In Massachusetts, services are generally not taxable. The state’s 6.25% sales tax applies to retail sales of tangible personal property and to a short list of specifically enumerated services; everything else sits outside the tax base unless a statute pulls it in.1Massachusetts Department of Revenue. Sales and Use Tax The complication is that many service transactions involve handing something physical to the customer, or involve software, and in those cases the taxability depends on what the deal really is and how the invoice is written.
The Default Rule
Chapter 64H of the General Laws imposes the 6.25% excise on retail sales of tangible personal property and on specifically enumerated services performed in the Commonwealth.2General Court of Massachusetts. Massachusetts General Laws Part I, Title IX, Chapter 64H, Section 2 If no physical property moves to the customer and the service isn’t on the enumerated list, the transaction is presumed non-taxable. Legal advice, accounting, medical consultations, haircuts, personal training, and management consulting all fall on the exempt side.1Massachusetts Department of Revenue. Sales and Use Tax
The Department of Revenue’s “Service Enterprises” regulation at 830 CMR 64H.1.1 sets out the two-part test. A service transaction escapes the tax when the real object of the deal is the service itself and either no tangible personal property changes hands or any property transferred is an inconsequential element of the deal. “Inconsequential” generally means the property is worth less than 10% of the total charge, which the DOR treats as a guideline rather than a hard cutoff.3Massachusetts Department of Revenue. 830 CMR 64H.1.1: Service Enterprises
Services That Are Taxable
A handful of service categories are taxed the same way as physical goods.
Telecommunications
Telecommunications services are taxable. The tax covers transmission of messages or information by electronic means, including local and long-distance calls and mobile service. The definition excludes cable television and internet access.4Massachusetts Department of Revenue. 830 CMR 64H.1.6: Telecommunications Services A monthly phone bill is taxable; a broadband subscription is not.
Gas, Electricity, and Steam
Sales of gas, electricity, and steam are taxable at 6.25%.1Massachusetts Department of Revenue. Sales and Use Tax Massachusetts treats these utility transmissions as sales of tangible personal property.
Meals and Prepared Food
Restaurant meals and other prepared food sold by vendors carry the 6.25% state tax. Many cities and towns have adopted a local-option meals excise of 0.75%, bringing the effective rate to 7% in those municipalities.5Massachusetts Department of Revenue. Sales Tax on Meals Restaurants, caterers, and food trucks collect this regardless of the service component of the operation.
When a Service Transfers Physical Goods
This is where most businesses get tripped up. If your service hands the customer something physical, the tax treatment depends on how central the goods are and how the invoice is written.
The 10% Guideline
Under the Service Enterprises regulation, if the property transferred is worth less than 10% of the total charge and you do not separately state its price on the bill, the whole transaction is treated as a non-taxable service. You, the provider, pay sales tax on the supplies when you buy them.3Massachusetts Department of Revenue. 830 CMR 64H.1.1: Service Enterprises
If the property is worth more than 10%, or if you break it out as a separate line item, the property portion is taxable. And if the property exceeds 10% and you don’t separately state it, the DOR can tax the entire receipt.3Massachusetts Department of Revenue. 830 CMR 64H.1.1: Service Enterprises That last scenario is the one that catches vendors during audits. Itemize your invoices.
Fabrication
When a vendor turns raw materials into a finished physical product for a customer, that’s a fabrication, and it’s taxable. A print shop that creates custom brochures from paper and ink is selling tangible personal property, not performing a service, even though skilled labor is the major cost.1Massachusetts Department of Revenue. Sales and Use Tax
Repair Work
Repair labor is not taxable when parts and labor are separately stated on the invoice. Only the parts charge is subject to sales tax.6Massachusetts Department of Revenue. Letter Ruling 85-8: Auto Repairs If the repairer lumps everything into one charge, the full amount can become taxable when parts hit 10% or more of the total. This hits auto mechanics, appliance repair shops, and any similar business the same way.
Installation and Real Property
Installation labor isn’t taxed as long as the labor is separately stated from the property being installed. Labor performed under a contract for construction, reconstruction, alteration, or repair of real property is not subject to sales tax at all.1Massachusetts Department of Revenue. Sales and Use Tax Replacing a furnace that becomes a permanent fixture, installing a new roof, or renovating a bathroom are real property improvements, and the labor is exempt regardless of invoice structure.
Software, SaaS, and Digital Content
Software is the trickiest category, and the rules diverge sharply from how other digital content is treated.
