Vape vending machines are legal in Florida, but only under tight conditions: the business needs a Retail Nicotine Products Dealer Permit for the location, each machine needs an employee-controlled lockout device that releases one product per transaction, and federal law restricts the machines to facilities that bar anyone under 21 from entering. Miss any of these, and you are looking at state criminal exposure, a permit the Division can refuse to reissue, and separate FDA penalties.
The Lockout Device Rule
Florida does not let a vape vending machine operate on its own. Section 569.37 requires every nicotine product sale to happen under the direct control or line of sight of the dealer or an employee. A vending machine qualifies only if it has a lockout device that an employee physically controls, triggering it to release one product at a time for each transaction.1Florida Senate. Florida Code 569.37 – Sale or Delivery of Nicotine Products; Restrictions
The device also has to fail safe. If the power cuts or someone disables the lockout, the machine cannot dispense anything. A machine sitting unattended and selling to whoever puts money in is illegal in Florida, full stop.
There is one exception. If your establishment prohibits everyone under 21 from entering at any time, the lockout requirement and the direct-control rule do not apply.1Florida Senate. Florida Code 569.37 – Sale or Delivery of Nicotine Products; Restrictions That covers bars and similar adults-only venues. Everywhere else, the lockout and an employee at the controls are mandatory.
Federal Rules Narrow the Field Further
Federal law sits on top of Florida’s. Under 21 CFR 1140.16, the FDA bans the sale of cigarettes and smokeless tobacco through any method other than a direct, face-to-face exchange with a consumer. Vending machines are explicitly prohibited, with one exception: machines in facilities where the retailer ensures no person under 21 is present or permitted to enter at any time.2eCFR. 21 CFR 1140.16 – Conditions of Manufacture, Sale, and Distribution The Tobacco Control Act carries the same restriction.3U.S. Food and Drug Administration. Family Smoking Prevention and Tobacco Control Act – An Overview
Read the two rules together and the practical picture tightens. A Florida-compliant lockout device is not enough on its own if the venue admits anyone under 21. To stay within both state and federal law in a mixed-age venue, you need the lockout plus an employee working it; the federal rule, meanwhile, still points toward adult-only facilities as the clean fit for vending machine operations.
The Permit You Need
Any business selling nicotine products at retail in Florida, or allowing a nicotine vending machine on its premises, must hold a Retail Nicotine Products Dealer Permit. Permits are issued per location. For vending machines, a permit is required for each machine and must be posted visibly on or near it. If you have multiple machines at one location, or sell both over the counter and through a machine at the same spot, one permit covers that location.4Florida Senate. Florida Code 569.32 – Retail Nicotine Products Dealer Permits; Application; Qualifications; Renewal; Duplicates
Applications go through the Florida Department of Business and Professional Regulation. There is currently no fee, though the statute lets the Division of Alcoholic Beverages and Tobacco set one up to $50 to cover administrative costs.5Florida Senate. Florida Code 569.003 – Division; Powers and Duties Permits can only be issued to individuals at least 21, or to corporations whose officers are all at least 21.4Florida Senate. Florida Code 569.32 – Retail Nicotine Products Dealer Permits; Application; Qualifications; Renewal; Duplicates
One shortcut: if you already hold a Retail Tobacco Products Dealer license, you do not need a separate nicotine permit to sell vape products or host a nicotine vending machine.6Florida Senate. Florida Code 569.34 – Operating Without a Retail Nicotine Products Dealer Permit; Penalty
Which Products You Can Stock
Every vaping product sold in the United States, including those sold through vending machines, needs a marketing authorization from the FDA. Companies obtain this through a Premarket Tobacco Product Application. Without a marketing granted order, a product cannot legally be sold.7U.S. Food and Drug Administration. Premarket Tobacco Product Marketing Granted Orders
As of early 2026, only a limited number of tobacco- and menthol-flavored e-cigarette products have received marketing orders. The FDA keeps a searchable database. Check every product you plan to load into a machine against it. Stocking an unauthorized product exposes you to federal enforcement, including seizure, on top of anything the state does.
Penalties for Selling to Someone Under 21
Selling, delivering, or giving a nicotine product to anyone under 21 is a criminal offense in Florida, not a regulatory infraction. Under Section 569.41, the penalties escalate:
- First offense: second-degree misdemeanor, punishable by up to 60 days in jail, a fine, or both.
- Second offense within one year: first-degree misdemeanor, punishable by up to one year in jail, a fine, or both.
- Third or subsequent offense at any time after the first: third-degree felony, punishable by up to five years in prison.
The statute applies to all nicotine product sales, vending machine transactions included.8Florida Senate. Florida Code 569.41 – Selling, Delivering, Bartering, Furnishing, or Giving Nicotine Products to Persons Under 21 Years of Age; Criminal Penalties; Defense A machine with a broken or bypassed lockout can accumulate violations quickly.
Penalties for Operating Without a Permit
Running a vape vending machine without the required permit is a noncriminal violation carrying a fine of up to $500. You are cited to appear before county court. You can pay the fine within 10 days, post a $500 bond, or appear at the hearing. Paying counts as admitting the violation.6Florida Senate. Florida Code 569.34 – Operating Without a Retail Nicotine Products Dealer Permit; Penalty
The longer-term risk is worse than the fine. The Division can refuse to issue a permit to anyone whose permit has previously been revoked, including individual officers of a corporation that lost its permit.5Florida Senate. Florida Code 569.003 – Division; Powers and Duties A revocation can follow you into future ventures.
Federal Civil Money Penalties
The FDA runs its own penalty track for sales to anyone under 21, authorized under 21 U.S.C. ยง 387f(d)(5), and the amounts escalate with repeat violations.3U.S. Food and Drug Administration. Family Smoking Prevention and Tobacco Control Act – An Overview The current dollar amounts, adjusted for inflation, are published by the FDA’s Center for Tobacco Products. For repeat offenders, the FDA can also issue a no-tobacco-sale order, barring a retail location from selling any tobacco products for a set period. That alone can end a vending operation independent of anything the state does.
The Age-Verification Defense
Florida provides a complete defense if you are charged with selling nicotine products to a minor, but all three elements have to be present at the time of the sale:
- The buyer claimed to be 21 or older.
- A reasonable person would have believed the buyer was 21 or older based on how they looked.
- You carefully checked a valid driver’s license, state-issued ID, passport, or U.S. military ID and acted in good faith on what it showed.
You cannot rely on just one.8Florida Senate. Florida Code 569.41 – Selling, Delivering, Bartering, Furnishing, or Giving Nicotine Products to Persons Under 21 Years of Age; Criminal Penalties; Defense For a vending machine, this is harder than it looks. The employee controlling the lockout is the person who has to verify age before releasing a product. No ID check at the lockout means no defense.
Local Rules Do Not Add More
Florida preempts local governments from setting their own minimum purchase ages or separate rules on the marketing, sale, or delivery of nicotine products. A city or county cannot add vending machine restrictions, require extra permits, or raise the purchase age above what Chapter 569 sets. If you operate machines in more than one Florida jurisdiction, the rules are the same in each.
