Most groceries in Florida are not taxed. The state’s 6% sales tax does not apply to food products sold for home consumption, so a normal cart of meat, produce, dairy, bread, and pantry staples rings up tax-free. The exceptions are specific: candy, soft drinks, single-serve ice cream, pet food, dietary supplements, and anything the store has prepared for immediate eating all carry sales tax, plus any local county surtax on top.
What Counts as Tax-Free Groceries
Florida law exempts food products for human consumption when they are sold in unprepared form at grocery stores, convenience stores, and supermarkets.1Florida Legislature. Florida Statutes 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions The exemption covers the categories most people associate with a grocery run:
- Meat, poultry, fish, and seafood, whether fresh, frozen, or canned
- Fruits and vegetables in any form: fresh, frozen, canned, or dried
- Dairy products including milk, cheese, butter, eggs, and yogurt
- Bread, flour, baking mixes, and breakfast cereal
- 100% fruit or vegetable juice
- Coffee and tea in dry or ground form (liquid tea is taxable)2Florida Dept. of Revenue. Nontaxable Medical Items and General Grocery List

- Condiments, spices, sugar, honey, and syrup3Legal Information Institute. Florida Admin Code Ann R 12A-1.011 – Sales of Food Products for Human Consumption
- Frozen dinners sold in sealed packaging for home preparation
- Plain bottled water
The common thread is that the store has not prepared the food for you. Once an item is cooked, assembled, or heated for immediate eating, it moves into the taxable column.
Grocery Items That Are Taxed
Several products sold alongside exempt staples are specifically excluded from the food exemption and carry the full 6% rate plus any local surtax.
Candy, Gum, and Confections
Chocolate bars, candy, and chewing gum are taxable. Florida treats confections as a separate category from food staples, so the grocery exemption does not reach them no matter where you buy them.3Legal Information Institute. Florida Admin Code Ann R 12A-1.011 – Sales of Food Products for Human Consumption
Soda and Juice Drinks Under 100% Juice
Sodas, flavored sparkling water, and other carbonated drinks are taxed. Fruit juice is exempt only when it is 100% natural juice; any blend containing less than that is taxable.1Florida Legislature. Florida Statutes 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions
Single-Serve Ice Cream and Novelties
Ice cream, frozen yogurt, and similar treats sold in cones, small cups, pints, popsicles, or frozen fruit bars are taxable. The statute names these single-serve and novelty formats as excluded from the food exemption.1Florida Legislature. Florida Statutes 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions Larger containers such as half-gallons or gallons are not on the taxable list and generally remain exempt.
Pet Food
Pet food and treats are taxed because the food exemption applies only to products for human consumption. The lone exception is a therapeutic veterinary diet formulated for a diagnosed animal health condition and sold only through a licensed veterinarian.4Florida Dept. of Revenue. Technical Assistance Advisement 17A-014
Vitamins and Dietary Supplements
Vitamins, minerals, herbal extracts, and protein powders are taxable. Florida does not classify dietary supplements as food, so the grocery exemption does not reach them even when you buy them at a supermarket. A health product escapes tax only if it is labeled as a drug or medicine and carries a National Drug Code.3Legal Information Institute. Florida Admin Code Ann R 12A-1.011 – Sales of Food Products for Human Consumption
Prepared and Hot Deli Foods
Food that a store heats, cooks, or assembles for immediate consumption is taxable, even when the raw ingredients would be exempt on their own.3Legal Information Institute. Florida Admin Code Ann R 12A-1.011 – Sales of Food Products for Human Consumption Common examples:
- Rotisserie chicken, steamed seafood, and hot soup from the deli counter
- Sandwiches and wraps made at the deli
- Pre-made salads sold with dressing or utensils
- Ready-to-eat meals packaged for carryout
- Bakery items sold hot where there is no seating
The line runs through who did the preparation. A frozen entrée you take home and heat yourself stays exempt. The same frozen entrée heated for you on the store’s premises becomes taxable.3Legal Information Institute. Florida Admin Code Ann R 12A-1.011 – Sales of Food Products for Human Consumption
Paying with SNAP Benefits
If you pay with SNAP benefits through an EBT card, no sales tax is charged on the SNAP-eligible items in your order. This comes from federal law that bars any participating state from taxing SNAP purchases.5eCFR. 7 CFR 272.1 – General Terms and Conditions The protection covers items that would otherwise be taxable when bought with cash, as long as they qualify as SNAP-eligible food.
When you split a purchase between SNAP and cash, the SNAP portion is tax-free and the cash portion is taxed under the normal rules. Candy or soda paid for in cash is still taxed on the cash amount.5eCFR. 7 CFR 272.1 – General Terms and Conditions
How Coupons Change the Taxable Amount
Coupons only matter on items that are already taxable, since there is nothing to reduce on an exempt grocery. On a taxable item, the type of coupon decides whether you save on tax too.
- A store coupon reduces the sales price, so tax is calculated on what you actually pay.
- A manufacturer coupon does not reduce the taxable amount. The manufacturer reimburses the store, and tax is still charged on the full retail price.6Legal Information Institute. Florida Admin Code Ann R 12A-1.018 – Trade and Cash Discounts, Coupons, and Rebates
Delivery Fees on Online Grocery Orders
When groceries are delivered, the tax status of the delivery charge depends on how it is billed and whether you had a choice. If the fee is listed separately on your receipt and you could have avoided it by picking up the order yourself, it is not taxable.7Legal Information Institute. Florida Admin Code Ann R 12A-1.045 – Transportation Charges If the fee is bundled into the item price, or the seller requires delivery with no pickup option, it is taxable.
Charges you pay directly to a third-party delivery service you hired yourself are not subject to Florida sales tax.7Legal Information Institute. Florida Admin Code Ann R 12A-1.045 – Transportation Charges These rules apply only to the delivery fee; the groceries themselves are still taxed or exempt based on what they are.
Local County Surtax on Top of the 6%
The 6% state rate is the floor. Most counties add a discretionary sales surtax that applies to the same taxable transactions.8Florida Dept. of Revenue. Florida Sales and Use Tax County surtax rates range from 0% to 2%, so the total tax on a taxable grocery item can land anywhere from 6% to 8% depending on the county.9Florida Dept. of Revenue. Discretionary Sales Surtax Rate Table The surtax only touches items that are already subject to state sales tax. Exempt groceries stay fully tax-free no matter where in Florida you shop.
