Are CBD Drinks Legal in Texas? Age, THC Limits, and 2026 Changes

CBD drinks are legal in Texas as long as they contain no more than 0.3 percent delta-9 THC on a dry weight basis, and you are at least 21 years old to buy them. That threshold, set by House Bill 1325 in 2019, is the line between a legal hemp beverage and illegal marijuana under Texas law.1Texas Legislature Online. Texas House Bill 1325 – Enrolled Version Everything else about buying, drinking, and carrying these products flows from that single chemical limit.

What the 0.3 Percent Rule Actually Means

House Bill 1325 carved hemp out of the Texas Controlled Substances Act by defining it as Cannabis sativa L. and its derivatives, extracts, and cannabinoids, so long as delta-9 THC stays at or below 0.3 percent on a dry weight basis. Anything above that line is marijuana, and marijuana is still illegal in Texas.2Office of Court Administration. The distinction is purely chemical. A CBD sparkling water and an illegal cannabis drink can look identical. What separates them is lab-verified THC concentration, which an accredited laboratory must confirm before the product reaches a Texas shelf.1Texas Legislature Online. Some Legal CBD Drinks Will Get You High

This is the most misunderstood part of the Texas market. The 0.3 percent limit measures delta-9 THC by dry weight, and Texas currently has no per-serving milligram cap. Manufacturers dilute THC in a large volume of liquid, so a 12-ounce can may contain several milligrams of delta-9 THC and still test under the threshold because the water adds mass without adding THC. The drink is technically compliant and genuinely intoxicating.

The same loophole has let delta-8 THC beverages flourish, since the 0.3 percent limit targets delta-9 specifically. Delta-8 drinks remain legal to sell in Texas, though the state banned cannabinoid-containing vapes and e-cigarettes as of September 2025.3Texas State Law Library. Consumable Hemp Products If you are buying a hemp beverage expecting a mild, non-psychoactive drink, read the label closely. Some of these products are closer in effect to a cannabis edible than to a wellness tonic.

You Have to Be 21

Texas prohibits the sale of any consumable hemp product to anyone under 21. Governor Abbott’s Executive Order GA-56 directed state agencies to ban sales to minors and require government-issued ID verification at the point of sale.4Office of the Governor. How to Tell a Compliant Product From a Risky One

Every consumable hemp product sold in Texas must carry a printed URL on the label linking to a Certificate of Analysis, a third-party lab report showing the cannabinoid profile. A QR code is allowed but does not satisfy the URL requirement by itself.6Texas Department of State Health Services. Consumable Hemp Program – Labeling

The label also has to include:

  • Batch or lot number
  • Batch date
  • THC content statement confirming delta-9 falls within legal limits
  • Manufacturer name

If the drink you are considering has none of these, treat it as a warning. CBD products are not FDA-approved, mislabeling has been a persistent problem in the industry, and a product that tests above 0.3 percent delta-9 is legally marijuana regardless of what the can calls it. Products falsely claiming compliance can be treated as deceptive trade practices.1Texas Legislature Online. Do Not Drive After a THC Beverage

Texas DWI law applies to any substance that causes you to lose the normal use of your mental or physical faculties, not just alcohol.7State of Texas. Texas Penal Code 49.04 – Driving While Intoxicated If you drink a hemp beverage with enough THC to impair your driving, you can be charged with DWI even though the product was perfectly legal to buy.

Texas has no “per se” THC blood level comparable to the 0.08 BAC rule for alcohol. Officers build impairment cases through field sobriety tests and drug recognition evaluations, with a blood draw showing THC serving as supporting evidence. The legal question is whether you were impaired, not whether what you drank was legal. A first DWI offense is a Class B misdemeanor with a minimum of 72 hours in jail.7State of Texas. CBD Drinks and Workplace Drug Tests

A legal CBD beverage can still cost you your job. Standard workplace drug panels screen for THC metabolites, not CBD, and because hemp products can legally contain up to 0.3 percent THC, regular use can build up enough THC to trigger a positive result. THC is fat-soluble and accumulates in fat tissue rather than flushing out quickly.

Because CBD products are not FDA-approved, a positive test from legal CBD use cannot be overturned by a medical review officer the way a prescription medication can. There is no prescription to present as an explanation. Texas law offers no safety net: private employers have broad discretion to set and enforce drug testing policies, and no Texas statute protects employees who test positive for THC that came from legal hemp.8Texas Workforce Commission. Drug Testing in the Workplace Weigh that risk carefully if you are in transportation, construction, or any safety-sensitive role governed by federal testing rules.

Drinking a CBD Beverage in Public

Consuming a hemp-derived CBD drink in public is legal in Texas. These products are not alcoholic beverages, so the state’s open container laws do not apply.9State of Texas. Texas Penal Code 49.031 – Possession of Alcoholic Beverage in Motor Vehicle You can carry an open CBD sparkling water in a park, at an outdoor event, or down the sidewalk without breaking state law. Local governments can still restrict consumption in places like municipal buildings, and private property owners can prohibit any beverage they choose. Keeping the original packaging on hand makes it easy to show an officer the product is legal if the question comes up.

What Changes on November 12, 2026

Much of the current Texas hemp beverage market has an expiration date. A new federal law redefining hemp takes effect November 12, 2026, imposing stricter limits on total THC content. Consumable hemp products with intoxicating THC levels will no longer qualify as legal hemp under federal law after that date.3Texas State Law Library. Consumable Hemp Products Products Texas allows today could become federally illegal, and how Texas will reconcile its own rules with the new federal definition is not yet clear.

The FDA has separately maintained that selling food and beverages containing CBD is illegal under federal law and has issued warning letters to companies doing so.10U.S. Food and Drug Administration. FDA Regulation of Cannabis and Cannabis-Derived Products, Including Cannabidiol (CBD) Enforcement against consumers has been minimal. The practical risk of buying and drinking a lab-tested, properly labeled CBD beverage in Texas right now is low. The bigger question is what the shelves will look like after next November.
