THC gummies are legal in Virginia, but only within narrow limits. Hemp-derived gummies sold at ordinary retail may contain no more than two milligrams of total THC per package, unless the product also carries at least 25 times as much CBD as THC. Stronger gummies made from cannabis are available only to patients enrolled in Virginia’s medical cannabis program. A federal law taking effect November 12, 2026 will tighten the rules again and push most products currently on shelves out of compliance.
What Makes a Hemp-Derived Gummy Legal at Retail
Virginia law separates hemp from marijuana at 0.3 percent total THC on a dry weight basis. Anything at or below that line is hemp; anything above it is marijuana and falls under a different set of rules.1Virginia Department of Agriculture and Consumer Services. Industrial Hemp | VDACS
For a hemp-derived gummy to be sold legally at retail in Virginia, two things must be true. The product can’t exceed 0.3 percent total THC concentration, and it can’t contain more than two milligrams of total THC per package.1Virginia Department of Agriculture and Consumer Services. Industrial Hemp | VDACS One exception: a product can exceed two milligrams if its CBD content is at least 25 times the total THC per package.2Virginia Code Commission. Virginia Code 3.2-4126 – Civil Penalties In practice, that means a 10 mg THC gummy package would need at least 250 mg of CBD to qualify under the ratio.
Labeling rules effectively set the minimum purchase age at 21. Any product containing THC must carry a notice that it may not be sold to anyone younger than 21.3Virginia Code Commission. Virginia Code 3.2-4123 – Product Packaging, Labeling, and Testing
Why Virginia’s Total THC Rule Catches People Off Guard
Virginia counts THC differently from the federal government. Under state law, “tetrahydrocannabinol” covers any naturally occurring or synthetic THC along with all its isomers, salts, and salts of isomers.4Virginia Code Commission. Virginia Code 3.2-4112 – Definitions “Total tetrahydrocannabinol” adds the weight of all THC isomers together with the adjusted weight of THCA, using a conversion factor of THCA × 0.877.5Virginia.gov. Guidance for Inhalable Hemp Products, October 2025
So delta-8, delta-9, delta-10, and every other THC variant all get counted when the state decides whether a gummy is legal. The federal 2018 Farm Bill, by contrast, measures only delta-9.6eCFR. 7 CFR 990.1 – Meaning of Terms A gummy that reads as federally legal because its delta-9 is under 0.3 percent can still violate Virginia law if delta-8 or other isomers push the total above the state’s limits. This matters most for products bought online from out-of-state retailers who formulate to the federal number.
How to Tell a Compliant Gummy on the Shelf
Virginia Code § 3.2-4123 lays out the packaging and labeling rules a legal hemp-derived gummy must follow:
- Child-resistant packaging on any product containing THC.
- No shapes or depictions of humans, animals, vehicles, or fruit.
- A label listing all ingredients, the single-serving amount, and the total percentage and milligrams of all THC in the product along with milligrams per serving.
- A notice that the product may not be sold to anyone under 21.3Virginia Code Commission. Virginia Code 3.2-4123 – Product Packaging, Labeling, and Testing
Every product also has to come with a certificate of analysis from an independent laboratory accredited under ISO/IEC 17025, stating the total THC concentration of the product or the batch. The lab’s accreditation certificate must be available for review at the retail location.3Virginia Code Commission. Virginia Code 3.2-4123 – Product Packaging, Labeling, and Testing If a shop can’t produce that paperwork, treat it as a warning sign.
Enforcement has been uneven, and non-compliant products remain widely available at convenience stores and vape shops. If a package promises strong psychoactive effects but claims to be hemp-derived, the math on the label is worth checking against the two-milligram rule.
Cannabis-Derived THC Gummies: Medical Patients Only
Gummies made from marijuana that exceed the 0.3 percent total THC threshold are legal only through Virginia’s medical cannabis program. To buy from a licensed dispensary, you need a written certification from a practitioner and a valid government-issued ID. Certifications are renewed annually.7Virginia Cannabis Control Authority. Medical Cannabis Program Overview Each dispensed dose of a cannabis product generally may not exceed 10 milligrams of total THC.8Virginia Code Commission. Virginia Code Title 4.1, Subtitle II – Cannabis Control Act
Adults 21 and older can already possess up to one ounce of marijuana for personal use.9Virginia Code Commission. Virginia Code 4.1-1100 – Possession of Marijuana by Persons 21 Years of Age or Older But there is no legal way to buy recreational cannabis gummies at a store today. That is scheduled to change on January 1, 2027.
Penalties for Non-Compliant Products
If a gummy’s total THC pushes it past the hemp threshold, it is treated as marijuana, and Virginia’s possession tiers apply to adults 21 and older:
- More than one ounce but not more than four ounces: civil penalty of up to $25.
- More than four ounces but not more than one pound: Class 3 misdemeanor for a first offense, Class 2 misdemeanor for a second or subsequent offense.
- More than one pound: felony carrying one to 10 years of imprisonment and a fine of up to $250,000, or both.9Virginia Code Commission. Virginia Code 4.1-1100 – Possession of Marijuana by Persons 21 Years of Age or Older
Possession of up to one ounce remains legal for anyone 21 or older, so a personal-use stash of non-compliant gummies is unlikely to produce criminal charges on its own. The sharper risk is on the sell side. Any business manufacturing or selling edible hemp products has to submit an Edible Hemp Products Disclosure Form to VDACS before offering the product for sale.10Virginia Department of Agriculture and Consumer Services. Hemp Product Enforcement Retailers out of compliance can face civil penalties of up to $10,000 for each day the violation continues, permit revocation, or criminal charges.11Virginia Department of Agriculture and Consumer Services. Flying with THC Gummies
Taking gummies through a Virginia airport brings federal law into the picture. The TSA follows federal rules, which currently allow hemp-derived products containing no more than 0.3 percent THC on a dry weight basis. Marijuana and cannabis products above that threshold remain federally illegal regardless of where you’re flying.12Transportation Security Administration. Medical Marijuana TSA officers aren’t actively testing gummies, but a product that raises suspicion can lead to delays and referral to law enforcement. Original sealed packaging with visible compliance labeling helps. The laws at your destination are a separate question worth checking before you pack.
The November 2026 Federal Change
Section 781 of the Continuing Appropriations Act of 2026 (Pub. L. No. 119-37), signed in November 2025, rewrites the federal definition of hemp. Starting November 12, 2026, “hemp” is measured by a total THC standard that includes THCA and delta-8, not just delta-9. Finished hemp-derived cannabinoid products are capped at 0.4 milligrams of total THC per container. The law also bans products containing cannabinoids synthesized outside the plant, which covers delta-8 produced through CBD isomerization and compounds such as HHC.
After November 12, 2026, non-compliant products become marijuana under the Controlled Substances Act. A two-milligram THC gummy that is fully legal under Virginia’s current hemp rules is five times the new federal limit. Nearly every hemp-derived THC gummy on the market today will need to be reformulated or pulled.
Recreational Retail Sales in 2027
Virginia has set up a framework for recreational marijuana retail. HB 642, passed during the 2026 legislative session, authorizes the Virginia Cannabis Control Authority to administer a retail marijuana market, with no retail sales permitted before January 1, 2027.13Virginia Legislative Information System. HB642 – 2026 Regular Session The same bill transfers oversight of certain regulated hemp products from VDACS to the Cannabis Control Authority starting January 1, 2027. Once retail sales open, adults 21 and older will be able to buy cannabis-derived gummies without a medical certification. Until then, medical dispensaries are the only legal storefront for cannabis-derived products, and compliant hemp-derived gummies remain available at general retail inside the limits above.
