Yes, BB guns are illegal in NYC. Under Section 10-131 of the New York City Administrative Code, it is a crime to possess, sell, or offer to sell any air-powered gun anywhere in the five boroughs, and the ban applies to adults and children alike with no permit option for individuals.1Justia. New York City Administrative Code 10-131 – Firearms
What Counts as a BB Gun Under the Ban
The city’s definition is broad. An “air pistol or air rifle” is any device where the propelling force is a spring or air.1Justia. New York City Administrative Code 10-131 – Firearms Caliber doesn’t matter. Appearance doesn’t matter. What the gun fires doesn’t matter.
That language sweeps in a lot of equipment people don’t think of as weapons. A classic Daisy BB gun qualifies. So does a pellet rifle, a spring-powered airsoft pistol, a CO2 handgun, a pre-charged pneumatic rifle, and a pump-action paintball marker. If the projectile leaves the barrel without gunpowder and a spring or air pushes it out, NYC treats the device as a prohibited weapon.
Federal law takes the opposite view. The ATF excludes BB and pellet guns from its definition of “firearms” because they lack an explosive charge.2ATF eRegulations. 27 CFR 447.11 – Meaning of Terms That classification carries no weight inside city limits. The local ordinance controls, and under the local ordinance, your backyard target gun is contraband.
What the Ban Actually Prohibits
Three activities are off limits: selling an air gun, offering one for sale, and simply possessing one.1Justia. New York City Administrative Code 10-131 – Firearms Possession alone is the offense. It doesn’t matter if the gun never leaves your apartment, sits unloaded in your closet, or is zipped inside a bag on the subway. There is no age exception, no self-defense exception, and no exception for keeping one at home for target practice.
There is also no license available to an individual resident. The only sales license on offer goes to dealers who ship to buyers outside the city, which does nothing for a New Yorker who wants to own one.
Penalties If You Get Caught
Possessing or selling an air gun in NYC is a misdemeanor. Conviction can bring up to three months in jail3New York State Senate. New York Penal Law 70.15 – Sentences of Imprisonment for Misdemeanors and Certain Other Offenses and a fine of up to $500.4New York State Senate. New York Penal Law 80.05 – Fines for Misdemeanors and Violations The gun itself is confiscated, and each item can be charged separately.
Firing an air gun in the city adds a second, heavier charge. Under New York Penal Law Section 265.35, discharging any air gun in a public place or where people could be endangered is a Class A misdemeanor punishable by up to a year in jail.5New York State Senate. New York Penal Law 265.35 – Prohibited Use of Weapons Someone shooting cans in a park faces both the possession charge and the discharge charge stacked on top of each other.
The record outlasts the sentence. A misdemeanor weapons conviction can surface on background checks for employment, professional licensing, and housing for years. It will not strip your right to own actual firearms under federal law unless the offense involves domestic violence, but the conviction itself creates problems most people don’t anticipate when they shrug off a BB gun as a toy.
The Shooting Range Exception
The only legal way to use an air gun in NYC is at a licensed shooting range. The exception covers use at the range. It does not let you keep the gun at home between visits or store it anywhere else in the city.
Transporting the gun to and from the range has its own rules. The device must be unloaded and carried in a locked, non-transparent case. Travel must be direct, with no detours. Stopping for groceries or dinner on the way home with an air gun in your trunk breaks the direct-travel requirement.
Buying One Outside the City Won’t Save You
New York State law restricts air gun possession only for people under 16.6New York State Senate. New York Penal Law 265.05 – Unlawful Possession of Weapons by Persons Under Sixteen Outside the five boroughs, an adult can walk into a sporting goods store, pay cash for a BB gun, and leave with it legally. The city’s ban is a separate local ordinance enacted under home rule authority.
That split is how most people get caught. You buy an air gun legally in Westchester or on Long Island, drive home, and become a criminal the moment you cross into Queens, the Bronx, Brooklyn, Staten Island, or Manhattan. The store has no obligation to warn you, and ignorance of the city ordinance is not a defense.
Federal protections don’t fill the gap either. The federal safe-passage law under 18 U.S.C. § 926A shields people transporting legal “firearms” through restrictive jurisdictions, but air guns aren’t firearms under federal law.7Office of the Law Revision Counsel. 18 U.S. Code 926A – Interstate Transportation of Firearms You cannot invoke it to drive a BB gun through NYC.
Air travel is the same trap. TSA permits BB guns and compressed air guns in checked baggage if they’re unloaded, packed in a locked hard-sided case, and declared at check-in.8Transportation Security Administration. What Can I Bring – Firearms Clearing TSA screening does not make the gun legal where you land. The moment you pick up that bag at JFK or LaGuardia, you’re in possession of a prohibited weapon under NYC law.
