To vote by absentee ballot in Arkansas, you need one of three qualifying excuses, an approved application on file with your county clerk, and a properly assembled return envelope that includes a copy of your photo ID. Arkansas does not allow no-excuse mail voting, does not use drop boxes, and does not give you a chance to fix a ballot after you send it in. Getting the details right the first time is the whole game.
Who Can Vote Absentee in Arkansas
Arkansas is one of a small number of states that still requires a reason to vote absentee. Preferring the convenience of mail is not enough. Under Arkansas Code 7-5-402, you qualify only if one of the following applies:1Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-402 – Voter Qualification
- You will be unavoidably absent from your polling place on Election Day.
- Illness or physical disability keeps you from voting in person.
- Religious discipline or a religious holiday prevents you from voting during the full twelve hours the polls are open.
Military members, their spouses and dependents, Merchant Marines, and U.S. citizens living abroad vote absentee through a separate federal framework, covered further down. Residents of state-licensed long-term care or residential care facilities also vote absentee, and facility administrators have a special pathway for handling those ballots.2Arkansas Board of Election Commissioners. How to Apply for a Ballot
The application form is prescribed by the Secretary of State and available from your county clerk’s office or the Arkansas Board of Election Commissioners website.3Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-405 – Application Form You will provide your name, residential voting address, date of birth, the election you want a ballot for, and the qualifying reason that applies to you.
Sign the application yourself. The county clerk compares your signature against the one on your voter registration file, and a clear mismatch is grounds for rejection.4Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-404 – Applications for Ballots If someone helps you fill out the form, that person has to include their own name, address, and signature. Electronic applications require a verifiable copy of your signature.
Application Deadlines
Your deadline depends on how you submit the application:
- By mail, fax, or email: must reach the county clerk no later than seven days before Election Day.
- In person or by designated bearer: must be delivered by the time the clerk’s office closes on the Friday before Election Day.
- By authorized agent, for voters medically unable to get to the polls: must be delivered by 1:30 p.m. on Election Day.
The clerk has no discretion to accept a late application.4Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-404 – Applications for Ballots Build in a cushion. If something goes wrong with your signature, you still have to resubmit before the same cutoff.
What to Include in Your Return Envelope
When the clerk approves your application, you receive a ballot package: the ballot, an inner ballot envelope, a voter statement form, and an outer return envelope. Envelope assembly is where many ballots fail. Mark your ballot, seal it inside the inner envelope, and place that sealed envelope, your completed voter statement, and a copy of your photo ID into the outer return envelope.
The voter statement asks for your printed name, signature, mailing address, residential voting address, and date of birth.5Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-409 – Materials Furnished to Qualified Voters You sign it under penalty of perjury. Election officials compare the name, address, date of birth, and signature on this statement against your original application; a clear, easily recognizable signature difference means rejection.6Arkansas Secretary of State. The Photo ID Copy
Every returned absentee ballot has to include a copy of photo identification. A photocopy is fine; you do not send the original.7Arkansas Secretary of State. 7 CAR 90-107 – Identification Required When Voting Absentee The ID must show your name and photograph and be issued by the United States, the State of Arkansas, or an accredited Arkansas postsecondary institution. If it has an expiration date, it cannot have expired more than four years before Election Day.
Common accepted forms include an Arkansas driver’s license or state photo ID card, a U.S. passport, U.S. military identification, a concealed handgun carry license, a college or university employee badge from an accredited Arkansas institution, a photo public assistance ID card, and the voter verification card issued under Arkansas law.8Arkansas Secretary of State. Voter Registration Information Residents of state-licensed long-term care facilities do not need to send a photo ID copy and instead submit documentation from the facility administrator confirming residency.
Return Deadlines and Allowed Methods
Arkansas law lists four, and only four, ways to return a voted absentee ballot. There are no drop boxes. County clerks, public employees, and election officials are prohibited from setting them up or using them for absentee collection.9Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-411 – Methods of Voting Absentee
- U.S. mail: must be received by the county clerk by 7:30 p.m. on Election Day. Each ballot has to be mailed separately. Bulk mailing of multiple ballots is prohibited unless the sender is a licensed long-term care facility administrator.
- In-person delivery by the voter: hand-delivered inside the county clerk’s physical office by the time it closes on the Friday before Election Day.
- Designated bearer or facility administrator: delivered to the clerk’s physical office by close of business on the Friday before Election Day.
- Authorized agent, for voters medically unable to reach the polls: delivered to the clerk’s office by 7:30 p.m. on Election Day, with signature verification and agent identity validation.
Postmark does not count for standard absentee returns. If the clerk does not have your ballot in hand by 7:30 p.m. on Election Day, it will not be counted.
Using a Designated Bearer
A designated bearer picks up and returns an absentee ballot on your behalf. One bearer can handle ballots for no more than two voters per election and cannot possess more than two absentee ballots at any time.10National Conference of State Legislatures. Ballot Collection Laws The bearer has to show photo ID to the county clerk and sign an oath both when picking up the ballot and when returning it. Their name, address, and signature must also appear on your voter statement.5Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-409 – Materials Furnished to Qualified Voters
Military and Overseas Voters
Members of the uniformed services, Arkansas National Guard, and Merchant Marines on active duty qualify for absentee voting, along with their spouses and dependents. U.S. citizens whose residence is in Arkansas but who live outside the country also qualify. These voters apply through the federal Uniformed and Overseas Citizens Absentee Voting Act, not the standard state process.2Arkansas Board of Election Commissioners. Arkansas Board of Election Commissioners – Absentee Voting
The important difference is the deadline. Ballots from qualified voters outside the United States must be signed, postmarked, and mailed no later than Election Day and may arrive at the county clerk’s office up to ten calendar days after the election. For active-duty military, the ballot has to be executed by Election Day and received within that same ten-day window; no postmark requirement applies.9Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-411 – Methods of Voting Absentee Federal law requires election officials to deliver blank ballots through at least one electronic method such as email or an online portal. If your ballot does not arrive in time, the Federal Write-In Absentee Ballot serves as a backup for federal races.11U.S. Election Assistance Commission. Best Practices for Serving Military Voters
If Something Goes Wrong
If your application is rejected because the signature does not match the one in your voter registration file, the county clerk has to notify you promptly by phone, email, or first-class mail and let you resubmit.4Justia. Arkansas Code Title 7 Chapter 5 Subchapter 4 Section 7-5-404 – Applications for Ballots The rejection is also logged in the clerk’s permanent electronic system. Resubmission still has to meet the original deadline, so apply well ahead of the cutoff.
There is no equivalent process for a voted ballot. Arkansas does not offer a cure procedure once your ballot is in the clerk’s hands. If canvassers find a missing voter statement, no photo ID copy, or a signature that does not match, the ballot is rejected and you typically will not find out until after Election Day. Before sealing the outer envelope, check that the voter statement is complete and signed, the photo ID copy is inside, the inner ballot envelope is sealed, and your signature looks like the one on your application.
Early Voting as an Alternative
If your schedule is unpredictable but you can get to a polling location before Election Day, early voting may be simpler than the absentee route. Early voting in Arkansas has no excuse requirement. Any qualified voter can show up during the early voting period.
For preferential primary and general elections, early voting runs from fifteen days before the election through 5:00 p.m. on the Monday before Election Day, with hours of 8:00 a.m. to 6:00 p.m. Monday through Friday and 10:00 a.m. to 4:00 p.m. on Saturdays. State holidays are excluded. For other elections, including general primary and runoff elections, early voting runs from seven days before through the day before the election, during regular county clerk office hours.12FindLaw.
