Broward Property Tax Appeals: VAB Petition, Evidence, and Hearing

To file a Broward property tax appeal, submit Form DR-486 to the Value Adjustment Board within 25 days of the date your TRIM notice was mailed, pay the $15 fee, exchange evidence with the Property Appraiser at least 15 days before your hearing, and present your case to a special magistrate. The deadline is rigid, the burden of proof is on you, and the evidence you bring decides the outcome.

Try an Informal Conference First

Before filing anything formal, you have the right to request a face-to-face meeting with the Broward County Property Appraiser’s office. You present the facts you believe support a lower value, and the appraiser’s representative explains how they arrived at theirs.1Florida House of Representatives. Florida Code 194 – Administrative and Judicial Review of Property Taxes The conference is not a prerequisite for a VAB petition, so you lose nothing by trying.

If the appraiser agrees your property is overvalued, the adjustment happens without a hearing. If not, the formal petition process is still open to you, and the comparable sales, photos, or other materials you prepared carry straight over. Treat it as a low-cost first attempt and still watch the 25-day petition clock, because an informal conversation does not pause it.

What You Can Actually Challenge

Most appeals rest on one of three arguments. Pick the one that fits your situation before you draft anything, because the petition form has a separate checkbox for each.

The Value Is Too High

Florida defines “just value” as the price a willing buyer would pay a willing seller in an arm’s-length transaction. The appraiser must weigh factors including present cash value, highest and best use, condition, and income the property generates.2Florida Legislature. Florida Code 193.011 – Factors to Consider in Deriving Just Valuation If the assessed figure exceeds what the market would support on January 1 of the tax year, you have grounds.

Your Assessment Is Out of Line with Neighbors

Even when your assessed value matches market value, you may still have a case if comparable properties nearby are assessed at a lower ratio of assessed to market value. The Florida Constitution requires uniformity within each property class, so your assessment should not be disproportionately high compared to similar homes on your street or in your subdivision. You build this case by pulling assessment data for comparable properties and showing a pattern.

An Exemption or Classification Was Denied

If the appraiser denied your homestead, veterans’, or senior exemption, you can appeal that denial to the VAB.3Florida Dept. of Revenue. Property Tax – Taxpayers – Property Value Disagree The same route is open for a denied agricultural classification; landowners receive written notice of denial by July 1 that must inform them of the right to appeal.4Florida Legislature. Florida Code 193.461 – Agricultural Lands Classification and Assessment

One more check if your property has a homestead exemption: Save Our Homes caps your annual assessed-value increase at 3% or the change in the Consumer Price Index, whichever is lower.5Florida Senate. Florida Code 193.155 – Homestead Assessments An assessed-value jump above that limit from the prior year is itself grounds for a petition.

Filing the Petition and Meeting the Deadline

The formal appeal begins with Form DR-486, the Petition to the Value Adjustment Board.6Florida Department of Revenue. DR-486 – Petition to the Value Adjustment Board The form asks you to select the type of challenge and enter your parcel identification number. In Broward County that is a 12-digit number shown on your TRIM notice and tax bill.7Broward County Official Records. Tips for Searching the Tracking Log Get it right; a wrong parcel ID can derail the petition.

The 25-Day Deadline

You must file within 25 days of the date the TRIM notice was mailed.8Florida House of Representatives. Florida Code 194.011 – Assessment Notice and Objections to Assessments In Broward County, the 2025 filing window ran from August 18 through September 17.9Broward County. Value Adjustment Board Petition Filing Expect similar timing in 2026. Once the window closes you have no administrative remedy until the following tax year.

The $15 Fee

Each petition carries a non-refundable $15 filing fee, payable by cash, check, or money order at the VAB office.10Broward County Value Adjustment Board. Value Adjustment Board Frequently Asked Questions Credit cards are accepted with a convenience fee. If your petition challenges a homestead exemption denial that was timely filed, the fee is typically waived.

How to Submit

Broward accepts petitions online through its VAB portal. After submitting electronically, you receive a transaction number and password to track the petition.9Broward County. Value Adjustment Board Petition Filing Petitions involving exemptions, portability, or multiple or contiguous parcels cannot be filed online and must be submitted in person at 115 S. Andrews Avenue, Room 120, Fort Lauderdale.

If you file by mail, use certified mail with return receipt. The postmark controls whether you met the deadline, and certified mail gives you proof. Keep copies of everything.

Evidence That Actually Wins

The appraiser’s number carries a legal presumption of correctness, so the burden sits on you to prove it is wrong.11Florida Legislature. Florida Code 194.301 – Challenge of Assessment Vague complaints about high taxes will not clear that bar. Documented facts will.

