Under California air gun laws, BB guns, pellet guns, airsoft guns, and paintball markers are not classified as firearms, so you don’t need a background check, registration, or waiting period to buy one. That doesn’t make them unregulated. State law still controls who can sell them, how they must be colored, where you can take them, and how you can handle them in public, and some violations carry felony exposure.
Not a Firearm, but Still Regulated
California defines a firearm as a device that launches a projectile through a barrel by explosion or combustion.1California Legislative Information. California Code, Penal Code – PEN 16520 Air guns use compressed air, gas, or a spring, so they fall outside that definition, and the California Department of Fish and Wildlife has said plainly that air rifles are not firearms in the state.2California Department of Fish and Wildlife. California Outdoors Q&A – Air Rifles Federal law draws the same line, and ATF regulations explicitly exclude BB and pellet guns.3ATF eRegulations. 27 CFR 447.11 Meaning of Terms
California does, however, define two overlapping categories for its own rules. A “BB device” is anything that fires a projectile like a BB or pellet using air pressure, gas pressure, or spring action, and the definition expressly includes paintball markers.4California Legislative Information. California Code, Penal Code – PEN 16250 An “imitation firearm” is any BB device, toy, or replica similar enough in color and overall appearance to a real firearm that a reasonable person could mistake it for one.5California Legislative Information. California Code, Penal Code – PEN 16700 A single device can be both, and the rules below pick up on one label or the other depending on the conduct.
Buying and Giving Air Guns to Minors
Selling any BB device to a minor is a misdemeanor.6California Legislative Information. California Penal Code PEN 19910 Giving or lending one to a minor is a separate misdemeanor unless the minor has express or implied permission from a parent or legal guardian.7California Legislative Information. California Penal Code PEN 19915 Between the two, the statutes cover every way an adult might put an air gun in a minor’s hands.
Notice who the law targets. There is no blanket ban on a minor owning or using an air gun in California. The crime belongs to the adult who sells or hands one over, and parental consent is the hinge for the furnishing rule.
Required Coloring and Markings
Federal law requires toy, look-alike, and imitation firearms to carry a blaze orange plug permanently inserted in the barrel, recessed no more than six millimeters from the muzzle.8Office of the Law Revision Counsel. 15 U.S. Code 5001 – Penalties for Entering Into Commerce of Imitation Firearms Traditional BB guns, pellet guns, and paintball guns are exempt from the federal rule.9eCFR. Marking of Toy, Look-Alike, and Imitation Firearms Airsoft guns that fire nonmetallic projectiles are not exempt and do need the orange tip.
California adds its own layer. Since January 1, 2016, state law has required BB devices firing 6-millimeter or 8-millimeter projectiles, which covers most airsoft guns, to meet specific coloration requirements. Spot marker guns firing projectiles larger than 10 millimeters are excluded. Altering, removing, or covering up any required marking is itself a crime, so if your air gun came with a bright tip or colored body panels for compliance, leave them in place.
Where You Cannot Take an Air Gun
K-12 Schools
Bringing or possessing any device that fires a metallic projectile through air, CO2, or spring action onto the grounds of a public or private K-12 school is a crime unless you have written permission from the principal or their designee.10California Legislative Information. California Penal Code PEN 626.10 The statute covers BB guns, pellet guns, and paintball markers alike. A violation is a wobbler: prosecutors can charge it as a misdemeanor carrying up to a year in county jail, or as a felony with state prison exposure. The choice usually turns on whether the device was loaded, whether anything threatening happened, and the person’s record.
Colleges and Universities
The same statute covers public and private college and university campuses. Possession without written authorization from a campus president or equivalent administrator is a misdemeanor.
Open Display, Brandishing, and Negligent Discharge
Public handling of an air gun can produce three separate charges, each more serious than the last.
Openly displaying or exposing an imitation firearm in a public place is itself unlawful.11California Legislative Information. California Code, Penal Code – PEN 20170 A first offense is an infraction with a $100 fine. Repeat violations can escalate to larger fines or misdemeanor charges. Walking down a sidewalk with a realistic airsoft gun visible is enough, even if you never raise it.
Pointing or waving an imitation firearm at someone in a way that would make a reasonable person fear injury is a misdemeanor with a 30-day minimum in county jail.12California Legislative Information. California Code, Penal Code – PEN 417.4 A judge cannot go below 30 days on a conviction. Self-defense is the only statutory exception.
Willfully discharging a BB device in a grossly negligent way that could cause injury or death is a separate offense, usually charged as a misdemeanor with up to a year in county jail.13California Legislative Information. California Code, Penal Code – PEN 246.3 Gross negligence means conduct far outside what a reasonable person would do, enough to show disregard for human life. Firing a pellet gun into the air in a residential neighborhood is the kind of fact pattern the statute reaches.
Hunting With an Air Rifle
California allows air rifles for small game mammals and resident game birds. You cannot use an air rifle of any caliber or power for big game or migratory game birds, because the methods-of-take regulations for those species don’t list air guns as an allowable option.2California Department of Fish and Wildlife. California Outdoors Q&A – Air Rifles
Because air rifles aren’t firearms, the Firearm Safety Certificate requirement doesn’t apply. You still need a valid California hunting license, and first-time license buyers must complete a hunter education course regardless of weapon. Bag limits, seasons, and species rules all apply the same way.
Transporting an Air Gun
California doesn’t impose the locked-container or trunk-storage rules it uses for firearms, and the federal interstate Safe Passage provision doesn’t apply either, since air guns aren’t firearms under federal law.14Office of the Law Revision Counsel. 18 U.S. Code 921 – Definitions Local ordinances still matter, though. Driving through a city that bans discharge within its limits with an uncased, loaded pellet rifle on the passenger seat invites trouble. Unloaded and cased is the safe default.
For air travel, TSA allows compressed-air guns, including paintball markers, in checked baggage only, never in carry-on. The compressed-air cylinder has to be detached before packing, and TSA screens these alongside firearms.15Transportation Security Administration. What Can I Bring? – Firearms
USPS does not treat air guns as firearms for mailing. You can ship one, but any compressed-gas cartridge or cylinder in the package triggers hazardous materials rules for compressed gases.16Postal Explorer. Publication 52 – Hazardous, Restricted, and Perishable Mail – 43 Firearms
Federal Land
The National Park Service allows firearm possession in parks when it complies with the laws of the state the park sits in, but prohibits discharging firearms in park areas unless hunting is specifically authorized by federal statute. Firearms are also banned inside NPS buildings.17National Park Service. Firearms in National Parks Because air guns aren’t firearms, those possession rules don’t automatically carry over, but the broader prohibition on dangerous weapons inside federal facilities could. Check the specific rules for whichever federal land you’re visiting before bringing one.
Local City and County Rules
Local ordinances are where many air gun owners actually get into trouble. The most common pattern is a flat ban on discharging any air gun within city limits. Sacramento, for example, makes it unlawful to carry or discharge an air gun anywhere in the city except at licensed shooting galleries.18Sacramento City Code. 9.32.070 Discharging Air Guns in City Many other California cities and counties have similar rules.
These can be stricter than anything in state law. Backyard target practice that would be fine under state rules may be banned by a city code, and some jurisdictions require permits for activities the state doesn’t regulate at all. Before setting up a target in your yard or carrying an air gun around town, pull up the municipal code for your city and county. A call to the local police non-emergency line usually gets a straight answer about what’s allowed where you live.
