Brandon Broderick Lawsuit: Whistleblower, Billing, and NJ Bar Admonition

Brandon J. Broderick, the New Jersey personal injury attorney whose namesake firm has grown to more than 50 lawyers across multiple states, and his firm have been the subject of three notable legal matters in recent years: a 2024 whistleblower lawsuit by a former paralegal that was voluntarily dismissed in 2025, a separate 2024 wrongful-termination suit by a former billing manager, and a 2025 disciplinary admonition from the New Jersey Disciplinary Review Board over threatening messages Broderick sent to a chiropractor.

Former Paralegal’s Whistleblower Suit

A former paralegal filed a whistleblower lawsuit against Brandon J. Broderick LLC in New Jersey state court on April 8, 2024. He alleged the firm created an uncomfortable workplace after he reported what he described as ethical violations to management.1Law360. Ex-Paralegal Launches Whistleblower Suit Against NJ Firm

The case never reached a decision on the merits. The paralegal dropped it through a stipulation of dismissal on April 30, 2025.2Law360. Former Paralegal Ends Whistleblower Suit Against NJ Firm Public records don’t confirm whether a private settlement preceded the dismissal.

Former Billing Manager’s Suit

About two months earlier, on February 8, 2024, a former billing manager sued the firm in New Jersey state court. She alleged she was fired for insisting that clients receive the maximum amount possible from their settlements, and claimed the firm prioritized its own fees over client interests.3Law360. New Jersey Bar Admonition

Separate from the employment cases, Broderick himself was disciplined by the New Jersey bar in 2025. The matter grew out of a March 2022 settlement in which Broderick’s firm resolved a client’s motorcycle accident case for $15,000. When the firm disbursed payments to medical providers, an administrative error sent a check meant for chiropractor Robert Monahan to the wrong payee.4NJ Courts. On May 24 and 25, 2022, that error led to a hostile exchange of text messages and a phone call. Broderick used profanity, made derogatory statements, and, according to the grievance, threatened to “smash his head with a baseball bat.” Monahan filed an ethics grievance, and the matter reached the Disciplinary Review Board of the Supreme Court of New Jersey as DRB 25-174.4NJ Courts. Charges

Broderick faced three charges under the New Jersey Rules of Professional Conduct:

  • RPC 3.2, failing to treat all persons involved in the litigation process with courtesy and consideration.
  • RPC 8.4(b), committing a criminal act (alleged harassment under N.J.S.A. 2C:33-4) that reflects adversely on a lawyer’s fitness.
  • RPC 8.4(d), engaging in conduct prejudicial to the administration of justice.

Outcome and Sanction

On September 23, 2025, the Board found Broderick guilty only of the RPC 3.2 violation. It dismissed the RPC 8.4(b) and RPC 8.4(d) charges, concluding the evidence did not establish an intent to harass or that the conduct had compromised the administration of justice.4NJ Courts. The sanction was an admonition, the lowest form of formal discipline in New Jersey. The Board cited several mitigating factors: Broderick’s 19 years of practice without prior discipline, his apology to Monahan, the two men’s preexisting working relationship, and the firm’s correction of the payment error. Broderick was also ordered to pay the costs of the proceedings. The admonition was filed with the Clerk of the Supreme Court and will be considered if any future disciplinary matter arises.4NJ Courts. In the Matter of Brandon James Broderick, DRB 25-174
