CA Legal .22 LR Pistols: Roster, Features, and Purchase Steps

California-legal .22 LR pistols do exist, but the selection is narrow and the buying process is slow. You must be at least 21, hold a Firearm Safety Certificate, buy through a licensed dealer, pass a background check, and wait ten days before taking the pistol home. The model you want almost certainly needs to be on California’s Roster of Certified Handguns, which rules out most modern rimfire pistols sold freely in other states. If it’s not on the roster, your realistic path is a private party transfer from someone who already owns one in California.

Who Can Buy a Handgun in California

The minimum age is 21 for any handgun purchase, dealer or private. Federal law sets the same floor for dealer sales, so there is no younger route.

Federal law also bars several categories of people from possessing any firearm: felony convictions, domestic violence misdemeanor convictions, active restraining orders involving an intimate partner or child, unlawful use of controlled substances, involuntary commitment to a mental institution, and fugitive status.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons California mirrors most of these and adds its own disqualifiers. The background check run during purchase screens for all of them.

Why the Handgun Roster Matters for .22 LR

Under Penal Code section 32000, a licensed dealer cannot sell a new handgun unless that specific model has passed state safety testing and been certified by the Department of Justice.2California Department of Justice – Office of the Attorney General. Handguns Certified for Sale Testing covers drop safety and basic firing reliability.3California Legislative Information. California Code Penal Code PEN 32000 – Unsafe Handguns Manufacturers pay annual fees to keep each model listed, and a lapse pulls the model.

The design requirements in Penal Code section 31910 are what thin the .22 LR shelf. A semi-automatic pistol with a detachable magazine still needs a magazine disconnect mechanism, and centerfire models additionally need a chamber load indicator.4California Legislative Information. California Code PEN 31910 – Unsafe Handgun Many rimfire pistol designs were never built with a magazine disconnect, so those models can’t make the roster. California’s microstamping requirement was removed by SB 452 in September 2023, which reopened the door for new submissions, but the magazine disconnect rule still filters out most popular .22 LR designs.5State of California – Department of Justice – Office of the Attorney General. Senate Bill (SB) 452 Microstamping The result: dealer selection skews toward older models certified years ago.

You can check whether a specific .22 LR model is currently rostered through the DOJ’s online search tool before you make the trip.

Getting an Off-Roster .22 LR Pistol

The roster only restricts new sales by dealers. Two legal paths bring unlisted models into civilian hands.

Private Party Transfers

If another California resident already owns the off-roster .22 LR you want, they can sell it to you. The transfer still runs through a licensed dealer, both parties need valid ID, and the background check and ten-day wait still apply. The pistol does not need to be on the roster because it is being transferred as a used firearm already in state.6California Legislative Information. California Code Penal Code PEN 32110 – Exemptions From Handgun Testing and Certification Requirements Off-roster pistols routinely sell at a premium through this channel, sometimes well above their out-of-state retail price.

Intrafamilial Transfers

Under Penal Code section 27875, a parent, grandparent, child, or grandchild can give you a handgun without going through a dealer, bypassing the roster. The transfer must be infrequent and both parties must be California residents. You report the transfer to the DOJ within 30 days and pay a $19 processing fee.7California Department of Justice. Report of Operation of Law or Intra-Familial Firearm Transaction

If the family member lives out of state, the exception narrows sharply. The interstate provision of the same statute covers only firearms received through inheritance, not gifts from a living relative.8California Legislative Information. California Code Penal Code PEN 27875 – Transfer of Firearm by Gift, Bequest, Intestate Succession, or Other Means Between Immediate Family Members An out-of-state parent cannot mail you a .22 LR pistol as a gift. A handgun crossing state lines to reach you generally must go through a California dealer, which puts you back on the roster.

Features That Will Make a .22 LR Pistol Illegal

A legally acquired, rostered pistol can still become an illegal assault weapon depending on its physical configuration. California’s assault weapon statute covers all semi-automatic pistols regardless of caliber. A semi-auto pistol with a detachable magazine qualifies as an assault weapon if it has any one of these features:

  • A threaded barrel designed to accept a flash suppressor, forward handgrip, or silencer.
  • A second handgrip forward of the trigger guard.
  • A barrel shroud that lets you hold the gun with your non-trigger hand without being burned (a standard slide doesn’t count).
  • The ability to accept a detachable magazine outside the pistol grip.

