The Berkeley noise ordinance, codified in Municipal Code Chapter 13.40, sets maximum decibel levels for every zoning district, restricts construction and other loud activities by time of day, and bans gas-powered leaf blowers across the entire city.1Berkeley Municipal Code. Berkeley Municipal Code 13.40 – Community Noise The rules apply to everyone inside city limits, including homeowners, renters, businesses, and contractors, and violations can be charged as either infractions or misdemeanors.
Decibel Limits by Zone and Time
Section 13.40.050 sets maximum exterior sound levels measured at the property line of the affected neighbor. The ceiling depends on where that neighbor lives and the time of day:
- Low-density residential (R-1, R-2, R-1A, R-2A, ESR): 55 dBA from 7:00 a.m. to 10:00 p.m., 45 dBA from 10:00 p.m. to 7:00 a.m.
- Higher-density residential (R-3 and above): 60 dBA daytime, 55 dBA nighttime.
- Commercial zones: 65 dBA daytime, 60 dBA nighttime.
- Industrial zones: 70 dBA at all hours.
A single loud moment is not an automatic violation. The sound has to exceed the listed limit for more than 30 cumulative minutes in any hour. And if ambient noise in your area already runs above the posted level, the ambient reading becomes the standard instead.
Noise Between Apartment Units
Section 13.40.060 covers sound passing between units in multi-family housing, measured inside the neighboring unit with windows in their normal seasonal position. The interior ceilings are 45 dBA during the day (7:00 a.m. to 10:00 p.m.) and 40 dBA at night (10:00 p.m. to 7:00 a.m.).
Duration matters here too, and the rule tightens as the volume climbs. Sound up to 5 dBA over the limit is allowed for no more than one cumulative minute per hour. Sound 10 dBA or more over the limit is not permitted for any duration. Shared-wall setups with subwoofers, home theaters, or late-night stereo use are the usual trigger.
When Construction Noise Is Allowed
Construction, drilling, repair, alteration, and demolition work that crosses a residential or commercial property line and breaks the decibel limits is confined to set hours under Section 13.40.070: 7:00 a.m. to 7:00 p.m. on weekdays, and 9:00 a.m. to 8:00 p.m. on weekends and holidays.2City of Berkeley. Berkeley Municipal Code 13.40.070 – Prohibited Acts Emergency utility work is the lone exception. If a crew runs loud equipment at 6:30 a.m. and a sound measurement confirms the limit is breached across a property line, that is a violation on the spot.
The Gas-Powered Leaf Blower Ban
Gas-powered leaf blowers are illegal everywhere in Berkeley. The ban covers any portable gasoline-engine machine used to blow leaves, dirt, or debris off any surface, and it applies to city employees, residents, and professional landscapers alike.2City of Berkeley. Berkeley Municipal Code 13.40.070 – Prohibited Acts No warning is required before a citation. Running one is an automatic violation. Retailers selling gas-powered blowers inside the city have to post notice of the prohibition.3City of Berkeley. Noise Standards
Barking Dogs and Other Prohibited Activities
Keeping an animal that makes repeated or prolonged noise violates the ordinance when the sound annoys at least two reasonable people living in separate residences. Persistent barking that bothers more than one neighbor qualifies, whether or not the owner is home. One warning has to be issued before a citation.2City of Berkeley. Berkeley Municipal Code 13.40.070 – Prohibited Acts
Section 13.40.070 also addresses several other sources:
- Amplified sound from loudspeakers or PA systems that exceeds the exterior or interior limits without a permit.
- Loud or raucous yelling, shouting, or whistling, enforceable after a single ignored warning.
- Loading or unloading boxes, crates, and building materials between 10:00 p.m. and 7:00 a.m. when the sound crosses a residential property line above the limits.
- Equipment vibration that annoys at least two people in separate residences at the property boundary.
- Power tools exceeding the decibel limits across a property line, after a warning and a sound measurement.
What the Ordinance Does Not Cover
Section 13.40.080 carves out several exemptions. Sounds alerting people to an emergency, and noise produced during emergency work, are fully exempt. Police sirens, fire truck horns, ambulance sirens, and train horns are exempt. Noncommercial, non-amplified public speaking and assembly on public property or rights-of-way falls outside the ordinance entirely. And a valid sound permit or variance overrides the standard limits for the activity it covers.
Sound Permits and Variances
If an event or project needs to exceed the normal decibel limits or run outside permitted hours, the city offers two routes through the Environmental Health Division.
Amplified Sound Permits
Anyone using loudspeakers, PA systems, or similar amplification outdoors has to get a permit from the Noise Control Officer in advance.3City of Berkeley. Noise Standards The same applies to indoor amplified sound that would break the interior limits. The officer can attach conditions like volume caps, time limits, and neighbor notification.
Submit the Sound Permit Application Form to envhealth@berkeleyca.gov at least 30 days before the event.4City of Berkeley. Application for an Amplified Sound Permit or Variance Only The form asks for contact details, the location, a description of the equipment, and the specific dates and times. The 30-day lead is firm. Plan ahead for block parties, outdoor concerts, or any event with speakers.
Variances
A variance is broader. It can excuse compliance with any provision of the ordinance, not only the amplified sound rules. The Noise Control Officer can grant one if the proposed noise will not endanger public health, safety, or welfare and if strict compliance would create an unreasonable hardship without an equal or greater public benefit. After-hours construction tied to a genuine scheduling constraint is the common use case. Variance requests go through the same Environmental Health Division contact.
How to Report a Violation
The right place to call depends on the type of noise.
For something happening right now, like a loud party, late-night amplified music, or construction outside the permitted hours, call the Berkeley Police Department’s non-emergency line. Officers can respond, observe the noise, and start the warning-and-measurement process on the scene.5Office of the Chancellor. Happy Neighbors
For ongoing problems from fixed sources, like a commercial HVAC unit, an industrial fan, or a compressor, contact the Environmental Health Division at (510) 981-5310 or envhealth@berkeleyca.gov.3City of Berkeley. Noise Standards Complaints can also go through the city’s online portal. Include the address of the source, the times the noise happens, and how long it lasts. A written log of dates, times, and descriptions strengthens any investigation that follows.
What Enforcement Looks Like
Most complaints start with a verbal warning from a Noise Control Officer or responding police officer. If the noise continues after the warning, or starts again within eight hours, it becomes a citable violation.6Berkeley Municipal Code. Berkeley Municipal Code 13.40.030 – General Noise Regulations Certain categories, including amplified sound, construction noise, and power tools, also require a decibel measurement confirming the breach before a citation can issue.
Two situations skip the warning step entirely: running a gas-powered leaf blower, and tampering with noise-monitoring equipment. Either one is a violation the moment it happens.
Once charged, a noise violation can be prosecuted as a misdemeanor or an infraction. The city can also treat an ongoing violation as a public nuisance and pursue abatement, which can force a noise source to stop. That matters most for businesses or property owners with permanent equipment generating the problem, because the consequences reach beyond any single fine.
