person.1California Legislative Information. California Code of Civil Procedure 704.100
System 2, under CCP 703.140, protects payments from an annuity or similar plan triggered by illness, disability, death, age, or length of service, again to the extent reasonably necessary for support. There are exceptions for insider-established plans that don’t qualify under IRS rules for tax-exempt retirement accounts.6California Legislative Information. California Code of Civil Procedure 703.140
Annuities held inside ERISA-qualified retirement plans or tax-exempt retirement accounts get an additional federal shield. Under 11 U.S.C. § 522, retirement funds in accounts exempt from taxation under Internal Revenue Code sections 401, 403, 408, 408A, 414, 457, or 501(a) are exempt in bankruptcy regardless of which state system you choose.7Office of the Law Revision Counsel. 11 USC 522 – Exemptions This federal protection doesn’t depend on the support test, which makes it considerably stronger for annuities inside qualified plans.
Debts That Override the Protection
Some debts cut through California’s annuity exemptions entirely.
Child and Spousal Support
Family support obligations get priority treatment. Under CCP 703.070, a creditor holding a judgment for child, family, or spousal support can ask the court to apply otherwise exempt annuity payments to that judgment. The court weighs the support creditor’s needs against yours and those of anyone you must support. The same override reaches annuities inside retirement plans under CCP 704.115(c).4California Legislative Information. California Code of Civil Procedure 704.115
Federal Tax Liens
The IRS does not honor state exemptions. A federal tax lien attaches to all your property and rights to property, including assets that would be exempt from every other creditor.8Internal Revenue Service. Internal Revenue Manual 5.17.2 – Federal Tax Liens Your annuity is reachable, matured or not, regardless of whether the payments are necessary for your support. A federal tax lien also survives bankruptcy in many cases.9Internal Revenue Service. Understanding a Federal Tax Lien
Federal Criminal Restitution
Restitution under a federal criminal judgment carries the enforcement power of a federal tax lien under 18 U.S.C. § 3613, and the statute explicitly overrides other federal law, which leaves state exemptions well out of its way.10Office of the Law Revision Counsel. 18 USC 3613 – Civil Remedies for Satisfaction of an Unpaid Fine The only exempt property is the narrow list protected from IRS levy under Internal Revenue Code § 6334, which covers things like basic clothing and undelivered mail. Not annuities. A federal restitution lien runs 20 years.
Buying an Annuity to Dodge a Creditor
Converting cash into an annuity after a creditor appears on the horizon is one of the fastest ways to lose the protection the statute would otherwise give you. California’s Uniform Voidable Transactions Act lets creditors undo transfers made with intent to hinder, delay, or defraud them.11California Legislative Information. California Civil Code 3439.04 – Uniform Voidable Transactions Act If a court finds you bought an annuity mainly to shelter assets from known or anticipated creditors, the entire amount can be made available for collection.
Courts don’t need an admission. They look at “badges of fraud”:
- You bought the annuity after being sued or threatened with suit.
- The purchase used up most of your available assets.
- You were insolvent, or became insolvent shortly after.
- The timing lined up with incurring a large debt.
- You concealed the transfer or kept control over the funds.
No single factor decides it, but several together make a strong case.11California Legislative Information. California Civil Code 3439.04 – Uniform Voidable Transactions Act The classic pattern is converting a large cash account into an annuity right after a lawsuit lands. Courts see through it.
How Far Back a Court Can Reach
In bankruptcy, the trustee can unwind fraudulent transfers made within two years before filing under federal law.12Office of the Law Revision Counsel. 11 USC 548 – Fraudulent Transfers and Obligations Under Bankruptcy Code § 544(b), the trustee can also borrow California’s state law, and the UVTA reaches further. Outside bankruptcy, creditors can act under the UVTA’s own statute of limitations, which runs up to seven years in some cases under Civil Code § 3439.09. Buying an annuity years before a bankruptcy filing is no guarantee of safety if the circumstances point to fraud.
