California Disability Benefits: Eligibility, Filing, and Payment Timing

California disability benefits replace part of your paycheck when a non-work-related illness, injury, or pregnancy keeps you from doing your job. The program is called State Disability Insurance, it’s run by the Employment Development Department, and it’s funded entirely by a payroll deduction from your own wages. For claims filed in 2026, SDI pays 70 to 90 percent of your regular wages, up to $1,765 per week, for as long as 52 weeks.1Employment Development Department. What SDI Covers

Under California Unemployment Insurance Code Section 2626, you count as disabled on any day a physical or mental condition prevents you from doing your regular work.2California Legislative Information. It includes physical and mental illnesses, injuries, pregnancy and childbirth, quarantine orders from a health officer for communicable diseases, and medically treated substance use disorders. One thing SDI does not cover is a work-related injury or illness. Those fall under workers’ compensation, a separate system paid for by your employer. If you’re not sure which category your situation fits, the EDD says to file for SDI anyway and let them decide.4CA.gov. File for Disability

Who Qualifies and How Much You’ll Get

You need to clear two hurdles: medical and financial.

On the medical side, a licensed physician or other authorized practitioner has to certify that you can’t work, and the certification has to continue for as long as your claim runs.

On the financial side, the EDD looks at a 12-month “base period” that falls roughly 5 to 18 months before your claim starts. You need at least $300 in wages that were subject to SDI tax during that period.1Employment Development Department. Your weekly amount depends on what you earned during the base period. The 2026 formula replaces 70 to 90 percent of your usual weekly wage, with lower earners getting the higher percentage. The weekly ceiling is $1,765. Those rates went up substantially in 2025, when the old 60-to-70 percent formula was replaced.6Employment Development Department. Two edge cases on eligibility. If your employer uses a state-approved Voluntary Plan instead of standard SDI, you file through the employer’s plan rather than the EDD; those plans must match SDI benefits and can’t cost more.8Employment Development Department. How to File Your Claim

The fastest route is online. Create a myEDD account, verify your identity through ID.me, and file through SDI Online.9Employment Development Department. Have this information ready before you start:

  • A valid California Driver License or state ID number, your full legal name as it appears on the ID, date of birth, and Social Security number.
  • Your most recent employer’s business name, phone number, and mailing address (check your W-2 or paystub), plus the last date you worked your normal duties.
  • Any wages you’ve received or expect to receive during your disability, including sick leave, PTO, or vacation pay. Note any workers’ compensation claim details too.
  • Bank routing and account numbers if you want direct deposit.

Two deadlines govern the timing. You have to wait at least nine days after your disability begins before filing. But you must file within 49 days of your disability start date or you risk losing benefits.9Employment Development Department. The Medical Certification

Your claim has two parts: your statement and your doctor’s. After you complete the claimant’s portion, your licensed health professional has to submit the medical certification, either as Part B on the paper form or electronically through SDI Online.10Employment Development Department. How to File a Disability Insurance Claim by Mail That certification also has to reach the EDD within 49 days of your disability start date, and nothing gets processed until both parts arrive. Reporting Income While You’re on Claim

Once benefits are flowing, you have to report any income you earn, even income that may not affect your benefit amount, and you have to report if you go back to work. Failing to do so can lead to overpayments, penalties, and a false statement disqualification that blocks future claims.12Employment Development Department. When Payments Start

Every new SDI claim starts with a seven-day non-payable waiting period. Benefits begin on the eighth day of your disability, not the first. Most payments go out within two weeks after the EDD receives a properly completed claim.7Employment Development Department. The EDD sends a Notice of Computation (DE 429D) showing your weekly benefit amount and the maximum total you can collect based on your base period. If the department needs more documentation, they’ll reach out through the portal or by mail; delays on your end mean delays in payment.

Job Protection Is Separate

This trips people up. Collecting SDI does not require your employer to hold your job. The EDD is explicit that these programs replace wages only.13Employment Development Department. Both provide unpaid, job-protected leave, but only if your employer is covered and you meet the eligibility rules.

In practice, your employer may require you to use FMLA or CFRA leave while you’re collecting SDI, so wage replacement and job protection can run at the same time. If you work for a smaller company that isn’t covered by either law, you may have no legal right to return to your same role. Confirm the details with HR before your leave starts.

Paid Family Leave

California’s Paid Family Leave program sits inside the same SDI system but covers a different situation: you can work, but a family member needs you. Under UIC Section 3301, PFL provides up to eight weeks of wage replacement in a 12-month period when you take time off to care for a seriously ill family member, bond with a new child, or handle a military qualifying exigency.14California Legislative Information. Eligible family members are your child, spouse, domestic partner, parent, grandparent, grandchild, or sibling. Parents-in-law are not on the list. Bonding leave has to happen within one year of birth, adoption, or foster placement.

PFL uses the same 70 to 90 percent wage formula and the same $1,765 weekly maximum as regular disability benefits.15Employment Development Department. Paid Family Leave Benefit Payment Amounts You must have an actual wage loss to qualify. If your employer keeps paying you fully during the leave, PFL doesn’t apply.

If Your Claim Is Denied

You have 30 days from the date on your denial notice to file an appeal. Submit the Appeal Form (DE 1000A) by mail to the return address on the denial notice.16Employment Development Department. State Disability Insurance Appeals Include a detailed explanation of why you believe you’re eligible, along with any supporting documents you didn’t provide originally. Miss the 30-day window and you can still file late, but you’ll have to explain the delay, and an Administrative Law Judge will decide whether the reason is good cause.

After you file, the EDD reconsiders internally first. If they still deny it, the appeal goes to the California Unemployment Insurance Appeals Board, where an Administrative Law Judge holds a hearing. You and an EDD representative present your sides, and the judge decides based on the facts. Miss the hearing and the appeal is dismissed.

When to Look at Federal Disability Instead

California’s SDI is built for temporary conditions and caps out at 52 weeks. If your condition is expected to last at least 12 consecutive months or result in death, you may qualify for one of two federal programs run by the Social Security Administration.17Social Security Administration. Social Security Disability Insurance (SSDI) is for people with a work history. You earn Social Security credits through payroll taxes, and you need enough of them, both recent and lifetime, to qualify.18Social Security Administration. Supplemental Security Income (SSI) is different. It doesn’t require any work history. Federal claims have their own denial and appeal process, separate from anything the EDD decides, and federal law caps disability attorney fees at 25 percent of your back pay or $9,200, whichever is less.22Social Security Administration. Fee Agreements
