Who Owes the Tax

Residents

Every Avon Lake resident age 18 or older who earns income must file a municipal return, no matter where that income was earned.2American Legal Publishing. You still need to file, and the credit described below handles the double-taxation problem.

Part-year residents also file. RITA’s Form 37 has a “Part-Year” residency checkbox, and you report only the income earned while you lived in the city.

Non-Residents Who Work in Avon Lake

If you work in Avon Lake but live elsewhere, the 1.5% applies to the income you earn there.2American Legal Publishing. Income That Is Not Taxed

Retired for the entire year with no W-2 wages, self-employment income, rental income, or gambling winnings? You can file a Declaration of Exemption with RITA rather than a full Form 37. The exemption can cover future years too, and you only resume filing if your income situation changes.

Credit for Taxes Paid to Another City

Avon Lake gives a 100% credit for municipal income taxes paid to another city, up to the local 1.5% rate.1American Legal Publishing. The math works like this:

  • Work city rate is 2.0%. You pay 2.0% to that city, Avon Lake credits its full 1.5%, and you owe nothing more to Avon Lake. Total: 2.0%.
  • Work city rate is 1.0%. You pay 1.0% to that city, Avon Lake credits 1.0%, and you owe the remaining 0.5% to Avon Lake. Total: 1.5%.

How to File Your Annual Return

Before you start, pull together your W-2s from every employer (showing local wages and any municipal tax withheld), any 1099-NEC or 1099-MISC forms for freelance or gig income, federal Schedule C if you’re self-employed, federal Schedule E for rental income, and pages 1 and 2 of your federal Form 1040. The 1040 is also required if you’re filing a Declaration of Exemption.

Deadline and Extensions

The annual return is due April 15. If you need more time to file, submit RITA Form 32 EST-EXT before that date. An extension gives you time to file, not time to pay. Penalties and Interest

RITA enforces two separate penalties, and both can hit the same return. An underpayment penalty of 15% applies to any tax not paid by the due date, whether the shortfall comes from the annual return or missed estimated payments.7Regional Income Tax Agency.
