Weed pens are legal in Florida only for patients registered in the state’s medical marijuana program. For everyone else, possessing a THC vape pen is a third-degree felony, no matter how small the cartridge. Hemp-derived vape pens containing Delta-8, CBD, or trace Delta-9 THC are a separate category and currently legal to buy without a medical card, though a federal rule arriving in late 2026 will upend most of that market.
Florida has no recreational marijuana program. Amendment 3 fell short of the 60% constitutional threshold in November 2024, so the medical route remains the only lawful one.
Unauthorized Possession Is a Felony
This is where people get caught off guard. Possessing 20 grams or less of cannabis flower is a first-degree misdemeanor in Florida. But the statute carves cannabis resin, extracts, and concentrates out of that misdemeanor category. THC vape oil is a concentrate. That means possessing any amount of THC vape oil without a medical card is a third-degree felony, punishable by up to five years in prison and a $5,000 fine.1Florida Senate. Florida Statutes 893.13 – Prohibited Acts; Penalties
A half-used cartridge carries the same felony classification as holding more than 20 grams of flower. The amount in the pen doesn’t change the charge.
A drug conviction also triggers a mandatory six-month driver’s license suspension under Florida Statute 322.055, though a court can grant a business-purposes-only exception in compelling circumstances.2The Florida Legislature. Florida Statutes 322.055 – Revocation or Suspension for Drug Offenses And if a hemp-derived vape pen tests above the legal THC threshold, it can be prosecuted as unlawful marijuana possession under the same statute.
The Medical Marijuana Route
Florida’s medical marijuana program, governed by Section 381.986 of the Florida Statutes, lets qualifying patients buy THC vape pens from state-licensed Medical Marijuana Treatment Centers (MMTCs).3Florida Senate. Florida Code 381.986 – Medical Use of Marijuana You need three things to get in:
- Florida residency, permanent or seasonal
- A diagnosis of a qualifying condition from a state-certified physician
- A Medical Marijuana Use Registry Identification Card issued by the Office of Medical Marijuana Use4Office Of Medical Marijuana Use. Registry Identification Cards
Qualifying Conditions
Florida law names specific conditions and includes a catch-all for comparable debilitating conditions:5Official Internet Site of the Florida Legislature. Florida Statutes 381.986 – Medical Use of Marijuana
- Cancer
- Epilepsy
- Glaucoma
- HIV/AIDS
- PTSD
- ALS
- Crohn’s disease
- Parkinson’s disease
- Multiple sclerosis
- Chronic nonmalignant pain
- Terminal illness with a prognosis of 12 months or less
- Other debilitating medical conditions comparable to those listed above
That last category gives physicians real discretion. If your diagnosis is similar in severity to a named condition, a qualified physician can still certify you.
Cost and Timeline
The physician evaluation typically runs $75 to $250. After certification, you register with the OMMU and pay a $75 annual state registration fee for the card. The full process usually takes a few weeks. Only MMTCs can dispense medical cannabis products, including vape cartridges, and your physician controls what forms and quantities you’re authorized to buy through the registry.
Hemp-Derived Vape Pens Without a Card
Vape pens that contain hemp-derived cannabinoids operate under a different rulebook. Florida’s hemp program, established under Section 581.217, follows the federal line: hemp is cannabis with no more than 0.3% total Delta-9 THC on a dry weight basis.6Florida Senate. Florida Statutes 581.217 – State Hemp Program Products meeting that threshold, including Delta-8 THC, HHC, CBD, and low-concentration Delta-9 vape pens, are currently legal in Florida without a medical card.
Florida still imposes product rules. Containers must carry a scannable QR code linking to a certificate of analysis, list the milligrams of each cannabinoid per serving, and use child-resistant packaging that doesn’t appeal to children. Sales of inhalable and ingestible hemp extract products are restricted to buyers 21 and older.
A Federal Cap Arriving November 12, 2026
Congress passed amendments to the 2018 Farm Bill that cap total THC in finished hemp products at 0.4 milligrams per container. That limit takes effect on November 12, 2026. Most CBD products on shelves today exceed 0.4 milligrams per container, and nearly every Delta-8 or Delta-9 vape cartridge sits far above it. Once the rule takes effect, most hemp-derived THC vape pens currently sold legally in Florida will need to be reformulated or pulled. If you rely on hemp-derived THC products, mark the date.
Where You Can and Cannot Vape
A valid medical card doesn’t make a vape pen legal everywhere.
Indoors
Florida’s Clean Indoor Air Act prohibits vaping in enclosed indoor workplaces, including offices, restaurants, retail stores, and public transportation.7The Florida Legislature. Florida Statutes 386.204 – Prohibition Narrow exceptions exist for designated hotel and motel guest rooms, standalone bars, and retail tobacco shops.8Florida Senate. Florida Statutes 386.2045 – Enclosed Indoor Workplaces; Specific Exceptions Private residences aren’t covered by the ban, but landlords can prohibit vaping in leases, and the medical marijuana statute preserves a property owner’s right to restrict use on their property.
Vehicles
Using a medical marijuana vape pen in a vehicle, aircraft, or motorboat is a first-degree misdemeanor, even for registered patients. The statute carves out a narrow exception only for low-THC cannabis that isn’t in a smokable form.5Official Internet Site of the Florida Legislature. Florida Statutes 381.986 – Medical Use of Marijuana You can transport your pen, but the product must stay in its original packaging. No lockbox is required by statute, though keeping it sealed and out of reach helps during a traffic stop.
Driving
Driving impaired by cannabis is illegal under Florida’s DUI statute. The standard is whether your normal faculties are impaired; a medical card does not shield you.9Justia. Florida Code 316.193 – Driving Under the Influence; Penalties
Work and Housing
A Florida medical marijuana card provides no workplace protection. The statute explicitly preserves an employer’s right to maintain a drug-free workplace, imposes no accommodation duty, and creates no cause of action for wrongful discharge or discrimination based on a positive drug test.5Official Internet Site of the Florida Legislature. Florida Statutes 381.986 – Medical Use of Marijuana You can legally use your vape pen at home on Friday and be fired for Monday’s drug test.
Housing has its own traps. Federal rules allow HUD to remove tenants from public housing or Section 8 housing for marijuana use on the premises, even where state law permits it. Private landlords can prohibit cannabis use through lease terms.
Out-of-State Cards and Travel
Florida does not recognize medical marijuana cards issued by other states. Out-of-state visitors cannot buy from Florida MMTCs or legally possess THC products here based on another state’s card.10Office Of Medical Marijuana Use. Frequently Asked Questions Florida patients traveling elsewhere should check the destination state’s reciprocity rules before packing a vape pen.
Air travel carries its own risk. Marijuana remains a Schedule I controlled substance under federal law, and TSA officers are required to report suspected violations to law enforcement when discovered during screening.11Transportation Security Administration. Medical Marijuana TSA doesn’t actively hunt for cannabis, but if a THC vape pen turns up in a bag check, the outcome depends on how local law enforcement responds. Hemp products at or below 0.3% Delta-9 THC on a dry weight basis are federally legal to fly with, though proving a product’s THC content on the spot is rarely simple. Mailing any THC product above the federal hemp threshold through USPS is a federal offense under the PACT Act.