Comparable Sales

For residential appeals, the strongest evidence is a set of comparable sales that closed before January 1 of the tax year. Look for properties similar to yours in size, age, condition, and location that sold for less than your assessed value. The Broward County Property Appraiser’s website lets you search recent sales by neighborhood. Three to five strong comparables tell a clearer story than a dozen weak ones. For each, note sale price, sale date, square footage, lot size, and any differences from your property that would affect value.

Photographs of deferred maintenance, storm damage, or foundation issues help, especially when the comparable that sold for more had features your property lacks. If your roof is 25 years old and the comparable had a new one, the picture makes that difference tangible for the magistrate.

Income Data for Commercial Properties

Commercial owners typically challenge assessments using the income capitalization approach, dividing net operating income by an appropriate capitalization rate. A credible submission requires actual rent rolls, vacancy data, and detailed operating expenses, ideally two to four years of expense history to support a stabilized figure. Capitalization rates should come from recent comparable sales in the Broward market.

A Professional Appraisal

Hiring a licensed appraiser is not required, but it strengthens the case for high-value or complex properties. Any appraisal you submit must comply with the Uniform Standards of Professional Appraisal Practice, and the valuation date should match January 1 of the tax year. An appraisal dated six months later reflects a different market and will carry less weight.

The 15-Day Evidence Exchange

Once your hearing is scheduled, both sides must share evidence at least 15 days before the hearing date. You give the appraiser a list of your evidence, copies of all documents, and a summary of any witness testimony. The appraiser does the same, including the property record card.12Florida Legislature. Florida Code 194.011 – Assessment Notice and Objections to Assessments This is not optional, and if the appraiser fails to comply, the hearing gets rescheduled.

Use the exchange window to study the appraiser’s comparables and look for weaknesses in their methodology. That is where your arguments at the hearing should focus.

What Happens at the Hearing

A special magistrate presides. Magistrates hearing value disputes must be state-certified appraisers; those hearing exemption or classification issues must be Florida Bar members with ad valorem tax experience.13Florida Legislature. Florida Code 194.035 – Special Magistrates They cannot be county employees.

You present your evidence first: comparables, appraisal, photos, income data. The appraiser’s office then presents its justification. The magistrate may ask questions of both sides. You do not need to prove bad faith. You need to prove the number is wrong, with evidence that it does not comply with the statutory valuation factors or accepted appraisal practice.11Florida Legislature. Florida Code 194.301 – Challenge of Assessment

After the hearing, the magistrate sends findings of fact and conclusions of law to the full Value Adjustment Board, which can accept the recommendation without another hearing. A reduction then flows through to the tax collector and reduces your final bill.

If You Lose

A VAB decision is not the end. Any taxpayer who disagrees with the board’s ruling can appeal to circuit court.14Florida Senate. Florida Code 194.036 – Appeals Circuit court is a significant step up in cost and complexity. You will likely need an attorney, the case proceeds through the court system, and the court can take additional evidence. For most residential homeowners, the cost of litigation exceeds the potential tax savings unless the value at stake is substantial. For commercial owners with six- or seven-figure assessments, it is a routine next step.

After a Win: Escrow and Federal Taxes

If you pay property taxes through a mortgage escrow account, a successful appeal does not automatically put money back in your pocket. The reduced tax bill lowers what your servicer owes the county, which creates an escrow surplus. Under federal rules, your servicer must run an annual escrow analysis and notify you of any surplus within 30 days. If the surplus is $50 or more, the servicer must refund it within 30 days. Smaller surpluses may be credited toward next year’s payments.15eCFR. 12 CFR 1024.17 – Escrow Accounts If the annual analysis already ran before the new assessment posted, call the servicer and request an early re-analysis. Not all will accommodate it, but many do. Your monthly payment should drop going forward either way.

A refund can also affect your federal return. If you itemized property taxes in a prior year and later receive a refund or credit for that year, the IRS tax benefit rule may require you to report part or all of it as income.16Internal Revenue Service. Publication 525 – Taxable and Nontaxable Income If the refund covers the same year you paid, you simply reduce the deduction by the refund amount instead. If you did not itemize in the year you paid, the refund is not taxable. Publication 525 includes a worksheet for calculating the exact amount. The federal SALT deduction is capped at $40,400 for the 2026 tax year ($20,200 for married filing separately), so if your total state and local taxes already exceeded the cap, the refund may not change your federal liability at all.
