To be eligible for California Paid Family Leave, you need at least $300 in wages that had State Disability Insurance (SDI) deducted during your base period, you have to be employed or actively looking for work when leave begins, and you have to be taking time off for one of three covered reasons: bonding with a new child, caring for a seriously ill family member, or handling certain military family matters.1California Legislative Information. California Code Unemployment Insurance Code 2652 – Computation2Employment Development Department. Paid Family Leave Meet those three conditions and you can collect up to eight weeks of partial wage replacement in any 12-month period.
The Earnings Test
PFL is funded by the SDI deduction you see on your pay stub as “CASDI.” If your employer has been withholding it, you are in the system. The question then is simply whether you earned enough during the base period.
The base period is the 12-month window the Employment Development Department (EDD) uses to look at your earnings history. It runs from roughly 17 months before your claim starts to about 5 months before it starts, broken into four quarters. You need a minimum of $300 in SDI-covered wages across that window to qualify financially.1California Legislative Information. California Code Unemployment Insurance Code 2652 – Computation If your work history is too recent to show up in that window, a current paycheck will not save the claim.
You also need to be employed or actively job-hunting when leave begins. Losing your job shortly before you need leave does not automatically disqualify you, as long as you were in the labor market when the need for leave arose.2Employment Development Department. Paid Family Leave
If You Are Self-Employed
Standard payroll employees are automatically covered. Self-employed workers, sole proprietors, and independent contractors are not, unless they opt in through the Disability Insurance Elective Coverage program. That requires a net profit of at least $4,600 per year, a two-year minimum enrollment, and a six-month waiting period before you can file a PFL claim.3Employment Development Department. Disability Insurance Elective Coverage (DIEC) If you did not enroll ahead of time, PFL is not available to you.
The Three Covered Reasons
California law authorizes PFL for exactly three categories of leave, and you have to actually lose wages because of the time off. PFL replaces income; it does not pay on top of a full salary.4California Legislative Information. California Code Unemployment Insurance Code 3301
- Bonding with a newborn, a newly adopted child, or a child newly placed in foster care. The leave must begin within one year of the birth or placement.
- Caring for a qualifying family member with a serious health condition.
- Military exigency, which covers logistics tied to a spouse, domestic partner, parent, or child being deployed to active duty in a foreign country. Qualifying activities include arranging childcare, handling financial and legal matters, counseling, and attending military briefings.
Which Family Members Count for Caregiving
California’s list is broad. You can take caregiving leave for your:5California Legislative Information. California Code Unemployment Insurance Code 3302
- Child, biological, adopted, foster, or stepchild, as well as a legal ward or a child you raised in a parental role, at any age.
- Parent, including biological, adoptive, foster, or stepparent, plus anyone who raised you in a parental role.
- Parent-in-law.
- Spouse or registered domestic partner.
- Grandparent or grandchild.
- Sibling, related by blood, adoption, or a common parent.
One thing to know about this list: it is wider than the federal Family and Medical Leave Act, which only covers a spouse, parent, or child.6U.S. Department of Labor. Family and Medical Leave Act You could qualify for PFL benefits to care for a grandparent or sibling and have no parallel federal protection for that same time off.
PFL Pays You. It Does Not Protect Your Job.
This is the single biggest misunderstanding about the program. PFL is wage replacement. It sends you a check during your leave. It does not require your employer to hold your position or reinstate you when you return.2Employment Development Department. Paid Family Leave
Job protection comes from separate laws. The federal FMLA provides up to 12 weeks of unpaid, job-protected leave per year, but only if your employer has at least 50 employees within 75 miles, you have worked there for 12 months, and you logged at least 1,250 hours in the prior year.6U.S. Department of Labor. Family and Medical Leave Act The California Family Rights Act (CFRA) covers employers with five or more employees and protects leave for many of the same reasons PFL pays benefits. If you qualify under FMLA, CFRA, or both, your employer must return you to the same or a comparable role. If you qualify under neither, collecting PFL does not stop a termination.
Before you file, figure out whether FMLA or CFRA applies to you. If neither does, have a direct conversation with your employer about your return.
How to File
You can apply online through the EDD’s SDI Online portal or by mailing a paper form. Online claims process faster.
Both caregiving and bonding claims use Form DE 2501F. For a caregiving claim, you complete Part A, the person you are caring for completes Part C, and their licensed health care provider fills out Part D with the diagnosis and estimated care time.7Employment Development Department. How to File a Paid Family Leave Claim by Mail For a bonding claim, you complete Part B and submit proof of your relationship to the child, such as a birth certificate, adoption order, or foster placement record.8Employment Development Department. California Paid Family Leave – Instruction and Information New mothers transitioning from an SDI pregnancy claim may receive a separate form (DE 2501FP) from the EDD to simplify the handoff.
File within 41 days of your first day of leave. Missing that deadline can cost you benefits unless you can show good cause for the delay.9California Legislative Information. California Code Unemployment Insurance Code 2706.1 – Filing, Determination and Payment of Disability Benefit Claims There is no waiting period once your claim is approved; benefits start on the first day of leave, and you can take the eight weeks intermittently rather than in one block if that fits your situation better.10Employment Development Department.
