California Earned Income Tax Credit: Eligibility, Amounts, and Filing

The California Earned Income Tax Credit (CalEITC) is a refundable state credit for workers earning up to $32,900 in tax year 2025, worth as much as $3,756 for a family with three or more qualifying children and $302 for a worker with no children. Because it’s refundable, you receive the full amount even if you owe no California income tax. Unlike the federal credit, CalEITC is open to filers who use an Individual Taxpayer Identification Number (ITIN), not only those with a Social Security Number.

Who Qualifies

To claim CalEITC for 2025 you need to meet each of the following:

  • You were at least 18 at the end of the tax year, or you have a qualifying child.
  • You had earned income from work performed in California — wages, salary, tips, or net self-employment earnings. Investment income by itself does not count.
  • You, your spouse, and any qualifying children each have a valid SSN or ITIN. California extended ITIN eligibility beginning with tax years on or after January 1, 2020.1Franchise Tax Board. Individual Taxpayer Identification Number (ITIN)
  • You lived in California for more than half of the tax year.

The credit is governed by California Revenue and Taxation Code Section 17052, which borrows many definitions from Internal Revenue Code Section 32 but sets its own income limits and credit percentages.2California Legislative Information. California Revenue and Taxation Code RTC 17052

If you’re married and filing separately, you can still claim CalEITC, but only if you had a qualifying child who lived with you for more than half the year and you either lived apart from your spouse for the last six months of the year or were legally separated under a written agreement or court decree.3Franchise Tax Board. 2025 Income Limits and Credit Amounts

For tax year 2025, both your earned income and your adjusted gross income must be $32,900 or less, regardless of filing status or number of children.4Franchise Tax Board. Eligibility and Credit Information If either figure crosses that line, you’re out. Below the ceiling, the credit phases out gradually, so most filers receive less than these maximums:

  • No qualifying children: up to $302
  • One qualifying child: up to $2,016
  • Two qualifying children: up to $3,339
  • Three or more qualifying children: up to $3,756

There is also a separate limit on investment income. For 2025 that cap is $11,950. Interest, dividends, capital gains, and similar passive income count toward it. Exceed the cap and you’re disqualified even if your earned income sits well under $32,900.

Qualifying Child Rules

You don’t need children to receive CalEITC, but having qualifying children raises the credit sharply. A child qualifies if all four tests are met:

  • Relationship. The child is your biological child, stepchild, foster child, sibling, or a descendant of any of these (such as a grandchild or niece).
  • Age. The child is younger than you and either under 19 at the end of the year or under 24 if a full-time student for at least five months of the year. There is no age limit for a child who is permanently and totally disabled.5Franchise Tax Board. Earned Income Tax Credit Calculator – Help with Qualifying Children
  • Residency. The child lived with you in California for more than half the year. Temporary absences such as school still count as time at home.
  • Joint return. The child did not file a joint return with a spouse, unless the only reason for filing was to claim a refund.

When Two People Could Claim the Same Child

If more than one person could claim the same child, the IRS tie-breaker rules apply. A parent always beats a non-parent. If both parents could claim the child but aren’t filing jointly, the parent who lived with the child longer wins, and if that’s a tie, the parent with the higher AGI claims the child. A non-parent can claim the child only if no eligible parent actually does, and only if the non-parent’s AGI is higher than any eligible parent’s.6Internal Revenue Service. Tie-Breaker Rules

Proving a Child Lived with You

If the Franchise Tax Board or IRS questions your claim, you’ll be asked for documents showing the child shared your address. School, medical, or daycare records work, as does a letter on official letterhead from a school, doctor, social service agency, or place of worship showing both your name and the child’s name at the same address, with dates.7Internal Revenue Service. Self-Employment and Gig Income

CalEITC is not limited to W-2 workers. If you drive for a rideshare company, freelance, sell goods online, or run any other business, your net self-employment earnings count as earned income.8Franchise Tax Board. 2025 California Earned Income Tax Credit Booklet “Net” means gross business revenue minus allowable business expenses, calculated on federal Schedule C (or Schedule F for farming) and carried into Worksheet 3 of Form 3514.

Earned Income, Self-Employment Income and Business Expenses If you receive Medicaid waiver payments or In-Home Supportive Services (IHSS) payments, you can choose whether to include or exclude them as earned income for CalEITC, and your California choice can differ from the choice you made on your federal return.8Franchise Tax Board. 2025 California Earned Income Tax Credit Booklet

Two Companion Credits on the Same Form

Two additional credits attach to CalEITC and are claimed on the same Form 3514. Many eligible filers miss them.

Young Child Tax Credit

The Young Child Tax Credit (YCTC) is worth up to $1,189 per qualifying child under age six for 2025. You must qualify for CalEITC first, and the same $32,900 income ceiling applies.4Franchise Tax Board. Eligibility and Credit Information A family with two children under six who hits the maximum CalEITC and YCTC could receive up to $5,717 in combined state credits, before any federal credits. YCTC is also available to ITIN holders.1Franchise Tax Board. Individual Taxpayer Identification Number (ITIN)

Foster Youth Tax Credit

The Foster Youth Tax Credit (FYTC) is worth up to $1,189 per qualifying taxpayer for 2025, or $2,378 if both you and your spouse or registered domestic partner qualify.10California Department of Social Services. Foster Youth Tax Credit All of these must apply:

  • You qualify for CalEITC.
  • You were between 18 and 25 at the end of the tax year.
  • You were in foster care at age 13 or older, placed through the California foster care system.11Franchise Tax Board. Foster Youth Tax Credit

How to Claim It

CalEITC, YCTC, and FYTC all live on FTB Form 3514, California Earned Income Tax Credit.12Franchise Tax Board. California Earned Income Tax Credit The form walks through 11 steps to determine eligibility and calculate the credit, which then transfers to your main California return.

Attach Form 3514 to whichever California return you file: Form 540, Form 540 2EZ (a simpler version for straightforward returns), or Form 540NR for nonresidents and part-year residents.13Franchise Tax Board. 2025 Form 3514 California Earned Income Tax Credit Pull together your W-2s, 1099s, and any Schedule C or Schedule SE for self-employment earnings. If you e-file through tax software, follow its CalEITC prompts instead of filling out the form by hand. The software runs the calculations and attaches Form 3514 for you.

Claiming a Credit You Missed in a Prior Year

If you qualified for CalEITC in an earlier year but never claimed it, you can file an amended California return using Schedule X attached to an amended Form 540, along with Form 3514 for that tax year.17Franchise Tax Board. 2025 Instructions for Schedule X California Explanation of Amended Return Changes California generally allows four years from the original return’s due date to file a refund claim. If you never filed at all for that year, you’ll need to file the original return, not an amendment.

Effect on Public Benefits

Receiving CalEITC will not disqualify you from CalWORKs, Medi-Cal, or CalFresh. The refund is exempt as income for public benefit purposes and is excluded from resource counts for 12 calendar months starting the month you receive it. You have a full year to spend or save it without affecting benefits eligibility.

For Supplemental Security Income, the rules are narrower. The Social Security Administration excludes federal tax refunds from SSI resource counts for 12 months after the month of receipt.18Social Security Administration. Federal Tax Refunds and Advance Tax Credits for SSI Resources That federal exclusion does not expressly cover state refunds. If you receive SSI, plan to spend or convert your CalEITC refund within the applicable exclusion period so your countable resources stay under the SSI limit.
