California-legal 10mm handguns do exist, and owning one is lawful. The state does not ban any caliber, and several 10mm models from Glock, Colt, and European American Armory currently appear on California’s approved handgun list.1State of California – Department of Justice – Office of the Attorney General. Approved Safety Devices What catches buyers off guard is not the caliber itself. It is the roster that limits which specific models dealers can sell new, the ten-round magazine cap, and the paperwork around buying both the gun and the ammunition.
Which 10mm Models You Can Actually Buy
California keeps an official Roster of Certified Handguns, maintained by the Department of Justice under Penal Code § 32015. Only models that have passed drop and firing tests and been judged “not unsafe” can be sold new at retail.2California Legislative Information. California Penal Code 32015 – Roster of Certified Handguns3California Legislative Information. California Penal Code 31910 – Unsafe Handgun Definitions
As of the most recent roster data, roughly 15 to 20 10mm models remain listed, almost all of them older Glock, Colt, and EAA designs grandfathered on years ago.1State of California – Department of Justice – Office of the Attorney General. Approved Safety Devices You can walk into a California gun shop and buy a new 10mm. The selection is just narrow. Newer centerfire semiautomatic designs face three feature requirements, including microstamping, that essentially no manufacturer has implemented, so the roster shrinks each year as companies decline to renew older models.3California Legislative Information. California Penal Code 31910 – Unsafe Handgun Definitions If a specific 10mm model is on your list, verify it is still rostered before you make the drive to the dealer.
The Ten-Round Magazine Cap
California defines a large-capacity magazine as any feeding device that accepts more than ten rounds, and almost all forms of ownership are prohibited.4California Legislative Information. California Penal Code 16740 – Large-Capacity Magazine Definition5California Legislative Information. California Penal Code 32310 – Large-Capacity Magazine This matters directly to 10mm owners because the full-size platforms popular elsewhere, like the Glock 20, normally ship with 15-round magazines. In California, every magazine you receive with the gun must be capped at ten rounds.
Possessing a large-capacity magazine can be charged as an infraction with a $100 fine per magazine or as a misdemeanor carrying up to a year in jail and a $100 fine per magazine. Selling or importing one carries steeper exposure, up to a year in county jail or a state prison term.5California Legislative Information. California Penal Code 32310 – Large-Capacity Magazine Before you leave the counter, open the box and confirm every magazine inside holds no more than ten.
How to Buy a 10mm from a Dealer
You need a valid Firearm Safety Certificate first. The FSC comes from passing a written test given by a DOJ-certified instructor, costs $25, and lasts five years.6California Legislative Information. California Penal Code 31615 – Firearm Safety Certificate Requirement Most gun shops administer the test on site.
With the FSC in hand, the dealer runs you through the Dealer’s Record of Sale process. The state fee totals $37.19.7State of California – Department of Justice – Office of the Attorney General. Frequently Asked Questions California then imposes a mandatory ten-day waiting period before the dealer can release the firearm, with no exceptions and no way to shorten it.8California Legislative Information. California Penal Code 27540 – Waiting Period
One more constraint: you can only buy one firearm every 30 days. This originally covered just handguns but now extends to all firearms, including rifles and shotguns.7State of California – Department of Justice – Office of the Attorney General. Frequently Asked Questions A rifle purchase two weeks ago means your 10mm has to wait.
Getting a 10mm That Isn’t on the Roster
The roster governs what dealers can sell new. It does not stop you from owning off-roster models acquired through other legal channels.
Private Party Transfers
A California resident who already owns an off-roster 10mm can sell it to another California resident. The transaction has to run through a licensed dealer with both parties present. The dealer may charge up to $10 per firearm for handling the transfer, on top of the $37.19 DROS fee, and the ten-day waiting period and background check still apply.7State of California – Department of Justice – Office of the Attorney General. Frequently Asked Questions Off-roster 10mm handguns often sell at a premium because supply is limited and demand for newer designs is strong.
Intrafamilial Transfers
California permits firearm transfers between parents, children, and grandparents without the handgun appearing on the roster. Out-of-state family members in those categories count. The recipient must hold a valid FSC and file Form BOF 4544A with the DOJ within 30 days, with a $19 processing fee.9California Department of Justice. Report of Operation of Law or Intra-Familial Firearm Transaction The DOJ then runs an eligibility check. Siblings, aunts, uncles, and cousins do not qualify and would need to use a private party transfer.
