The EDD complaint form DE 8123, titled “Comments, Suggestions, and/or Complaints,” is the paper form California’s Employment Development Department uses to collect service-quality feedback. You fill it out by hand and mail it to the EDD division that handles the program your complaint involves. It’s the right channel for problems like rude staff, long waits, unreturned callbacks, or a failure to provide help in your language. It is not the way to challenge a denied claim or an overpayment notice.
When DE 8123 Is the Right Form
The form is built for how you were treated, not what the department decided about your money. Use it if an EDD representative was dismissive on the phone, an office refused to help you in your language, or you waited weeks for a callback that never came. If your problem is a denied claim, an overpayment notice, or any other decision about the amount or eligibility of your benefits, you need to file an appeal instead. Appeals go to an Administrative Law Judge through the California Unemployment Insurance Appeals Board, a completely separate process.2Employment Development Department. How To Get the Form

You can also pick up a copy at any EDD public office.
The form is available in seven languages: English, Spanish, Mandarin, Cantonese, Armenian, Vietnamese, and Tagalog.4National Association of State Workforce Agencies. How To Fill It Out
The form fits on one page. It asks for:

- The service area: check the box for the program your complaint involves (Unemployment Insurance, Disability Insurance, Paid Family Leave, Tax-Related Services, Fraud, Workforce Services, CalJOBS, Legal Office, or Other).
- Incident details: the date, time, and location of the interaction, plus the name or identification of any staff member involved.
- A separate language access section if your complaint involves a failure to provide services in your language.
- An open description space to write what happened.
The description is the part that matters most. Stick to facts. What did you ask for? What did the employee say or do? When did it happen? How did it affect your ability to get help? If you called in, note the approximate time and any reference number you were given. If you visited an office, name the location. Specificity makes it easier for the department to match your account against its internal records.
Keep copies of anything you reference: call logs, letters from EDD, screenshots of online messages. Attach photocopies if they help tell the story. Don’t send originals of anything you can’t replace.

There is no single address. The back of the form lists a different mailing address for each service area, and you need to send it to the one that matches the program you checked on the front.3Employment Development Department. Before mailing, photocopy or scan everything you’re sending. Using USPS Certified Mail or a service with delivery confirmation gives you a verified delivery date if the department later says it never arrived.
Language Access Complaints Have Extra Channels
If your complaint is about a language barrier, you have more than one way in. California’s Dymally-Alatorre Bilingual Services Act requires state agencies that regularly interact with non-English-speaking residents to have enough bilingual staff to serve them.5Justia. What Happens After You Submit
An EDD directive for its workforce services offices instructs complaint representatives to contact the customer within three business days of receiving a complaint.6Employment Development Department. Directive – ES Complaint System That initial contact is typically to confirm receipt and ask follow-up questions if your written description needs clarification. The department does not publish a guaranteed turnaround for a final written response.
The investigation compares your account with internal records, call logs, and any documentation you attached. If the review finds that staff violated service standards, the resolution might involve retraining, procedural changes at the local office, or other corrective steps. The written response usually outlines what the department found and what it did about it.
Filing DE 8123 will not affect your benefit claim. The complaint process runs on a separate track from eligibility decisions, payment processing, and appeals.
