Delta-8 gummies are legal in Alabama if you are at least 21 and buy them in person from a retailer licensed by the Alabama Alcoholic Beverage Control Board. House Bill 445, which took effect in stages through 2025 and 2026, sets the rules on potency, labeling, and where sales can happen.1LegiScan. AL HB445 2025 Regular Session A federal provision scheduled to take effect in November 2026 could end the Delta-8 market nationwide, so the current legal status has a visible expiration date.
Where You Can Buy Them
Only ABC Board-licensed brick-and-mortar retailers can legally sell Delta-8 gummies in Alabama. The license categories are food stores, pharmacies, and specialty retailers.2Alabama ABC Board. Consumable Hemp Products
Online ordering, delivery, drive-through sales, vending machines, self-service displays, and direct shipment of consumable hemp products into or within Alabama are all prohibited. If you have been buying Delta-8 gummies from an out-of-state website and having them shipped to Alabama, that is no longer legal. A first violation of the shipping ban is a Class A misdemeanor, and a second or subsequent violation is a Class C felony.3Alabama Legislature. HB445 Enrolled – Section 28-12-60
You Must Be 21
As of January 1, 2026, no one under 21 can buy any consumable hemp product in Alabama, Delta-8 gummies included. Retailers are required to verify your age at the point of sale.4Alabama Legislature. HB445 Enrolled – Section 28-12-48 Bring ID.
What a Legal Gummy Looks Like
HB 445 caps how much THC a gummy can contain. The limit is 10 milligrams of total THC per serving, each serving must be individually wrapped, and a single carton cannot exceed 40 milligrams of total THC.5Alabama Legislature. HB445 Enrolled – Section 28-12-23 Anything advertised with higher per-serving or per-container amounts is not a legal Alabama product.
Before you buy, check the label. Alabama requires every package to include a scannable barcode or QR code linked to a certificate of analysis from an independent lab, a full ingredient list, manufacture and expiration dates, a batch number, total THC per container, serving size, and THC per serving. Five specific warnings must also appear on the label: keep away from children; consumption may cause you to fail a drug test due to THC; not safe or intended for anyone under 21; not safe for pregnant or breastfeeding individuals; and may impair your ability to drive or operate machinery. Packaging must be child-resistant and the product must remain in the original sealed container as packaged by the producer.6Alabama Legislature. HB445 Enrolled – Sections 28-12-24 and 28-12-25
Scan the QR code before you consume anything. If a product has no scannable code, or the lab results are missing or incomplete, pick a different brand. The FDA has flagged that most commercial Delta-8 is made by chemically converting CBD, and that some manufacturers use potentially unsafe household chemicals and leave harmful by-products in finished products.7U.S. Food and Drug Administration. 5 Things to Know about Delta-8 Tetrahydrocannabinol The lab report is your check on what you are actually putting in your body.
One format boundary worth knowing: smokable hemp products are entirely banned in Alabama, including hemp cigarettes, cigars, joints, buds, flowers, leaves, and ground flower.8Alabama Legislature. HB445 Enrolled – Section 28-12-2 Gummies, tinctures, beverages, and topicals remain legal.
Expect a 10% Tax at Checkout
Alabama applies a 10% excise tax to the retail sales price of all consumable hemp products, on top of any other taxes.9Alabama Legislature. HB445 Enrolled – Section 28-12-5 The number on the shelf is not what you will pay at the register.
Delta-8 and Your Job
The drug test warning on every Alabama label is not a formality. Standard workplace drug tests screen for THC metabolites and cannot distinguish Delta-8 from Delta-9. A positive result looks the same regardless of source.
Alabama is an at-will employment state with no legal protections for workers who use hemp-derived THC products. Your employer can test for THC, can fire you for a positive result, and has no obligation to accommodate your Delta-8 use even though the product is legal to purchase. Alabama also has no medical marijuana employment protections. If you are subject to drug testing at work, treat Delta-8 gummies the way you would treat any THC product.
Traveling With Delta-8 Gummies
Federal law prohibits states from blocking the interstate transportation of lawfully produced hemp.10eCFR. 7 CFR 990.63 – Interstate Transportation of Hemp In practice, state laws differ. Some states ban Delta-8 outright, and carrying Alabama-legal gummies into one of those states could lead to criminal charges. Check the laws of any state you plan to enter before you pack.
For air travel, TSA screens for security threats rather than drugs and does not search for cannabis products. If an officer finds what appears to be an illegal substance, the matter is referred to local law enforcement.11Transportation Security Administration. Medical Marijuana Hemp products at or below 0.3% Delta-9 THC are federally legal to fly with, but what happens after you land depends on the arrival state.
The Federal Ban Scheduled for November 2026
In November 2025, Congress passed a continuing resolution (H.R. 5371) that redefined hemp-derived cannabinoid products. Section 781 bans any finished hemp product containing cannabinoids synthesized or manufactured outside the plant, and any product with more than 0.4 milligrams of combined total THC per container.12Congress.gov. H.R.5371 – 119th Congress Text Nearly all commercial Delta-8 is produced by chemically converting CBD rather than extracted from the plant, so the provision reaches the Delta-8 market directly. The ban is scheduled to take effect in November 2026.
Bipartisan lawmakers have pushed to repeal or delay implementation, but as of early 2026 those efforts have not succeeded, and the 2026 Farm Bill markup excluded intoxicating hemp regulation. If the federal ban takes effect as scheduled, Delta-8 gummies could become illegal nationwide regardless of what Alabama law allows. For now, buying them in Alabama is legal when you follow the rules above; the window on that may close before the end of 2026.
