Are CBD Gummies Legal in Hawaii? THC Limits, Labels, and Shipping

CBD gummies are legal in Hawaii, with tight limits. Under Hawaii Administrative Rules Chapter 11-37, a gummy may contain no more than one milligram of total THC per piece and no more than five milligrams of total THC per container, one gummy counts as one serving, and the buyer must be 21 or older.1Legal Information Institute. Hawaii Code R 11-37-5 – Edible Manufactured Hemp Products Those caps are stricter than what most national CBD brands put on their shelves, so the gummy you can order freely from a mainland site is often not a gummy you can legally buy in Honolulu.

The THC Limits That Actually Matter

Hawaii added gummies to its approved list of edible hemp products on December 6, 2024. The rule sets three hard numbers for gummies: one gummy equals one serving, each gummy caps at one milligram of total THC, and the whole container caps at five milligrams of total THC.1Legal Information Institute. Hawaii Code R 11-37-5 – Edible Manufactured Hemp Products

Compare that to what you’ll see online. A typical mainland CBD gummy might carry 25 to 50 milligrams of CBD and up to two milligrams of THC per piece. A ten-count bottle of those gummies would blow past Hawaii’s five-milligram container cap on the first piece. The product can be perfectly legal where it was made and still unlawful to sell here.

Hawaii also still bans adding cannabinoids to ordinary food. You cannot buy a CBD-infused cookie or chocolate bar unless the hemp ingredient has FDA GRAS recognition.2Legal Information Institute. Hawaii Code R 11-37-3 – Prohibitions Gummies are allowed because the rules classify them as an edible manufactured hemp product, not a food with hemp added. If you’re searching for a chewable CBD product, gummies are the category to look for.

Who Can Legally Buy

You have to be 21 or older. Retailers are required to check ID, and product labels must carry an age-restriction statement such as “Not for sale to persons under the age of 21.”3Hawaii Department of Health. That is stricter than many states, which set the hemp CBD purchase age at 18. If you’re visiting Hawaii and you’re 18, 19, or 20, you cannot buy hemp CBD gummies here, even if you can buy the same product at home.

What to Check on the Label

Reading the label is the fastest way to confirm a gummy is compliant before you pay for it. Hawaii requires every manufactured hemp product to display the product name and net weight, a full ingredient statement, a batch number, directions for use, a physician guidance statement, a “Keep out of the reach of children” warning, the age-restriction notice, and a QR code or website linking to lab results.4Hawaii State Department of Health. Edible products carry extra labeling. The label must list the number of servings per package, the serving size, and the per-serving content in milligrams for total THC, delta-9 THC, delta-8 THC, THCA, and CBD. It must also carry an FDA-style disclaimer that the product is not intended to diagnose, treat, cure, or prevent disease, plus any major food allergen disclosures.4Hawaii State Department of Health. The QR code is the one piece of the label most worth your attention. It should link to a Certificate of Analysis showing the actual THC content and testing for heavy metals, pesticides, and residual solvents. Three quick checks: per-gummy total THC at or under one milligram, container total at or under five milligrams, and a working link to lab results. A gummy missing the QR code is a red flag.

Buying Online and Shipping to Hawaii

You can have hemp CBD gummies mailed to a Hawaii address. USPS allows domestic shipment of hemp and hemp-based products as long as the THC concentration stays at or under 0.3 percent and the mailer complies with all applicable federal, state, and local laws; mailers must keep compliance records, including lab results and licenses, for at least two years.5United States Postal Service. USPS Publication 52 – Section 453.37 Hemp-based Products International shipments of hemp products through USPS are prohibited.

The practical problem is a product legal to sell on the mainland may fail Hawaii’s rules. A three-milligram-per-gummy product sold freely in many states violates Hawaii’s one-milligram-per-serving cap. Before you order, line the product’s per-serving and per-container THC numbers up against Hawaii’s limits.

Starting in January 2026, any business selling or distributing manufactured hemp products in Hawaii, including online sellers shipping into the state from elsewhere, must hold a Certificate of Registration from the Office of Medical Cannabis Control and Regulation.6Hawaii State Department of Health. Manufactured Hemp Product Retailer and Distributor Registry Notification If an online retailer shipping to Hawaii cannot show that registration, they are not operating in compliance with state law. The same registration applies to the brick-and-mortar store down the street, so asking a retailer about it is a fair question.

Where State and Federal Law Don’t Line Up

Hawaii allows up to five milligrams of total THC per gummy container. Federal law, as of 2026, excludes from the “hemp” definition any final hemp-derived cannabinoid product containing more than 0.4 milligrams combined total of THC and THC-like cannabinoids per container.7Office of the Law Revision Counsel. 7 USC 1639o – Definitions A gummy container built to Hawaii’s five-milligram limit sits well above the federal cap and technically falls outside the federal hemp definition. Federal enforcement priorities around this gap are still developing, but the mismatch is real and worth knowing.

Federal law also excludes products containing synthetically manufactured cannabinoids or cannabinoids that cannot be naturally produced by the cannabis plant, regardless of THC concentration.7Office of the Law Revision Counsel. 7 USC 1639o – Definitions Delta-8 THC made by chemical conversion from CBD is not federally legal hemp.

Drug Testing

Legal CBD gummies can still cost you a job. Standard workplace urine tests screen for THC metabolites and cannot tell the difference between THC from a Hawaii-compliant gummy and THC from marijuana. Full-spectrum products contain trace THC by design and carry the highest risk; CBD isolate products carry the lowest, but no hemp product guarantees a clean result.

Detection depends on how often you use the product, your metabolism and body composition, and the type of test. Hawaii law does not require employers to accommodate hemp-derived CBD use, and “it’s legal hemp” is not a defense most employers accept. If your workplace tests, factor that in before you buy.

Buying With Confidence

The compliance signals stack up quickly once you know what to look for: a retailer that can point to its Hawaii Certificate of Registration, a gummy label showing one milligram or less of total THC per piece and five milligrams or less per container, the full set of required warnings, and a QR code that actually loads a Certificate of Analysis. A product that clears those checks is a product you can buy and use within Hawaii law.
