The rules for California’s Express Lanes come down to a few essentials: you need a FasTrak transponder mounted in your vehicle and a funded account before you enter, the toll changes in real time based on congestion, and carpools that meet the posted occupancy minimum ride free or at a discount. Each corridor is run by a different transportation agency, so hours, carpool minimums, and penalty amounts shift from one stretch of highway to the next.
Under California Vehicle Code Section 23302, entering a toll highway without a transponder linked to an account with enough balance to cover the toll is itself evidence of a toll violation.1California Legislative Information. California Vehicle Code Section 23302 License plate accounts don’t satisfy this. They work for Bay Area bridges, but express lanes require a physical toll tag.2Bay Area FasTrak. Ways to Pay
What You Need Before You Enter
FasTrak sells two transponder models, and the choice matters.
- FasTrak Standard pays tolls on bridges, toll roads, and express lanes. If you always drive solo, this covers you.
- FasTrak Flex has a three-position switch for declaring occupancy: “1” for solo, “2” for a two-person carpool, “3” for three or more. Roadside equipment reads the switch and charges accordingly.3FasTrak. FasTrak Throughout California
The switch setting is on you. If three people are in the car but you leave it on “1,” you pay the solo toll with no refund after the fact. Check it before you merge.
Mount the transponder on the inside of the windshield near the rearview mirror so overhead sensors can read it. Metallic tint or a dashcam mounted too close can block the signal, and the trip then shows up on your account as an unrecognized read.
Every FasTrak account opens with a $25 prepaid balance.4FasTrak. Get FasTrak A credit card on file replenishes the balance automatically when it runs low. If you prefer cash, you can fund the account at participating gas stations, convenience stores, and check-cashing locations, or mail a check or money order, with a $25 minimum.5FasTrak. Payment and Account Replenishment FAQs If the balance goes negative because you forgot to top up or your card expired, tolls still post and penalties can stack on top. A customer service representative can sometimes waive the penalty if you bring the account current quickly.6FasTrak. FAQ – Invoices and Penalties
Who Rides Free and Who Pays
Most California express lanes require two occupants for free passage. Certain corridors in the Bay Area and Los Angeles require three. Signs at each entrance tell you which rule applies.7California Department of Transportation. High-Occupancy Vehicle Systems Carpoolers still need a FasTrak Flex set to the correct position or the system charges the solo rate.
Motorcycles are exempt from the occupancy requirement under California Vehicle Code Section 21655.5 and can use express lanes without paying a toll.7California Department of Transportation. High-Occupancy Vehicle Systems Riders still need a transponder so the system can identify them. Because windshield mounting isn’t practical on a bike, the law allows a rider to carry the transponder in a front pocket, inside a cycle net draped over the gas tank, or in a storage compartment. Holding it up by hand while riding is illegal.8FasTrak. FasTrak Toll Tags Guide
One point that catches a lot of EV and plug-in hybrid drivers off guard: the Clean Air Vehicle decal program ended on September 30, 2025, and every decal color is now expired with no grace period.9California Air Resources Board. The End of Californias Clean Air Vehicle Decal Program As of October 1, 2025, clean air vehicles no longer get toll discounts on express lanes or free carpool-lane access based on emissions status.10FasTrak. Discounts If you drive an EV or hybrid, you follow the same rules as everyone else.
How Tolls Are Priced
Tolls aren’t fixed. Prices adjust in real time based on congestion in the general-purpose lanes. When traffic slows down beside them, the express lane toll rises to keep too many vehicles from entering at once, with the goal of maintaining express lane speeds around 45 miles per hour or faster. When demand drops, so does the price.
Electronic signs at each entry point show the current toll to specific downstream exits. You lock in the rate displayed at the moment you enter, even if the price jumps a minute later for the next driver. On the LA Metro ExpressLanes, tolls range from a minimum of $0.35 per mile to a maximum of $3.20 per mile as of March 2026.11Metro ExpressLanes. Hours and Lane Markings
Most California express lanes are tolled weekdays from 5:00 a.m. to 8:00 p.m. Outside those hours and on major holidays, the lanes open to all traffic for free.12511 SF Bay. Bay Area Express Lanes Network A few corridors, like the I-80 Express Lanes in the Bay Area, operate seven days a week during the same hours.13FasTrak. Carpooling Guide The schedule is not universal, so check the signage for the corridor you use.