Prewritten Software
Standardized (prewritten) software is taxable at 6.25% no matter how it reaches the customer. Disc, download, or remote access all count. Taxable transfers include licenses, leases, upgrades, and rights to use software hosted on someone else’s server.7Massachusetts Department of Revenue. 830 CMR 64H.1.3: Computer Industry Services and Products
Custom Software
Custom software development is generally exempt. When the principal object is the professional work of a programmer or systems analyst, and any physical media delivered is inconsequential, the transaction is a non-taxable service. The same 10% guideline applies. If the programming is bundled as a mandatory part of a taxable sale of hardware or prewritten software, however, the entire charge becomes taxable.7Massachusetts Department of Revenue. 830 CMR 64H.1.3: Computer Industry Services and Products
Cloud and SaaS
Cloud arrangements turn on the object-of-the-transaction test. When the customer’s real purpose is to access computing resources and storage capacity, and any use of prewritten software on the provider’s server is incidental, the DOR has ruled the transaction non-taxable.8Massachusetts Department of Revenue. Letter Ruling 12-8: Cloud Computing Pure infrastructure services generally fall on the exempt side. A standard SaaS product where the customer’s real object is using the software itself will often be taxable, because the DOR treats charges to access or use software on a remote server as sales of prewritten software.1Massachusetts Department of Revenue. Sales and Use Tax The line between using someone’s software and buying computing resources that happen to include software is fuzzy, and the DOR evaluates it transaction by transaction.
Other Digital Content
Downloaded music, video, and reading material are not taxable when delivered electronically.1Massachusetts Department of Revenue. Sales and Use Tax The same music on a CD or the same book in paperback is taxable. Delivery method controls the outcome.
Exemption Certificates You May See
Even on an otherwise taxable sale, a buyer may hand you a certificate that removes the transaction from the tax base. You have to verify the certificate is properly filled out and signed, and keep it in your records. On audit, the burden of proving a sale was not a taxable retail sale falls on the vendor unless the vendor has an accepted certificate on file.9Massachusetts Department of Revenue. Form ST-4 Sales Tax Resale Certificate
Resale: a buyer who will resell the item in the regular course of business uses Form ST-4. Manufacturing and research: materials, tools, fuel, and machinery used directly in manufacturing, processing, or converting tangible personal property are generally exempt, claimed on Form ST-12. The exemption extends to replacement parts and maintenance services for qualifying production equipment.9Massachusetts Department of Revenue. Form ST-4 Sales Tax Resale Certificate Nonprofit and government: 501(c)(3) organizations apply for Form ST-2 through MassTaxConnect using their federal EIN and name as they appear on the IRS determination letter. Once approved, the certificate is valid for ten years, and the DOR issues a renewal roughly 30 days before it expires if nothing has changed.10Massachusetts Department of Revenue. If You’re Selling Something Taxable
Any business selling taxable services or property in Massachusetts must register with the DOR through MassTaxConnect before collecting tax. The DOR mails a Form ST-1 registration certificate, which has to be posted and visible at the business location.11Massachusetts Department of Revenue. Register Your Business with MassTaxConnect Out-of-state sellers with no physical presence must register and collect once their remote sales to Massachusetts customers exceed $100,000 in a calendar year.1Massachusetts Department of Revenue. Sales and Use Tax
Filing frequency depends on estimated annual liability: annual if $100 or less (due January 20), quarterly if more than $100 but not more than $1,200 (due the 20th after each quarter), monthly if more than $1,200 (due the 20th of the following month). These thresholds exclude the meals tax, which has its own schedule.12Massachusetts Department of Revenue. 830 CMR 62C.16.2: Sales and Use Tax Returns and Payments
If a vendor doesn’t collect Massachusetts sales tax on a taxable transaction, the buyer owes use tax at the same 6.25% rate directly to the DOR.13Massachusetts Department of Revenue. Sales and Use Tax for Businesses This matters for businesses buying taxable software, telecommunications, or other taxable items from vendors who don’t collect Massachusetts tax; the obligation shifts to the buyer to self-report.
What’s at Stake If You Get It Wrong
Late filing carries a penalty of 1% of the unpaid tax per month (or fraction of a month), up to 25%.14Massachusetts Department of Revenue. Massachusetts Penalties and Interest Assessed by DOR Underpayment interest for the first quarter of 2026 is 8%, compounded daily, and the rate adjusts quarterly based on the federal short-term rate plus four percentage points.15Massachusetts Department of Revenue. TIR 25-8: Interest Rate On Overpayments And Underpayments
The piece that keeps business owners up at night: sales tax is a trust-fund tax. The money you collect from customers belongs to the Commonwealth, and you hold it until remittance. If a business fails to pay it over, any officer, employee, or member who had a duty to remit the tax is personally and individually liable for the amount owed.16General Court of Massachusetts. Massachusetts General Laws Chapter 64H, Section 16 An LLC or corporation does not shield you from that liability. Classifying the transaction correctly at the outset is far cheaper than defending the call later.
