Contract cancellation law in California gives you a limited right to back out of certain agreements after signing, with windows that run from two business days to seven days depending on what you bought. The right isn’t universal: it attaches to specific contract types the Legislature singled out, usually because of high-pressure sales tactics or the setting where the deal was made. If your contract qualifies, you also have to cancel the right way and on time.
Which Contracts You Can Cancel and How Long You Have
The cancellation window depends entirely on what you signed. These are the main categories California law covers.
Door-to-Door and Off-Premises Sales
If a salesperson sold you something at your home, your workplace, or a temporary location like a hotel conference room or trade show, and the price was $25 or more, you have three business days to cancel for any reason.1California Legislative Information. California Civil Code CIV 1689.5 The clock starts the day after you sign. Saturdays count. Sundays and holidays don’t.
The seller is supposed to hand you a cancellation form at the time of sale along with a copy of the contract. You can use that form, or any signed and dated written notice saying you want to cancel, as long as it reaches the seller’s address before midnight on the last day of the window.2California Legislative Information. California Civil Code CIV 1689.7 A mailed notice is timely if the postmark is within the window, even if it arrives later.
Gym and Health Studio Memberships
Every gym or health studio contract in California comes with a five-business-day cancellation window, excluding Sundays and holidays.3Justia Law. California Civil Code 1812.80-1812.97 – Contracts for Health Studio Services The contract must include a conspicuous cancellation notice in at least 10-point boldface type near the signature line, telling you how and where to send the notice.
You also have a separate right to cancel if the facility isn’t fully operational when you sign up or never opens at all. In that situation you’re entitled to a full refund including initiation fees, and the gym has 30 days to pay it.3Justia Law. California Civil Code 1812.80-1812.97 – Contracts for Health Studio Services
Timeshares
Timeshare buyers get seven calendar days to cancel. The clock starts on whichever is later: the day you signed the purchase contract or the day you received the public report about the development.4California Legislative Information. California Business and Professions Code BPC 11238 All purchase money is held in escrow during the cancellation period, so the developer doesn’t actually receive your funds unless you let the deadline pass.5California Department of Real Estate. Weight Loss, Dating Services, and Medical Alert Contracts
Weight loss contracts can be canceled within three business days of signing, by letter, email, or any written communication showing you don’t want to be bound. Refunds are due within 10 days of the business receiving your notice.6California Legislative Information. California Civil Code – Weight Loss Contracts
Dating service contracts carry similar cancellation rights, meant to prevent lock-in on expensive long-term commitments after a single pitch.
Personal emergency response unit contracts, meaning standalone medical alert devices and monitoring services not bundled with a home alarm, come with a seven-business-day cancellation window.
Home Equity Loans and Cash-Out Refinancing
Federal law layers a three-business-day right of rescission on top of state protections for certain loans secured by your primary home. This covers home equity loans, home equity lines of credit, and cash-out refinancings where you borrow more than your existing balance.7Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions The three-day window starts on the latest of three dates: when you close the loan, when you receive all required disclosures, or when you receive the rescission notice.
The rescission right does not apply to a mortgage used to buy a home, and it does not apply to a simple rate-and-term refinance with no new money borrowed.7Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions
Subscriptions and Automatic Renewals
California’s Automatic Renewal Law doesn’t give you a fixed cancellation window; it gives you the ability to cancel at any time without the business getting in your way. Any company that charges you on a recurring basis has to disclose, up front, that the subscription will continue until you cancel, what the recurring charges will be, and how to cancel. The business must also get your clear, affirmative consent before charging you.8California Legislative Information. California Business and Professions Code BPC 17601 – Automatic Renewal and Continuous Service Offers
Amendments effective July 1, 2025, added reminder requirements and tightened the cancellation process:9California Attorney General. Consumer Alert on California’s Automatic Renewal Law
- Annual subscriptions require a renewal notice between 15 and 45 days before the charge, stating the renewal terms, the amount, and how to cancel.
- Free or discounted trials lasting more than 31 days require a notice between 3 and 21 days before the trial ends.
- Price increases require notice at least 7 days before the new fee takes effect.
- Every subscriber must get a yearly reminder identifying the service, the charge amount and frequency, and how to cancel.
If you signed up online, the business has to let you cancel online. It cannot push you to call a phone number or visit a location, and the cancellation process cannot include steps meant to delay you.9California Attorney General. Consumer Alert on California’s Automatic Renewal Law
Extra Time for Buyers 65 and Older
Californians who are 65 or older get five business days instead of three for several contract types:10California Contractors State License Board. Warnings and Exceptions
- Home solicitation contracts
- Home improvement contracts
- Property Assessed Clean Energy (PACE) assessment contracts
- Service and repair contracts
- Seminar sales contracts
The business owes seniors the same cancellation notice and forms as any other buyer. Only the window is longer.