A semi-auto pistol with a fixed magazine that holds more than ten rounds also qualifies.9California Legislative Information. California Code PEN 30515 – Assault Weapons and .50 BMG Rifles Possession is a felony and causes permanent loss of firearm rights. The threaded barrel is the feature that catches .22 LR buyers most often, because many rimfire pistols sold elsewhere ship with threaded barrels for suppressor use.

California bans suppressors outright. Possessing a silencer is a felony under Penal Code section 33410, punishable by up to three years in state prison and a $10,000 fine. Recent federal changes to the suppressor tax stamp do not override the state ban.

The Ten-Round Magazine Limit

Under Penal Code section 32310, it is illegal to manufacture, import, sell, give, lend, buy, or receive any magazine holding more than ten rounds, punishable by up to a year in county jail.10California Legislative Information. California Code PEN 32310 – Large-Capacity Magazines Simple possession is a separate offense, chargeable as an infraction with a fine up to $100 per magazine, or as a misdemeanor with the same fine plus up to a year in jail. There is no rimfire exemption. A target .22 LR pistol that ships with a 15-round magazine elsewhere must use a 10-round magazine here, and the 15-round magazine cannot be brought into the state.

The Purchase Process, Step by Step

Once you’ve identified a legal model, the actual purchase takes at least ten days.

Firearm Safety Certificate

Before you can buy, you need a Firearm Safety Certificate. That means passing a 30-question written test on firearm safety and California gun laws with at least 75%. DOJ-certified instructors administer it, usually at gun stores. The certificate costs $25 and is valid for five years.11State of California – Department of Justice – Office of the Attorney General. Paperwork and Background Check

At the dealer you’ll complete ATF Form 4473, the federal firearms transaction record, which covers criminal history, mental health, citizenship, drug use, and whether you’re the actual buyer. Lying on the form is a federal felony.12Bureau of Alcohol, Tobacco, Firearms and Explosives. Firearms Transaction Record (ATF Form 4473) The dealer simultaneously submits the Dealer’s Record of Sale to the California DOJ to run the state background check. The DROS fee is $31.19.13New York Codes, Rules and Regulations. 11 California Code of Regulations 4001 – DROS Fees

Ten-Day Waiting Period

California requires ten days between submitting your purchase paperwork and picking up the firearm.14California Legislative Information. California Code PEN 26815 – Sale, Lease, or Transfer of Firearms at Retail There is no exception for .22 LR pistols, prior gun owners, or current FSC holders. If the background check needs follow-up, the clock may restart.

Safe Handling Demonstration

At pickup, the dealer watches you perform a safe handling demonstration with dummy rounds. For a semi-auto pistol, that’s removing the magazine, checking the chamber, loading a dummy round, cycling the action, and applying the safety. You don’t walk out until you can do it correctly.

Buying Ammunition for Your .22 LR

Every ammunition purchase in California, including .22 LR, requires a background check. If you’ve previously bought a firearm here and your information is already in the DOJ system, the standard eligibility check costs $1 and usually clears in minutes. If you’re not in the system, a more thorough check costs $19 and can take several days. A valid California driver’s license or state ID is required for even a single box.

Transporting the Pistol

Carrying a loaded firearm in public is prohibited under Penal Code section 25850. A first offense is generally a misdemeanor carrying up to a year in jail and a $1,000 fine, with sharper penalties for prior convictions or a stolen gun.15California Legislative Information. California Code PEN 25850 – Carrying a Loaded Firearm

In a vehicle, a handgun must be unloaded and in a locked container. The trunk counts; the glove compartment and center console do not.16State of California – Department of Justice – Office of the Attorney General. Transporting Firearms in California A lockbox with a padlock or combination lock works for vehicles without a trunk. The pistol should move directly to or from the vehicle for a lawful purpose, such as a range trip or the drive home from the dealer.

What the Whole Thing Costs

The pistol’s sticker price is only the beginning. California adds:

On a $400 pistol, the state excise tax and standard sales tax alone can push the total past $470 before the DROS fee, dealer markup, or your first box of ammunition. On a private party transfer or off-roster purchase, add a premium on the pistol itself plus a separate dealer transfer fee on top of the DROS.
