California EDD Appeal Form (DE 1000A): Filing and 30-Day Deadline

To appeal an EDD decision, use the California EDD appeal form that came with your denial notice — DE 1000M for unemployment insurance, DE 1000AA for state disability insurance or paid family leave — and get it postmarked within 30 calendar days of the mailing date on that notice. Filing costs nothing. You can mail it, or, for disability and paid family leave claims, submit it electronically through your myEDD account.¹²

Which Form You Need

EDD uses a different form for each benefit type. The form packaged with your Notice of Determination is the correct one. If you’ve lost it, download a replacement from the California Unemployment Insurance Appeals Board’s forms page.³

DE 1000M — Unemployment Insurance appeals. This is what comes with a UI Notice of Determination.¹
DE 1000AA — State Disability Insurance and Paid Family Leave appeals. EDD sends this form with denial notices for DI (DE 2517) and PFL (DE 2514) claims.²

Some older EDD materials refer to a “DE 1000A.” That designation points to the same appeal process, and if the form you received is labeled DE 1000A you can still use it. What matters is that you respond to the specific notice you got.

The 30-Day Deadline

You have 30 calendar days from the mailing date printed on your Notice of Determination to file. Claimants and employers get the same window.⁴ The date that counts is your postmark if you mail the form, or the electronic timestamp if you submit online for a DI or PFL case. Delivery to the EDD office does not have to happen within the 30 days — sending does.

If you’re filing anywhere near the deadline, use certified mail with return receipt. The few extra dollars buys you dated proof of the postmark.

Filling Out the Form

Most people can complete the form in under 20 minutes. Keep your denial notice next to you while you work through it. The form asks for:

Your Social Security Number, which links the appeal to your existing claim file.
Your EDD employer account number, if you are an employer filing the appeal.
The date of the notice you’re appealing, copied exactly from the Notice of Determination. This is how the Appeals Board matches your appeal to the right decision.
Your mailing address, phone, email, and cell number. The Appeals Board uses these to send your Notice of Hearing and the judge’s decision, so keep them current.⁴
Your reason for disagreeing with the determination.

Writing the Reason You Disagree

This is the part of the form that carries your appeal. Focus on facts, not frustration. If EDD concluded you quit voluntarily, explain the specific circumstances that made leaving necessary: an unsafe work environment, a significant change in job duties, a medical condition. Use exact dates when you can. If the denial turned on wages earned, explain the discrepancy and point to pay stubs or records that back up your numbers.

Keep the tone neutral and specific. The Administrative Law Judge who reads your explanation is looking for a factual dispute with EDD’s determination, not a general argument that the outcome felt unfair. If you run out of space, attach extra sheets and write your name and Social Security Number at the top of each page so they stay linked to your file.

Appealing by Letter Instead

You are not required to use the printed form. A letter works if you don’t have access to a printer or lost the form. For disability and paid family leave appeals, the letter must include your full name, DI Claim ID Number or EDD Customer Account Number, Social Security Number, address, phone number, reason for the appeal, any request for language assistance or special accommodations, and your signature.² For unemployment appeals, the letter replaces the form, so include everything the form would have asked for.¹

How to Submit

Submission method depends on which benefit you’re appealing.

Unemployment Insurance

Mail the completed DE 1000M or letter to the return address printed at the top of your Notice of Determination.¹ There is no online portal for submitting the initial UI appeal itself.

Disability Insurance and Paid Family Leave

Mail the DE 1000AA to the return address on your notice, or submit it electronically. EDD describes online submission as the fastest and most secure option.² Electronic filing runs through your myEDD account. Do not confuse this with the CUIAB’s myAppeal portal, which is a separate system used after the appeal is already on file.

If You Miss the 30 Days

You can still file late, but you have to explain the delay on the form. An Administrative Law Judge decides whether your reason meets the “good cause” standard, which California law defines broadly enough to include mistake, inadvertence, surprise, or excusable neglect.⁵ Serious medical emergencies, natural disasters, and never receiving the notice in the mail are the kinds of reasons that tend to qualify. If the judge finds your reason insufficient, the appeal is dismissed without any review of the merits of your case.⁴

What Happens After You File

EDD first reviews whether the evidence you provided is enough to reverse its own decision. If it isn’t, EDD forwards the case to the CUIAB’s local Office of Appeals for a hearing.² The CUIAB then mails you an Appeal Acknowledgement and Welcome Letter with your case number and instructions for registering on the myAppeal portal, where you can track your case status.⁶ Later, a Notice of Hearing arrives with the date, time, and dial-in or location information for your hearing before an Administrative Law Judge.

One point about benefits during this period: if EDD previously found you eligible and your employer is the one appealing, federal law does not allow the state to stop your payments while that appeal is pending. Benefits continue until a new decision specifically finds you ineligible.⁷ If the appeal eventually goes against you, EDD will issue an overpayment notice for any benefits you weren’t entitled to, and that overpayment can itself be appealed using the same process.⁸
