Arkansas salvage title rules kick in when a vehicle’s damage reaches 70% of its pre-loss retail value, or when the vehicle is water-damaged. 1Justia Law. Arkansas Code Title 27 – Section 27-14-2301 – Definitions Once a vehicle hits either trigger, the current title has to be surrendered to the Office of Motor Vehicle within 30 days, and a new title stamped “SALVAGE” takes its place. From there the vehicle has three possible futures: rebuilt and road-legal, parts-only and permanently off the road, or sold with mandatory written disclosure to the buyer. Missing a step can mean a Class A misdemeanor, a voided sale, or a vehicle you can’t register.
When a Vehicle Becomes Salvage
Two conditions make a vehicle salvage in Arkansas: damage equal to or greater than 70% of the vehicle’s average retail value before the damage, or water damage of any dollar amount. 1Justia Law. Arkansas Code Title 27 – Section 27-14-2301 – Definitions The Office of Motor Vehicle sets the criteria for calculating that retail value.
Age matters. The mandatory salvage title rules apply only to vehicles less than eight model years old before the calendar year of the incident. If your vehicle is eight model years old or older, you are not required to brand it, though you may voluntarily surrender the title and request either a salvage certificate or a parts-only title. 2Justia Law. Arkansas Code Title 27 – Section 27-14-2302 – Issuance of Damage Certificate That line decides whether the 30-day clock below is a legal obligation or just an option.
Who Files, and By When
The 30-day deadline runs from the date the vehicle became salvage, and it applies whether the owner is an insurance company or an individual. 2Justia Law. Arkansas Code Title 27 – Section 27-14-2302 – Issuance of Damage Certificate Three scenarios cover most cases.
When an insurer takes ownership through an indemnity payment, the insurer surrenders the existing certificate of title to the Office of Motor Vehicle within 30 days of acquiring it, along with a completed Declaration of Damage form, a salvage title application, and the applicable fees and taxes. 3Code of Arkansas Rules. 27 CAR 14-102 – Salvage Title Application Process The Office then issues a new certificate with “SALVAGE” printed in the remarks section on the face of the title. 4Code of Arkansas Rules. 27 CAR 14-103 – Issuance of Salvage Titles and Title Notation
When an insurer pays a claim but does not take ownership, it must still notify the Office that the vehicle is a salvage vehicle. 2Justia Law. Arkansas Code Title 27 – Section 27-14-2302 – Issuance of Damage Certificate A notation then follows the title through any reissue until the owner surrenders the certificate and a proper salvage title is issued. 5Arkansas Department of Finance and Administration. When no insurer is in the picture — the owner takes the loss themselves, or the vehicle isn’t insured — the owner has the same 30 days to surrender the title with the Declaration of Damage, application, and fees. 2Justia Law. Rebuilding a Salvage Vehicle Back to Road Legal
A salvage title is not a dead end. If you repair the vehicle, you can apply for a rebuilt title, which allows registration and road use. Arkansas requires three things: a completed Affidavit of Reconstruction, a VIN inspection, and the rebuilt title application filed within ten working days of finishing the rebuild. 6Legal Information Institute. Arkansas Code R 006.05.07-007 – Rule 2007-8 Salvage, Rebuilt and Parts Only Vehicle
The Affidavit of Reconstruction
The affidavit is a sworn record of what was done to the vehicle. The rebuilder lists every part repaired and every part replaced, including the donor VIN for major components such as engines, transmissions, and body panels, and provides a written description of the repairs. Both the rebuilder and the owner sign, and the rebuilder certifies under penalty of law that all structural repairs meet manufacturer or industry-approved standards. 7Arkansas Department of Finance and Administration. Affidavit of Reconstruction of Salvage Motor Vehicle
Water-damaged vehicles carry an extra burden: every replaced electrical component has to be listed on the affidavit. 7Arkansas Department of Finance and Administration. Affidavit of Reconstruction of Salvage Motor Vehicle Rebuilders working on flood vehicles should expect substantially more paperwork than on a collision rebuild.
VIN Inspection
Before a rebuilt title issues, the Arkansas State Police or a designated law enforcement agency inspects the vehicle to verify the VIN and confirm the vehicle is not stolen. This is an identity and theft check, not a mechanical safety inspection.
