Having Adderall in Arizona without a prescription is a Class 4 felony under state law, punishable by a presumptive 2.5 years in prison and a mandatory fine of at least $1,000. Most people charged for the first time with simple personal possession qualify for mandatory probation instead of prison under Proposition 200, but that protection vanishes once the quantity hits nine grams or the facts suggest you were selling.
What Counts as Possessing Adderall Without a Prescription
Adderall is a Schedule II controlled substance federally,1Drug Enforcement Administration. Drug Scheduling and Arizona classifies its active ingredient, amphetamine, as a “dangerous drug” under ARS 13-3407.2Arizona Legislature. Arizona Code 13-3407 – Possession, Use, Administration, Acquisition, Sale, Manufacture or Transportation of Dangerous Drugs; Classification Legal possession requires a current prescription from a practitioner holding a DEA registration number.3Drug Enforcement Administration. Registration Q&A
Because Adderall is Schedule II, refills are prohibited. A practitioner can write multiple sequential prescriptions covering up to a 90-day supply, but each one has to state the earliest date a pharmacy may fill it.4eCFR. 21 CFR 1306.12 – Refilling Prescriptions; Issuance of Multiple Prescriptions A few situations that people assume are safe actually aren’t:
- Holding onto pills past the period your prescription covered.
- Carrying someone else’s prescription pills, even a family member’s.
- Taking a friend’s Adderall to study or stay awake.
In each of those situations, you are in the same legal position as someone with no prescription at all.
Felony Penalties for Simple Possession
Possessing or using Adderall without a valid prescription is a Class 4 felony under ARS 13-3407, no matter how small the quantity.2Arizona Legislature. On top of any prison term, the court must impose a fine of at least $1,000 or three times the street value of the drugs, whichever is greater. Judges cannot waive or reduce it.2Arizona Legislature. Why Adderall Can’t Be Reduced to a Misdemeanor
For many dangerous drugs, Arizona prosecutors can ask the court to reduce a first-time simple possession charge to a Class 1 misdemeanor. That option does not exist for Adderall. The statute specifically excludes amphetamine, along with methamphetamine, LSD, and PCP, from the misdemeanor reduction.2Arizona Legislature. Arizona Code 13-3407 – Possession, Use, Administration, Acquisition, Sale, Manufacture or Transportation of Dangerous Drugs; Classification
A college student holding a few unprescribed pills during finals week faces the same felony classification as someone caught with a much more stigmatized substance. That mismatch between how people perceive Adderall and how the statute treats it is the single most important thing to understand about the law.
Proposition 200 Probation for First and Second Offenses
Most first-time Adderall possession cases do not end in prison. Arizona’s Proposition 200, codified at ARS 13-901.01, requires courts to grant probation to anyone convicted of personal possession or use of a controlled substance for the first or second time. The statute overrides the normal sentencing framework and tells the court to suspend the prison sentence and place the person on probation.6Arizona Legislature. Arizona Code 13-901.01 – Probation for Persons Convicted of Possession or Use of Controlled Substances or Drug Paraphernalia
A drug treatment or education program is a required condition, and you are expected to pay for it to the extent you can afford it. For a second conviction, the court can add intensive probation, home arrest, or community restitution.6Arizona Legislature. Arizona Code 13-901.01 – Probation for Persons Convicted of Possession or Use of Controlled Substances or Drug Paraphernalia
Prop 200 has limits. You lose eligibility if:
- You have been convicted of personal possession three or more times.
- You were convicted of or indicted for a violent crime.
- You refuse drug treatment or reject probation.
- The offense involved methamphetamine.
The methamphetamine exclusion matters because it does not sweep in amphetamine generally. Someone caught with unprescribed Adderall still qualifies for Prop 200 on a first or second offense, assuming no other disqualifier applies.6Arizona Legislature. Arizona Code 13-901.01 – Probation for Persons Convicted of Possession or Use of Controlled Substances or Drug Paraphernalia Refusing court-ordered treatment after starting probation can trigger revocation and resentencing under the standard felony ranges.
When Possession Becomes Possession for Sale
If evidence suggests you had Adderall with intent to sell, or transported it for sale, the charge jumps to a Class 2 felony.2Arizona Legislature. Arizona Code 13-3407 – Possession, Use, Administration, Acquisition, Sale, Manufacture or Transportation of Dangerous Drugs; Classification First-time Class 2 ranges are:5Arizona Legislature. - Mitigated: 3 years
- Minimum: 4 years
- Presumptive: 5 years
- Maximum: 10 years
- Aggravated: 12.5 years
Prosecutors do not need to catch anyone mid-transaction. Cash alongside pills, digital scales, individually packaged doses, or text messages discussing sales can all be used as evidence of intent. Prop 200’s mandatory probation does not apply to possession for sale. The $1,000-or-three-times-value fine does.2Arizona Legislature. The Nine-Gram Threshold
Arizona sets a threshold amount for amphetamine at nine grams, including amphetamine in liquid form.7Arizona Legislature. Arizona Code 13-3401 – Definitions Hitting or exceeding that weight means mandatory prison and no eligibility for probation, a suspended sentence, or early release, whether the charge is simple possession or possession for sale. Judicial discretion disappears.
A standard Adderall tablet contains roughly 5 to 30 milligrams of mixed amphetamine salts, so nine grams of pure amphetamine would represent a large number of pills. The threshold goes by the total weight of the substance, though, which depending on how the state calculates it can include inactive ingredients. The specific facts matter.
How Arizona Finds Out
Arizona runs the Controlled Substances Prescription Monitoring Program through the State Board of Pharmacy, which collects dispensing data on every Schedule II through V prescription filled in the state.8Arizona Controlled Substances Prescription Monitoring Program. Pharmacists are required to check the PMP database before dispensing any Schedule II substance, including Adderall. Practitioners also have to query it before prescribing opioids or benzodiazepines in Schedules II through IV and at least quarterly while treatment continues.9Arizona Legislature. Arizona Code 36-2606 – Registration; Access; Requirements; Mandatory Use; Annual User Satisfaction Survey; Report; Definitions Trying to collect prescriptions from multiple doctors or pharmacies leaves a clear data trail, and more than 45 states share PMP data through a national interconnect, so filling across state lines does not hide the pattern. Law enforcement can access the data for investigations, and PMP records sometimes end up as evidence in criminal cases.8Arizona Controlled Substances Prescription Monitoring Program.
