Are THC Gummies Legal in Texas? Delta-8, Penalties & Medical Use

THC gummies are legal in Texas when they are hemp-derived, contain no more than 0.3% delta-9 THC on a dry weight basis, and are sold by a licensed or registered seller to a buyer at least 21 years old. Anything above that 0.3% line is not treated as marijuana under Texas law. It falls into Penalty Group 2, where even a small package can be charged as a felony.

What Makes a THC Gummy Legal in Texas

The dividing line is a single number. Texas Health and Safety Code Chapter 443 defines consumable hemp products and prohibits any retail product with a delta-9 THC concentration above 0.3% on a dry weight basis.1State of Texas. Texas Health and Safety Code Chapter 443 The Texas Controlled Substances Act backs that up by carving hemp and the tetrahydrocannabinols in hemp out of the definition of a controlled substance.2State of Texas. Texas Health and Safety Code 481.002 – Definitions Federal law draws the line in the same place: the 2018 Farm Bill removed hemp from the federal Controlled Substances Act using the same 0.3% delta-9 threshold.3Office of the Law Revision Counsel. 7 U.S. Code 1639o – Definitions

A compliant gummy also has to come through a legal channel. Manufacturers and businesses that repackage or relabel products need a license from the Texas Department of State Health Services Consumable Hemp Program, and stores selling pre-packaged products need a retail registration.4Texas DSHS. Consumable Hemp Program

You have to be 21 to buy. DSHS adopted emergency rules in October 2025 barring licensed retailers and registered sellers from selling consumable hemp products to anyone under 21 and requiring government-issued ID verification on every purchase.4Texas DSHS. Consumable Hemp Program Sellers who ignore the rule can lose their license or registration.

Before you buy, ask to see a Certificate of Analysis from an accredited lab. A legitimate COA shows cannabinoid content by type, the batch or lot number, the testing date, and screening results for pesticides, heavy metals, and residual solvents. If a retailer can’t produce one, walk out.

Where Delta-8 Gummies Stand Right Now

Delta-8 THC sits on shakier ground. In 2021, DSHS posted a notice classifying any amount of delta-8 THC as a Schedule I controlled substance. Hemp businesses sued; a Travis County court issued an injunction blocking the rule, and an appeals court upheld it. DSHS appealed to the Texas Supreme Court, where the case was still pending as of early 2026. While the injunction holds, hemp-derived delta-8 products continue to be sold in Texas.

Two other developments could change the picture quickly. Governor Abbott issued a 2025 executive order generally permitting the sale of THC products while banning sales to minors. In late 2025, Congress passed a provision that would ban hemp products containing more than 0.4% total THC, with the ban scheduled to take effect later in 2026. If that federal cap kicks in, products that rely on delta-8 or other isomers to push total THC higher could disappear from shelves no matter how the Texas court rules.

What Happens If a Gummy Isn’t Legal

Here is where people get the law badly wrong. Illegal THC gummies in Texas are not prosecuted as marijuana. The Controlled Substances Act lists tetrahydrocannabinols “other than marihuana” in Penalty Group 2, which captures THC in extracted, concentrated, and edible form.5State of Texas. Texas Health and Safety Code 481.103 – Penalty Group 2 Possession is charged under Section 481.116, and the penalties scale by the total weight of the product, not just the THC inside it:6State of Texas. Texas Health and Safety Code 481.116 – Offense Possession of Substance in Penalty Group 2

  • Less than 1 gram: state jail felony, 180 days to 2 years in a state jail facility and a fine up to $10,000.
  • 1 to 4 grams: third-degree felony, 2 to 10 years in prison and a fine up to $10,000.
  • 4 to 400 grams: second-degree felony, 2 to 20 years in prison and a fine up to $10,000.
  • 400 grams or more: first-degree felony, 5 to 99 years in prison and a fine up to $50,000.

Compare that with plant marijuana. Possession of less than two ounces of marijuana flower is a Class B misdemeanor with a maximum of 180 days in jail and a $2,000 fine.7State of Texas. Texas Health and Safety Code 481.121 – Offense Possession of Marihuana A pouch of gummies weighing a few grams can carry felony exposure that the equivalent weight of flower never would.

Why a Legal Product Can Still Get You Arrested

Standard field test kits can’t tell legal hemp from illegal THC. The Duquenois-Levine test commonly used in roadside stops identifies cannabis compounds but doesn’t measure THC concentration. If an officer finds gummies and the field test comes back positive, you can be arrested and charged even when the product is compliant. Sorting it out takes lab analysis, which can run weeks or months.

Carrying original packaging that lists cannabinoid content, along with a Certificate of Analysis for the batch, helps you make your case. It doesn’t prevent the arrest.

The Compassionate Use Program

Texas has one other legal pathway for THC products, and it isn’t the general hemp market. The Compassionate Use Program under Occupations Code Chapter 169 lets a registered physician prescribe low-THC cannabis to permanent Texas residents with a qualifying condition. Low-THC cannabis is defined by a per-dose cap: no more than 10 milligrams of tetrahydrocannabinols per dosage unit.8State of Texas. Texas Occupations Code Chapter 169 – Authority to Prescribe Low-THC Cannabis to Certain Patients for Compassionate Use

Qualifying conditions include epilepsy or a seizure disorder, multiple sclerosis, spasticity, ALS, autism, cancer, an incurable neurodegenerative disease, PTSD, chronic pain lasting more than 90 days where THC is a viable treatment, traumatic brain injury, Crohn’s disease or other inflammatory bowel disease, and terminal illness or conditions requiring hospice or palliative care.8State of Texas. Texas Occupations Code Chapter 169 – Authority to Prescribe Low-THC Cannabis to Certain Patients for Compassionate Use The physician enters the prescription in a state registry, and patients pick up their products only from state-licensed dispensaries. Smoking is not permitted; delivery methods include oils and capsules.

Workplace Drug Tests Don’t Care That It’s Legal

Legal hemp-derived gummies can still cost you your job. Standard drug tests detect THC metabolites and don’t distinguish between hemp-derived and marijuana-derived THC. Your employer generally doesn’t have to accept “it was legal hemp” as an explanation for a positive test.

The U.S. Department of Transportation is explicit for safety-sensitive workers like truck drivers, pilots, school bus drivers, and pipeline emergency responders. DOT guidance says CBD use is not a legitimate medical explanation for a positive marijuana test, and medical review officers will verify the positive even when the employee cites a legal CBD or hemp product. DOT also warns that product labels can be misleading because the FDA does not certify THC levels in CBD or hemp products.9U.S. Department of Transportation. DOT CBD Notice No federal law protects private-sector employees from being fired over a positive THC test caused by legal hemp use, and Texas has no state law protecting off-duty hemp use either.

Flying and Crossing State Lines

TSA policy allows hemp-derived products containing no more than 0.3% delta-9 THC in both carry-on and checked bags on domestic flights. Officers aren’t searching for cannabis products, but if they find something during routine screening and suspect it’s illegal, they refer the matter to local law enforcement.10Transportation Security Administration. Medical Marijuana Gummy packaging doesn’t always make THC content obvious, so keeping the original label and a COA with you helps if questions come up.

Driving across state lines is a different problem. The 2018 Farm Bill protects the interstate transport of compliant hemp, but that protection only reaches products that actually meet the federal hemp definition. At a traffic stop, the same field-testing limits that cause problems inside Texas apply everywhere else. And a product legal in Texas may be banned in the state you’re entering. Check destination state law before you pack.