Filing the Rebuilt Title Application
Within ten working days of completing the rebuild, the owner or rebuilder submits the salvage title, the signed Affidavit of Reconstruction, a title application, and the required fees and taxes. 6Legal Information Institute. Arkansas Code R 006.05.07-007 – Rule 2007-8 Salvage, Rebuilt and Parts Only Vehicle The Office of Motor Vehicle then issues a new certificate with “REBUILT” printed in the remarks section.
If the rebuilder fails to give the Affidavit of Reconstruction to the owner, or the owner fails to surrender it to the state, the omission is a Class A misdemeanor. 7Arkansas Department of Finance and Administration. Affidavit of Reconstruction of Salvage Motor Vehicle
Parts-Only Titles
If a salvage vehicle has no resale value except as parts or scrap, the owner can request a parts-only title. The current certificate is surrendered and a new one issues bearing the notations “PARTS ONLY” and “Not for Registration.” 8Code of Arkansas Rules. 27 CAR 14-104 – Issuance of Parts-Only Titles and Title Notation An individual owner or an insurer that owns the vehicle can apply.
The brand is permanent. It carries forward on every title subsequently issued for the vehicle, regardless of any claim that it has been repaired. 2Justia Law. Arkansas Code Title 27 – Section 27-14-2302 – Issuance of Damage Certificate A parts-only vehicle cannot be registered for road use in Arkansas, and the same bar applies to vehicles declared junk or nonrepairable, or carrying a junking certificate from another state. 8Code of Arkansas Rules. 27 CAR 14-104 – Issuance of Parts-Only Titles and Title Notation There is no path back. Choose this designation only if you are certain the vehicle will never go back on the road.
Selling a Branded-Title Vehicle
Anyone selling a salvage, rebuilt, or parts-only vehicle in Arkansas has to disclose the brand in writing before the sale closes. Dealers and private sellers both use a buyer’s notification form prescribed by the Consumer Protection Division of the Attorney General’s office, which includes a description of the damage on file with the Office of Motor Vehicle.
Dealers must complete the form fully and attach it to a side window of the vehicle with “BUYER’S NOTIFICATION” facing outward. The form can be removed temporarily for a test drive and must be reattached immediately afterward. Non-dealer sellers who knowingly offer a branded-title vehicle must disclose the brand and provide the damage description to any prospective buyer before closing the transaction, using the same form. 9Justia Law. Arkansas Code Title 27 – Section 27-14-2303 – Disclosure Requirements
Both have to obtain the buyer’s acknowledgment signature on the form before the sale is complete. Without that signature, the buyer can void the entire transaction within 60 days. If the buyer voids, the seller has ten days to issue a full refund of the purchase price. A seller who refunds within that window is free of further liability; a seller who doesn’t is exposed to additional remedies. 9Justia Law. Arkansas Code Title 27 – Section 27-14-2303 – Disclosure Requirements
Insurance on a Rebuilt Vehicle
A rebuilt title gets you back on the road, but insuring the vehicle is a separate problem. Many insurers decline comprehensive or collision coverage on rebuilt vehicles because pre-existing damage is hard to separate from new damage after a future claim. Some will write liability only, which leaves the vehicle itself uncovered. Before committing to a rebuild, call your insurer, confirm what coverage is actually available, and shop around. Rebuilt-vehicle policies vary more between carriers than clean-title policies do, and the math on a rebuild shifts significantly if you end up carrying the physical damage risk yourself.
Penalties for Getting It Wrong
The documentation failure most likely to produce criminal exposure is skipping the Affidavit of Reconstruction. It is a Class A misdemeanor for the rebuilder to fail to deliver the affidavit or for the owner to fail to surrender it. 7Arkansas Department of Finance and Administration. Affidavit of Reconstruction of Salvage Motor Vehicle In Arkansas, a Class A misdemeanor carries up to one year in jail and a fine of up to $2,500.
Sellers who skip disclosure risk having the sale voided and refunding the full purchase price. 9Justia Law. Arkansas Code Title 27 – Section 27-14-2303 – Disclosure Requirements And a rebuilt vehicle with gaps in its paper trail becomes very hard to resell, because experienced buyers and dealers will walk away from incomplete documentation.
