Eligibility for the California Consumer Assistance Program turns on three things: your household income, whether your vehicle recently failed a Smog Check, and whether your car and its registration meet the program’s rules. If you qualify, the Bureau of Automotive Repair will either help pay for emissions repairs (up to $1,450) or pay you to scrap the vehicle ($1,350, $1,500, or $2,000, depending on the tier).1Bureau of Automotive Repair. Consumer Assistance Program – Income Eligibility One retirement tier is open regardless of income; everything else requires meeting the income test.
Income Limits for 2026
Repair assistance and the two higher retirement tiers ($1,500 and $2,000) require gross household income at or below 225% of the federal poverty level.1Bureau of Automotive Repair. Consumer Assistance Program – Income Eligibility The 2026 cutoffs are:2U.S. Department of Health and Human Services. 2026 Poverty Guidelines
- 1 person: $35,910
- 2 people: $48,690
- 3 people: $61,470
- 4 people: $74,250
- 5 people: $87,030
- 6 people: $99,810
For households larger than six, add $12,780 per additional person. If your income exceeds these limits, the only CAP benefit available to you is the $1,350 vehicle retirement tier.3Bureau of Automotive Repair. Retire Your Vehicle
Who Qualifies for Repair Assistance
To qualify for repair help, your vehicle must have failed its most recent Smog Check and your household income must fall at or below the thresholds above. Repairs have to be performed at a station contracted with the Bureau of Automotive Repair; work done anywhere else does not count.4Bureau of Automotive Repair. Apply for Repair Assistance
The state’s maximum contribution depends on model year. For 1996 or newer vehicles, CAP pays up to $1,450 toward diagnosis and emissions-related repairs; for 1976 through 1995 vehicles, the cap is $1,100. You pay a 20% co-payment on bills within those ranges, and anything above the state’s cap is yours.4Bureau of Automotive Repair. Apply for Repair Assistance Authorization by the Bureau comes before any work begins, so a shop that starts repairs without your eligibility letter leaves you on the hook for the full bill.
Who Qualifies for Vehicle Retirement
Retirement eligibility is split into three tiers, and you need to match a tier exactly. Mixing elements from different tiers does not work.3Bureau of Automotive Repair. Retire Your Vehicle
- $2,000 tier: You meet the income limit and your vehicle failed its most recent Smog Check.
- $1,500 tier: You meet the income limit and the vehicle has a completed Smog Check (pass or fail) within the 180 days before you apply. Zero-emissions vehicles such as battery-electric and hydrogen fuel cell cars are excluded from this tier.
- $1,350 tier: No income requirement, but the vehicle must have failed its most recent Smog Check.
For the $2,000 and $1,350 tiers, the Smog Check failure cannot be solely from an ignition timing adjustment, a failed gas cap test, or a tampered emissions control system.5Legal Information Institute. California Code of Regulations Title 16 3394.4 – Eligibility Requirements A gas cap failure, by itself, won’t get your car in.
There’s also a frequency limit. A sole owner can retire only one vehicle through CAP in any 12-month period; a joint owner can retire up to two.3Bureau of Automotive Repair. Retire Your Vehicle
Vehicle and Registration Rules
Even if your income and Smog Check status check out, the car itself must qualify. It has to be a passenger car, truck, SUV, or van with a gross vehicle weight rating of 10,000 pounds or less, and it must be subject to the Smog Check program.3Bureau of Automotive Repair. Retire Your Vehicle
Registration rules disqualify a lot of applicants. The vehicle must be currently registered with the DMV with a valid, unexpired sticker, or all fees must be paid and the registration cannot have been expired more than 120 days. It must also have been continuously registered in California for the two consecutive years before the current expiration date, with no lapses totaling more than 120 days in that window.5Legal Information Institute. California Code of Regulations Title 16 3394.4 – Eligibility Requirements Cars registered to a business, government agency, or nonprofit are not eligible, and the vehicle cannot be in the middle of an ownership transfer or classified as junked or total-loss salvage.3Bureau of Automotive Repair. The vehicle also has to be drivable and reasonably intact when you take it to the dismantler. It must start without a jump or starting fluid, drive forward at least 10 yards under its own power, and still have its doors, hood, dashboard, windshield, exhaust system, side panels, at least one bumper, at least one side window, the driver’s seat, and a working headlight, taillight, and brake light.5Legal Information Institute. Documents That Prove Eligibility
Income proof is where most applications live or die. The Bureau wants your most recent federal Form 1040 or California Form 540 tax return. A W-2 by itself is not accepted. If you don’t file taxes, acceptable alternatives include proof of current unemployment benefits, veterans’ benefits, disability payments issued within the last 60 days, your latest Social Security annual award letter, or a bank statement from the past 60 days showing Social Security direct deposit. If you’re submitting earned wages as support, include a recent pay stub along with your tax return.1Bureau of Automotive Repair. Consumer Assistance Program – Income Eligibility
You’ll also need your current vehicle registration and the most recent Smog Check inspection report. The VIN and license plate on your application must match the registration card exactly, because the Bureau cross-checks against DMV records.
How to Apply
Applications go through the Bureau’s online portal or by mail to its Sacramento office. The Bureau commits to reviewing applications within two weeks of receipt, and online submissions typically move faster than paper.6Bureau of Automotive Repair. CAP Online Application
If you’re approved, you’ll receive an official letter of eligibility with a unique authorization number. That letter is what unlocks the benefit. No CAP-contracted repair shop will begin work without it, and no dismantler will accept your vehicle without it. Scrapping your car or starting repairs before the letter arrives forfeits the payment. For retirement, the letter carries an expiration date; miss it and the approval is void.3Bureau of Automotive Repair. Retire Your Vehicle
A Note on Taxes
Whether a CAP payment is taxable federal income is not a simple yes or no. State assistance payments can qualify for the IRS general welfare exclusion when they come from a government fund, are based on individual need, and aren’t compensation for services.7Internal Revenue Service. IRS Issues Guidance on State Tax Payments The IRS calls this a fact-intensive inquiry, and agencies are required to file Form 1099-G for taxable grants of $600 or more.8Internal Revenue Service. Instructions for Form 1099-G If a 1099-G arrives after you participate in CAP, ask a tax professional whether the exclusion applies to your situation.
