California child support back pay — the arrears a parent owes after missing or underpaying court-ordered support — does not go away. Every unpaid dollar is tracked as a fixed debt, carries 10% annual interest, and remains collectible for the rest of the owing parent’s life. The state uses wage garnishment, tax intercepts, license suspensions, property liens, passport denial, and in serious cases criminal prosecution to collect it. The only ways to limit the damage are to pay current support in full, modify the order through the court before falling behind, or, for a narrow set of cases, apply for the state’s Debt Reduction Program.
How Back Pay Starts and Grows
Arrears begin the first month a parent fails to pay the full court-ordered amount. They can also reach back further than many parents expect. Under Family Code 4009, a judge can make a support order retroactive to the date the original petition was filed, not the date the order was signed.1California Legislative Information. California Code Family Code 4009 A case that spends four months in court can produce four months of arrears the day the order is finalized.
Once a support order exists, the parent’s intent stops mattering. Lost hours, a medical crisis, or a verbal agreement with the other parent to accept less — none of it changes the balance. Every unpaid dollar is a fixed liability from the moment it was due.
Interest Is 10% a Year
California charges 10% annual interest on all unpaid child support, under the same statute that governs interest on other court judgments, Code of Civil Procedure 685.010.2California Legislative Information. California Code CCP 685.010 Interest starts on the first day of the month after a payment was due and went unpaid. Miss a full year on a $500 monthly obligation and you owe $6,000 in principal plus $600 in interest, with the interest continuing to compound on the growing balance.
Once interest attaches, it merges with the underlying arrears and is just as enforceable as the original support. Courts have very limited authority to reduce or forgive it. The longer a balance sits, the harder it becomes to pay off.
There Is No Statute of Limitations
California places no time limit on collecting child support arrears. The state will keep pursuing the debt long after the child turns 18, and will keep pursuing it when the parent who was owed is no longer actively asking for enforcement.3California Child Support Services. Frequently Asked Questions If the child is still in high school at 18, the current support obligation runs until graduation or the 19th birthday, whichever comes first, but arrears that built up during the child’s minority follow the owing parent indefinitely.
Family Code 290 gives courts broad authority to enforce support orders through wage execution, receivership, contempt, or any other method the court finds appropriate.4California Legislative Information. California Code Family Code 290 A parent who owes $40,000 when a child turns 18 still owes it at 30 or 40, and the balance will be larger by then because the 10% interest never stops.
How the State Collects
The Department of Child Support Services and local agencies pursue arrears through several channels at once. You do not have to miss many payments before the first collection action hits.
Wage Garnishment
The most common tool is an income withholding order sent directly to the paying parent’s employer, who deducts support from each paycheck.5Child Support Services. Enforcing a Court Order For current support plus arrears the default cap is 50% of disposable earnings, and a court can go higher. Federal law caps the total at 65% of disposable income.
Tax Refund Intercepts
Parents who owe arrears are reported to both the IRS and the California Franchise Tax Board. Any state or federal refund gets redirected to the arrears balance automatically, with no separate court order needed.5Child Support Services. Enforcing a Court Order
License Suspensions
California can suspend or deny driver’s licenses, business licenses, and professional licenses — cosmetologists, contractors, doctors, teachers, and attorneys are all exposed. The suspension stays in place until the parent pays or works out a payment arrangement with the child support agency.5Child Support Services. Enforcing a Court Order
Property Liens
The agency can record a lien against real property in any California county where the owing parent has an interest. The parent cannot sell or refinance that property until the arrears are paid or an alternative arrangement is made. The lien is a public record and affects credit as well.5Child Support Services. Passport Denial
When arrears exceed $2,500, the state certifies the debt to the federal Office of Child Support Enforcement, which triggers passport denial through the U.S. State Department.6Office of the Law Revision Counsel. 42 USC 652 – Duties of Secretary The State Department will refuse a new passport and can revoke or restrict an existing one. Parents often learn about this at the airport.
When Nonpayment Becomes a Crime
Willful failure to support a child is a crime in California. Under Penal Code 270, a parent who deliberately fails to provide food, clothing, shelter, or medical care commits a misdemeanor punishable by up to one year in county jail, a fine of up to $2,000, or both.7California Legislative Information. California Code PEN 270 If parentage has already been legally established and the parent still refuses to pay, the offense can be charged as a felony carrying a state prison sentence of one year and one day.
A court can also hold a non-paying parent in contempt, with fines up to $1,000 per violation and possible jail time. Criminal prosecution tends to focus on large balances, long gaps in payment, or parents hiding income, rather than someone who missed a single month.
You Can Only Lower Future Support, Not Past-Due Support
This is where parents hurt themselves most. If your income drops, you cannot wipe out the arrears that build up before you ask the court to change the order. Family Code 3651 allows modification only going forward from the date you file the motion.8California Legislative Information. California Code Family Code FAM 3651 Every day between the income drop and the filing is money you owe at the original rate, with interest.
The court can modify support “at any time as the court determines to be necessary,” but you have to show a real change in circumstances: job loss, serious illness, disability, or a significant income reduction. A verbal deal with the other parent does nothing. If you are falling behind, file the motion right away. The local child support agency or a family law facilitator at your courthouse can help with the forms. The clock on your arrears stops only when the court signs a new order, and that process takes weeks.
The Debt Reduction Program
Parents who already owe large arrears to the government may qualify for California’s Debt Reduction Program. The program applies only to government-owed debt — arrears that accumulated because the children received public assistance such as CalWORKs or were in foster care while support went unpaid.9California Child Support Services. Debt Reduction Program It does not touch money owed directly to the other parent.
Family Code 17550 sets the eligibility conditions. The child must be residing with you, and the child must have been reunified with you from foster care or returned to your custody from a guardian or relative caregiver. Your income must fall below 250% of the federal poverty level, and the local child support agency must find that reducing the debt is in the child’s best interest.10California Legislative Information. California Code Family Code FAM 17550
Contact the local child support agency handling your case to request an application. You will need documentation of income, assets, monthly expenses, and the circumstances that prevent you from paying in full. If you qualify, the agency offers a settlement for less than the full balance, calculated against your income, family size, and local cost of living. Payments must then be made exactly as agreed. Missing a payment after the agreement cancels the deal, and the full original debt comes back.9California Child Support Services. Debt Reduction Program Completing the program clears the government-owed portion of your arrears so you can focus on current support going forward.
