Are RPGs Legal in Texas? Tax Stamps, Permits, Penalties

Rocket-propelled grenade launchers are legal to own in Texas, but only if you clear a stack of federal requirements first and keep the registration current. Both the launcher and every live round qualify as a “destructive device” under the National Firearms Act, each requires its own ATF registration and $200 tax stamp, and you need a separate federal explosives permit to receive the rounds themselves. Texas prohibits explosive weapons under Penal Code Section 46.05, but carves out an exception for items properly registered with the ATF.1State of Texas. Texas Penal Code 46.05 – Prohibited Weapons Miss any piece and you face felony exposure under both federal and state law.

Why an RPG Counts as a Destructive Device

The National Firearms Act sweeps RPGs in through two separate doors. The launcher has a bore well over one-half inch and is capable of firing a projectile by explosive or propellant action, which puts it inside the destructive device definition on its own. Each explosive round then qualifies independently as either a rocket with more than four ounces of propellant or a missile with more than a quarter ounce of explosive charge.2Office of the Law Revision Counsel. 26 USC 5845 – Definitions

The statute also covers any combination of parts designed or intended for converting a device into a destructive device, so unassembled components are not a workaround.2Office of the Law Revision Counsel. 26 USC 5845 – Definitions The exclusions in the statute (signaling and safety devices, surplus ordnance sold under specific Army provisions, antiques, sporting-use rifles) do not realistically reach a functional RPG system.

What Legal Ownership Requires

Acquiring a destructive device starts with ATF Form 4, the Application for Tax Paid Transfer and Registration of a Firearm. The form is filed in duplicate, the $200 transfer tax goes with it, and the transfer cannot happen until the ATF approves both the transfer and the registration.3Bureau of Alcohol, Tobacco, Firearms and Explosives. Chapter 9 – Transfers of NFA Firearms4Office of the Law Revision Counsel. 26 USC 5812 – Transfers Taking possession before the stamp comes back is itself an unregistered-possession offense.

Individual applicants also have to submit:

The ATF will deny the application if the transfer or possession would put the recipient in violation of any federal, state, or local law.3Bureau of Alcohol, Tobacco, Firearms and Explosives. Chapter 9 – Transfers of NFA Firearms

Every Explosive Round Carries Its Own Tax Stamp

This is where the math turns ugly. Because each explosive rocket or warhead independently qualifies as a destructive device, each round needs its own registration and its own $200 tax stamp on top of the stamp for the launcher.2Office of the Law Revision Counsel. 26 USC 5845 – Definitions6Office of the Law Revision Counsel. 26 USC 5811 – Transfer Tax Ten live rounds means $2,000 in tax stamps for the ammunition alone, plus the stamp for the tube, plus whatever the items cost on the extremely limited legal market.

Inert training rounds and non-explosive practice projectiles do not automatically trigger the same classification, since the statutory thresholds hinge on propellant and explosive weight. Once a round crosses four ounces of propellant or a quarter ounce of explosive charge, though, it is a destructive device and must be individually registered before you receive it.2Office of the Law Revision Counsel. 26 USC 5845 – Definitions

The Separate Federal Explosives Permit

NFA registration is only half the federal picture. Federal explosives law, which operates independently of the NFA, requires anyone who receives explosive materials to first hold a federal explosives license or permit. Distributing explosive materials to someone without one is itself a crime.7GovInfo. Federal Explosives Law and Regulations

Which permit you need depends on how and where you acquire the material. Someone acquiring explosives inside their home state on six or fewer occasions a year needs a limited permit. More frequent acquisitions, interstate transport, or purchases from out-of-state sellers call for a user permit. A full license is for people in the business of importing, manufacturing, or dealing in explosive materials.8eCFR. 27 CFR 555.41 – General Skipping this step after completing the NFA process is still an independent federal violation.

Where Texas Law Fits In

Texas Penal Code Section 46.05 makes it an offense to possess, manufacture, transport, repair, or sell an explosive weapon. The state defines an “explosive weapon” to include any explosive or incendiary bomb, grenade, rocket, or mine designed to inflict serious bodily injury, death, or substantial property damage, along with any device designed to deliver or shoot one. An RPG and its rounds fall squarely inside that language.1State of Texas. Texas Penal Code 46.05 – Prohibited Weapons

The exception is the whole reason legal ownership is possible in Texas at all: the statute does not apply to explosive weapons registered in the National Firearms Registration and Transfer Record maintained by the ATF, or to items classified as a curio or relic by the U.S. Department of Justice.1State of Texas. Texas Penal Code 46.05 – Prohibited Weapons If the registration lapses or never existed, state felony charges stack on top of the federal problem.

Penalties for Getting It Wrong

Federal

Possessing an unregistered destructive device violates 26 U.S.C. § 5861, which makes it unlawful to receive or possess any NFA firearm not registered to the possessor in the National Firearms Registration and Transfer Record.9Office of the Law Revision Counsel. 26 USC 5861 – Prohibited Acts A conviction carries up to 10 years in federal prison, a fine of up to $10,000, or both.10Office of the Law Revision Counsel. 26 USC 5871 – Penalties Each unregistered round is a separate count. A launcher and three unregistered rounds equals four violations, each at the full statutory range.

Texas

Violating Section 46.05 is a third-degree felony. The sentencing range is 2 to 10 years in the Texas Department of Criminal Justice, with a possible fine of up to $10,000.11State of Texas. Texas Penal Code 12.34 – Third Degree Felony Punishment Because Texas and the federal government are separate sovereigns, state and federal charges can both go forward from the same facts, and a missing explosives permit adds another federal layer.

Storage Rules That Make Home Possession Impractical

Clearing registration still leaves you with federal storage law. Explosive materials must be kept in locked magazines built to construction standards that depend on the type and class of explosive. High explosives require a Type 1 (permanent) or Type 2 (portable) magazine; a Type 3 magazine only allows temporary daytime storage, with materials moved back to an approved magazine before the end of the day.12Bureau of Alcohol, Tobacco, Firearms and Explosives. Explosives Storage Requirements

On top of that, the ATF sets minimum distances between explosive storage and inhabited buildings, public highways, and passenger railways. For up to 1,000 pounds of low explosives, the minimum setback is 75 feet from the nearest inhabited building or public road, and the required distance grows with quantity.13Bureau of Alcohol, Tobacco, Firearms and Explosives. Table of Distances Even a handful of warheads needs a compliant magazine set an appropriate distance from any residence or roadway. For a typical suburban lot, that is effectively impossible.

Inert and Deactivated Launchers

The picture changes for inert or deactivated launchers, the type sold at military surplus shops or online as display pieces. A tube permanently modified so it cannot fire any projectile does not meet the destructive device definition, which requires a weapon that “will, or may be readily converted to, expel a projectile by the action of an explosive or other propellant.”2Office of the Law Revision Counsel. 26 USC 5845 – Definitions The ATF has issued classification letters confirming that specific inert launcher kits are not destructive devices.

The line is thinner than it looks. Installing a subcaliber firing device inside a deactivated tube can push the combination back into NFA territory, either as a short-barreled rifle or as a destructive device, depending on the configuration. Owning the inert tube is generally fine. Modifying it to fire anything, even small-caliber training rounds, is where trouble starts. If you buy a surplus launcher, confirm it comes with an ATF classification letter and leave it alone.