Buying 10mm Ammunition
Ammunition sales in California run through licensed vendors in face-to-face transactions.10California Legislative Information. California Penal Code 30312 – Sale of Ammunition Through Licensed Vendor You can order 10mm online, but it has to ship to a California-licensed vendor who processes the handoff in person.
At the counter, the vendor runs a background check. If you have a firearm registered to you in the state’s Automated Firearms System, the check normally clears instantly and costs $1. Without a record in that system, you face a more thorough eligibility check that costs $19 and can take several business days.11California Legislative Information. California Penal Code 30370 – Ammunition Purchase Authorizations First-time buyers and anyone whose firearms predate the registration system should expect the longer process.
Transporting and Storing Your 10mm
In a vehicle, the handgun must be unloaded and inside a locked container. A trunk qualifies. A glove compartment or center console does not.12State of California – Department of Justice – Office of the Attorney General. Transporting Firearms in California A hard-sided pistol case with a padlock, key lock, or combination lock meets the definition; a soft zippered case does not. The gun has to stay locked in that container while you move it between vehicle and destination. Walking across a parking lot with a 10mm in a holster, even unloaded, is unlawful unless you hold a valid CCW.
At home, California attaches criminal liability to storing a firearm where a child could get to it, with three tiers:
- First-degree criminal storage applies when a child accesses the firearm and causes death or serious injury. It is a wobbler, chargeable as a misdemeanor (up to one year in county jail, up to $1,000) or a felony (16 months, two years, or three years in state prison, up to $10,000).
- Second-degree criminal storage applies when a child takes the firearm to a public place or brandishes it. Misdemeanor, up to one year in jail, up to $1,000.
- Third-degree criminal storage applies when you negligently store a firearm where you know a child could access it, regardless of outcome. Misdemeanor.13California Legislative Information. California Penal Code 25100-25110 – Criminal Storage of Firearm
A California-approved locking device or DOJ-approved lock box takes you out of this exposure. Dealers are required to provide or sell you an approved device at the time of purchase.14State of California – Department of Justice – Office of the Attorney General. Handguns Certified for Sale
Carrying a 10mm in Public
Loaded concealed carry of a 10mm in public requires a Concealed Carry Weapon license from your county sheriff or local police chief. California does not restrict calibers for concealed carry, so a 10mm qualifies as long as it is listed on your permit. Applicants must be at least 21, show good moral character, complete a state-mandated training course, and apply to the local issuing authority. Fees and processing times vary by county, and the background investigation can run several months.
Senate Bill 2 attempted to ban concealed carry in a long list of sensitive places, including parks, public transit, libraries, and places of worship. Federal courts have partially blocked enforcement, with some restrictions upheld and others enjoined, and the litigation continues through the Ninth Circuit. If you hold a CCW, check the current status of these injunctions before relying on your permit at any specific public location.
Using a 10mm for Self-Defense
Inside your home, Penal Code § 198.5 gives you a legal presumption that you acted out of reasonable fear when an intruder unlawfully and forcibly enters, and you knew or had reason to believe the entry was unlawful. The law presumes you feared imminent death or serious injury to yourself or your household.15California Legislative Information. California Penal Code 198.5 – Presumption of Fear in Residence That presumption works strongly in a homeowner’s favor in a clear home-invasion scenario.
Outside the home, the test is different. Deadly force is justified only when you reasonably believe you face an imminent threat of death or great bodily harm, and your response must be proportional. California has no stand-your-ground statute, so prosecutors and juries will consider whether you had a reasonable opportunity to retreat. The 10mm’s power is not part of the analysis. The threat and the reasonableness of your response are.
Hunting with a 10mm
The 10mm is a common handgun choice for wild boar and other medium game, and California permits handgun hunting for many species. The rule that bites hunters here is the statewide non-lead ammunition requirement. Since July 1, 2019, any ammunition used to take wildlife anywhere in California must be non-lead, defined as containing one percent lead or less by weight, on both public and private land.16California Department of Fish and Wildlife. Nonlead Ammunition in California
Certified non-lead 10mm loads are available from Barnes, Federal, Hornady, Lehigh Defense, and others.17California Department of Fish and Wildlife. Certified Nonlead Ammunition They tend to cost more than standard jacketed hollow points, and your local shop may not stock them, so plan ahead.
Wildlife officers can inspect any ammunition you have while hunting. If you are carrying a 10mm capable of firing lead, you cannot also have lead 10mm rounds on you, with one exception: ammunition in a concealed handgun carried for personal protection is exempt from the possession ban.16California Department of Fish and Wildlife. Nonlead Ammunition in California Keep hunting ammunition and carry ammunition clearly separated to avoid any confusion in the field.
