Arkansas emotional support animal laws give tenants with a qualifying mental health disability the right to keep an ESA in rental housing without paying pet deposits, pet fees, or monthly pet rent, even where the landlord has a no-pet policy. Those protections come primarily from the federal Fair Housing Act and the Arkansas Fair Housing Act. One state-specific rule sets Arkansas apart: since 2023, the licensed professional who writes your ESA letter must have had a therapeutic relationship with you for at least 30 days.
What a Landlord Must Allow
A landlord who receives a reasonable accommodation request supported by proper documentation has to let the tenant keep the ESA. No pet deposit, no pet fee, no monthly pet rent.1U.S. Department of Housing and Urban Development. Assistance Animals Breed restrictions, weight limits, and species bans in the general pet policy do not apply to assistance animals, because any denial has to rest on evidence about the specific animal rather than a category.
Arkansas Code 16-123-314 mirrors the federal prohibition on disability-based housing discrimination, and the Arkansas Fair Housing Act is considered substantially equivalent to the federal law.2Justia. Arkansas Code 16-123-314 – Disability – Definition3Arkansas Department of Inspector General. Fair Housing Laws A landlord can legally deny an ESA request only in narrow situations:
- The specific animal poses a genuine health or safety threat that no other accommodation could reduce.
- The specific animal would cause substantial physical property damage that no alternative could prevent.
- Granting the request would impose an unreasonable financial or administrative burden on the landlord.
Rentals Not Covered
Two narrow federal exemptions take some Arkansas rentals outside fair housing coverage. The first is a single-family home rented by a private owner who owns no more than three such homes and rents without a broker or real estate agent. The second is an owner-occupied building with no more than four units where the owner lives in one of them.4Office of the Law Revision Counsel. 42 USC 3603 – Effective Date of Subchapter Even in exempt rentals, discriminatory advertising is still prohibited, and many landlords in these situations accommodate ESAs anyway to avoid a dispute.
The 30-Day Provider Relationship Rule
Arkansas HB1420, enacted in 2023, requires that the licensed mental health professional writing your ESA letter must have had a therapeutic relationship with you for at least 30 days before issuing it.5Arkansas State Legislature. HB1420 This directly targets the websites that sell instant ESA letters after a brief questionnaire and a credit card payment. A letter produced that way can reasonably be rejected by an Arkansas landlord.
A valid letter should come from a licensed healthcare professional such as a physician, psychologist, psychiatrist, or licensed therapist, and should appear on official letterhead with the provider’s contact information, license number, and date. The letter needs to confirm that you have a disability substantially limiting at least one major life activity and that the ESA provides therapeutic emotional support that alleviates a symptom or effect of that disability.6HUD Exchange. What Documentation Does a Resident Need to Provide So an Assistance Animal Is Not Considered a Pet
Telehealth is not automatically disqualifying. HUD distinguishes between legitimate remote healthcare, where a licensed provider delivers real services and has personal knowledge of the patient, and pay-for-a-letter sites that sell certificates to anyone.7U.S. Department of Housing and Urban Development. Fact Sheet on HUDs Assistance Animals Notice A legitimate telehealth provider still has to clear the 30-day relationship bar in Arkansas.
What a landlord cannot demand: access to your full medical records, a specific diagnosis, a particular letter format, or annual renewals for conditions that are permanent or long-term.
Damage, Deposits, and Your Liability
The no-pet-fee rule is often misread as protection against any animal-related charges. It is not. If an ESA scratches hardwood, stains carpet, or damages the unit beyond normal wear and tear, the landlord can deduct repair costs from your standard security deposit the same way they would for any other damage.1U.S. Department of Housing and Urban Development. Assistance Animals
Document the condition of the unit at move-in with photos and a written checklist so that a landlord cannot later attribute pre-existing damage to the animal. Renter’s insurance that includes pet-related liability is worth considering, since you could be personally liable if the ESA injures another tenant or a visitor.
Where ESAs Have No Protection
An ESA letter is a housing document. It gives you no right to bring the animal into restaurants, grocery stores, movie theaters, hotels, or other businesses in Arkansas. Only service animals under the ADA have that public-access right, and ESAs do not meet the ADA definition because they are not individually trained to perform a specific task related to a disability.8U.S. Department of Justice. Some businesses allow well-behaved animals voluntarily, but that is their choice, not your right.
Air Travel
Airlines are no longer required to treat ESAs as anything other than pets. A U.S. Department of Transportation final rule issued in December 2020, effective January 2021, revised the Air Carrier Access Act regulations and expressly removed emotional support animals from the service-animal category for air travel.10U.S. Department of Transportation. U.S. Department of Transportation Announces Final Rule on Traveling by Air with Service Animals Expect to use an under-seat carrier and pay standard pet fees, typically $50 to $150 each way. Psychiatric service dogs trained to perform specific tasks still qualify for free cabin travel under the revised rules.
ESAs in University Housing
Students at Arkansas colleges and universities can request an ESA accommodation in dormitories and other university-owned housing. The Fair Housing Act applies because these are dwellings, and a university cannot refuse an ESA simply because pets are not usually permitted in student housing.1U.S. Department of Housing and Urban Development. Assistance Animals
Send the request to the campus disability services office with the same documentation any landlord would require, including a letter from a licensed mental health professional who satisfies Arkansas’s 30-day relationship rule. Universities can use their own forms but cannot set requirements that conflict with fair housing law, such as a flat species restriction without an individualized assessment. The animal is generally limited to your living space. Classrooms, dining halls, and other campus buildings fall under the public-access rules that cover service animals only.
If a Landlord Refuses
If an Arkansas landlord or university wrongfully denies a reasonable accommodation, you can file a housing discrimination complaint with HUD or the Arkansas Department of Inspector General, which handles fair housing enforcement in the state.3Arkansas Department of Inspector General. Fair Housing Laws Under federal law, the complaint generally has to be filed within one year of the discriminatory act. You can also file a federal lawsuit directly without going through the administrative process. Possible remedies include an order requiring the landlord to allow the ESA, monetary damages, and in some cases attorney’s fees.
Keep written records of every communication, especially your initial request, the documentation you submitted, and the landlord’s response. Email and text are better evidence than phone calls.
Fake Letters and Misrepresentation
Arkansas does not currently have a statute that specifically criminalizes falsely claiming a pet is an ESA. Even so, submitting a fabricated letter is not consequence-free. A landlord who discovers that a tenant used a fake ESA letter may have grounds to terminate the lease for material misrepresentation, and someone caught claiming ESA status to get a pet into a restricted business can be removed and banned from the premises.