Dashed white lines mark where you can enter and exit. Double solid white lines mean no crossing. California Vehicle Code Section 21655.8 makes crossing them a moving violation, enforced by highway patrol and cameras.14California Legislative Information. California Code Vehicle Code 21655.8 The one exception is yielding to an emergency vehicle with lights or sirens, in which case you should exit the lane as soon as you can do so safely.
Once you’re in the lane, overhead equipment reads your transponder and records your passage through each segment. The system debits your account automatically. You can review charges online or on monthly statements.
Rental Cars
If you’re driving a rental, you have two paths. The better one is to bring your own FasTrak transponder and temporarily add the rental’s license plate to your account by logging in and entering the plate number with the rental start and end dates. Mount your transponder on the windshield and tolls post normally.15FasTrak. Rental Vehicles Guide
The second path is your rental company’s toll service. Most agencies offer programs like TollPass or e-Toll, but not all of them cover express lane tolls. In the Bay Area, PlatePass is the only rental toll service accepted for express lanes.15FasTrak. Rental Vehicles Guide These services also add a daily convenience fee on top of tolls, which can run up fast on a longer trip. Use an express lane in a rental with no valid toll arrangement and the violation goes to the rental company, which passes it to you along with its own administrative fee.
Low-Income Toll Discounts
The Express Lanes START program in the Bay Area offers qualifying low-income households reduced tolls on the I-880 and I-80 express lanes: 50% off when driving alone, 75% off for a two-person carpool, and free travel with three or more passengers. To qualify, you need to live in one of the nine Bay Area counties and have a household income at or below 200% of the federal poverty level. For a household of one, that threshold is $31,920; for a family of four, $66,000. Proof of income can come from documents like a CalFresh card, a Medi-Cal card, or your most recent tax return.16Express Lanes START. Express Lanes START The LA Metro ExpressLanes runs a similar low-income assistance plan with its own criteria.
Violations and Penalties
Express lanes use high-speed cameras to capture license plates of vehicles without a valid transponder or with an unreadable signal. Under California Vehicle Code Section 23302.5, toll evasion is a civil violation, not a criminal one, and it’s handled through an administrative process rather than traffic court.17California Legislative Information. California Code Vehicle Code 23302.5
When the system detects an unpaid toll, the issuing agency mails a Notice of Toll Evasion to the registered owner. The first notice typically includes the unpaid toll plus a $10 penalty. If that goes unpaid, a second notice adds a steeper penalty, often around $30 on top of the toll. Paying promptly after the second notice can sometimes reduce the penalty back to $10.15FasTrak. Rental Vehicles Guide Exact amounts vary by corridor because each agency sets its own penalty schedule within state law.
Ignoring the notices is where the real damage starts. If penalties remain unpaid, the issuing agency can send the outstanding balance to the DMV, which will refuse to renew your vehicle registration until the balance is cleared.18California Legislative Information. California Code Vehicle Code 4770 There’s no minimum number of violations needed to trigger the hold. A single unresolved notice can block renewal.19California Department of Motor Vehicles. Contesting a Violation
If you think a notice was issued in error, you have 21 days from the date the notice was issued, or 30 days from the mailing of a delinquent notice (whichever is later), to contest it. At this first stage, you don’t pay anything up front. The issuing agency investigates based on its records, including camera photos, and mails you the result.20California Legislative Information. California Code Vehicle Code VEH 40255
If the investigation goes against you, you have 15 days from the mailing of that result to request an administrative hearing. This stage requires a deposit, generally the penalty amount up to $250, plus 10% of any amount above $1,000. If your household income is below 200% of the federal poverty level, you only deposit the toll itself, not the penalty.20California Legislative Information. California Code Vehicle Code VEH 40255 The hearing takes place within 90 days of your request, and you can attend in person, by phone, or submit your case in writing.
If the hearing officer rules against you, filing an appeal in superior court is still an option. Most people never reach that stage, but the path matters when penalties have grown into hundreds of dollars. The common mistake is missing the 21-day window for the initial contest, which forfeits the simplest and cheapest shot at getting the charge dismissed.