What California Does Not Let You Cancel
A common assumption is that California has a general cooling-off period for big purchases. It doesn’t. Car buyers in particular are often caught off guard: there is no automatic cancellation right for a vehicle purchase.
Licensed dealers selling used cars priced at $40,000 or less must offer you a two-day cancellation option at the time of sale, but you have to actually purchase that option, and the dealer charges a fee for it.11California Department of Motor Vehicles. Car Buyer’s Bill of Rights If you bought the option and want to use it, bring the car back within two business days by the dealer’s closing time, with no more than 250 miles added, all original paperwork, no new tickets or liens, and in the same condition. The dealer then owes a full refund including sales tax, registration fees, and your trade-in or its fair market value.
The option is not available for new cars, vehicles over $40,000, private-party sales, motorcycles, off-highway vehicles, or recreational vehicles.11California Department of Motor Vehicles. Car Buyer’s Bill of Rights And a purchase mortgage, straightforward refinance with no new money, and most ordinary retail purchases also fall outside any cancellation statute.
How to Send a Valid Cancellation Notice
Hitting the deadline isn’t enough on its own. The mechanics have to be right, or the business can argue the cancellation never took effect.
Start with the pre-printed cancellation form if the seller gave you one. California law requires sellers in home solicitation sales, gym contracts, and several other categories to provide one. Sign it, date it, and send it to the address the contract specifies.2California Legislative Information. California Civil Code CIV 1689.7 If no form was provided, write a short letter with your name, the contract date, and your intent to cancel. That satisfies the statute.
Send it in writing. A phone call doesn’t count for contracts that require written notice. Mail works if the postmark falls within the cancellation window, even if the letter arrives after the deadline. Certified mail with a return receipt gives you proof. Hand delivery to the seller’s business address also works.
Email or fax is only safe when the contract explicitly allows it. The weight loss contract statute accepts written notice by mail or delivery without restricting the form.6California Legislative Information. California Civil Code – Weight Loss Contracts A signed letter sent by certified mail is the safest default across all contract types.
When You Get Your Money Back
Each contract type sets its own refund deadline.
- Home solicitation sales: full refund within 10 days of the seller receiving your cancellation notice, plus the return of any traded-in property in substantially the same condition.2California Legislative Information. California Civil Code CIV 1689.7
- Weight loss contracts: full refund within 10 days.6California Legislative Information. California Civil Code – Weight Loss Contracts
- Health studio contracts: refund within 30 days, including initiation fees if the gym never opened as promised.3Justia Law. California Civil Code 1812.80-1812.97 – Contracts for Health Studio Services
- Timeshares: purchase money held in escrow during the seven-day period is returned to the buyer upon cancellation.5California Department of Real Estate. FAQs – Time-shares
- Used cars with the cancellation option: full refund including sales tax and registration fees when the vehicle is returned within two business days.11California Department of Motor Vehicles. Car Buyer’s Bill of Rights
If you paid by credit card and the business stalls, the Fair Credit Billing Act lets you dispute the charge directly with your card issuer by sending written notice within 60 days of the statement date showing the charge.12Office of the Law Revision Counsel. 15 USC 1666 – Correction of Billing Errors Include your name, account number, the amount in dispute, and why you think the charge is wrong. That doesn’t replace your cancellation rights against the seller, but it gives you leverage when the refund doesn’t arrive.
If the Business Refuses to Honor Your Cancellation
The first stop is the California Department of Consumer Affairs. You can file a complaint online or by calling 800-952-5210.13California Department of Consumer Affairs. Consumer Self-Help, Tips and Resources to Resolve Consumer Complaints For smaller amounts, small claims court lets you pursue restitution without hiring an attorney.
Two California statutes give consumers stronger tools. The Unfair Competition Law allows lawsuits against businesses engaged in unlawful or deceptive conduct, and courts can order a business to stop the practice and return money it shouldn’t have collected. The UCL is limited to equitable remedies and does not award damages beyond restitution.14California Legislative Information. California Business and Professions Code – Unfair Competition
The Consumer Legal Remedies Act goes further. If a business used deceptive practices in connection with a contract, you can recover actual financial losses, get a court order stopping the behavior, and in cases of intentional misconduct seek punitive damages.15California Legislative Information. California Civil Code CIV 1780 Before filing a CLRA lawsuit for damages, you have to send the business a written demand letter giving it a chance to fix the problem. Skipping that step is a common reason these cases get dismissed early.
