The sales tax in Baton Rouge is 10.50% on most purchases, made up of a 5.00% Louisiana state tax and a 5.50% local tax collected by East Baton Rouge Parish. That combined rate took effect January 1, 2025, after Louisiana’s 2024 tax reform, so older charts showing 9.45% or 9.95% are out of date.
How the 10.50% Breaks Down
The state portion of 5.00% replaced the previous 4.45% rate under Act 10 of the 2024 Third Extraordinary Legislative Session, which also broadened the tax base to include digital products.1Louisiana Sales and Use Tax Commission for Remote Sellers. Announcements It is authorized primarily under La. R.S. 47:302.2Justia. Louisiana Code 47:302 – Imposition of Tax
The 5.50% local share is split four ways:
- Parish tax: 2.00%
- City tax: 1.50%
- Street and sewer tax: 1.00%
- School board tax: 1.00%
Together those four pieces produce the 5.50% local rate, and combined with the state tax, the 10.50% total on most Baton Rouge receipts.3City of Baton Rouge / Parish of East Baton Rouge. Sales and Use Tax Rates Effective January 1, 2025
Rates can shift elsewhere in the parish. Baker, Central, and Zachary have their own municipal taxing authorities and carry slightly different local rates, and Economic Development Districts can tack on another percentage point in limited areas. For any large purchase, check the rate for the exact address.
What Gets Taxed at the Full Rate
The 10.50% rate applies to most tangible personal property sold or leased in Baton Rouge: clothing, electronics, furniture, household goods, and the like. Louisiana generally does not tax services, but there are exceptions. Telecommunications services, fabrication labor, and the printing of tangible materials all carry the full sales tax. Hotel room rentals are taxed at the standard rate and face an additional 6% occupancy tax, bringing the total on a Baton Rouge hotel stay to about 16.50%.
Digital Products
Since January 1, 2025, Louisiana’s sales tax base covers digital products. Downloads, streaming content, e-books, digital music, and similar items are taxable at both the state and local level.4Louisiana Department of Revenue. Prepared Food
Food sold by restaurants, delis, and fast-food outlets is taxed at the full 10.50% because it does not qualify as food for home consumption.
What’s Exempt or Reduced
Groceries
Groceries bought for home consumption are exempt from the 5.00% state sales tax. They are not fully exempt locally. The 1.00% street and sewer portion drops off, but the parish, city, and school board pieces still apply.3City of Baton Rouge / Parish of East Baton Rouge. Prescriptions and Medical Devices
Prescription drugs and prescription insulin have long been exempt from the state sales tax. Beginning August 1, 2025, House Bill 606 extended that exemption to local sales taxes as well, so prescription medications in Baton Rouge should now carry no sales tax at either level.5Louisiana State Legislature. Purchases for Resale
Items bought strictly for resale are not taxed at the point of purchase, provided the buyer presents a valid Louisiana resale certificate. Certificates are issued through the Louisiana Taxpayer Access Point (LaTAP), are valid for one year, and must be renewed annually.7Louisiana Department of Revenue. Resale Certificate Using a resale certificate to buy items your business actually consumes rather than resells is a fast route to an audit and back-tax assessment.
Buying Online: Consumer Use Tax
If you buy something online or out of state and the seller does not charge Louisiana sales tax, you owe consumer use tax on the purchase. This most often comes up with small out-of-state retailers that fall below the remote seller registration threshold.
Louisiana uses a flat combined consumer use tax rate of 9.00%, split 5.00% to the state and 4.00% to local jurisdictions. That rate applies regardless of whether your local rate is actually higher or lower. You can report it on your Louisiana individual income tax return (Form IT-540) or separately on Form R-1035. For purchases made during 2025, the deadline to pay is May 15, 2026.8Louisiana Department of Revenue. Louisiana Consumer Use Tax Nonpayment draws the same penalty and interest as any other delinquent Louisiana tax.
If You’re Collecting the Tax
Registering
Any business selling taxable goods or services in Baton Rouge must register with both the state and the parish before its first sale. State registration uses Form R-16019, the Application for Louisiana Revenue Account Number, filed with the Louisiana Department of Revenue.9Louisiana Department of Revenue. Application for Louisiana Revenue Account Number You also register locally with the City of Baton Rouge Department of Finance, Revenue Division.
Your physical address determines which local rate applies, and that matters: a storefront a few blocks outside Baton Rouge city limits may fall under a different column on the parish rate schedule.
Filing and Deadlines
East Baton Rouge Parish requires sales tax returns to be filed online through the Parish E-File system; paper filing was phased out beginning April 2020 under Act 536 of the 2014 Legislative Session.10Louisiana Association of Tax Administrators. East Baton Rouge Parish State returns are filed separately through the Louisiana Department of Revenue’s online portal.
Both state and local returns are due on the 20th of the month after the collection period. If the 20th lands on a weekend or holiday, the deadline moves to the next business day.11City of Baton Rouge. Online Sales Tax Payments Most businesses file monthly; the Department of Revenue may assign quarterly or annual schedules to lower-volume sellers.
Late Penalties and Interest
A late return triggers a 5% penalty on the unpaid tax for the first 30 days of delinquency, plus another 5% for each additional 30-day period, capped at 25% of the tax owed.12Louisiana State Legislature. Louisiana Revised Statutes Title 47 – Penalties for Delinquent Returns On a $10,000 tax bill, that cap still means an extra $2,500.
Interest runs on top of the penalty. For 2026, the delinquent tax interest rate is 10.50% per year.13Louisiana Department of Revenue. Interest Rate Schedule 2026 The rate is set annually at three percentage points above the judicial interest rate under La. R.S. 9:3500, with a maximum of 1.25% per month.14Louisiana State Legislature. Louisiana Revised Statutes 47:1601 – Interest on Delinquent Taxes Interest has no cap. Filing late also forfeits your vendor compensation for that period.
Vendor Compensation
Louisiana lets businesses keep a small percentage of the sales tax they collect to offset administrative costs. The statutory rate is 1.05%, but because the 2024 reform added a new levy under R.S. 47:321.1 that does not qualify for vendor compensation, the effective rate dropped to 0.84% of total state tax collected starting January 1, 2025.15Louisiana Department of Revenue. What Is the State’s Vendor’s Compensation Deduction Rate? On a monthly remittance of $5,000 in state tax, that’s about $42 you keep. It disappears if you file late.
Selling Into Baton Rouge From Out of State
Out-of-state businesses must register to collect and remit Louisiana sales tax once they cross either of two thresholds in the current or previous calendar year: $100,000 in gross revenue from sales delivered into Louisiana, or 200 or more separate transactions delivered into the state.16Louisiana Sales and Use Tax Commission for Remote Sellers. Frequently Asked Questions Either trigger is enough on its own. Remote sellers register through the Louisiana Sales and Use Tax Commission for Remote Sellers, which handles both state and local filing from one point.
Marketplace facilitators like Amazon and Etsy generally collect and remit on behalf of their third-party sellers. If you also sell through your own website or at pop-ups in Baton Rouge, you remain responsible for the tax on those direct sales.
