The California Family School Partnership Act gives working parents up to 40 hours of job-protected leave each year to take part in their children’s school and licensed childcare activities, with a ceiling of eight hours in any single month. The law, codified at Labor Code Section 230.8, applies to employees at worksites with 25 or more people, covers planned events and emergencies alike, and protects you from being fired or disciplined for using it.1California Legislative Information. Who Can Use This Leave
You qualify if you work for an employer with 25 or more employees at the same location. There is no minimum tenure and no hours-per-week floor, so new hires are covered on day one as long as the worksite is big enough.1California Legislative Information. California Labor Code LAB 230.8
The statute reads “parent” generously. You are eligible as a parent, guardian, stepparent, foster parent, or grandparent, and also if you stand in loco parentis to the child. The child has to be of an age to attend kindergarten through 12th grade, or enrolled in a licensed childcare facility.2California Department of Human Resources. 2108 – Family School Partnership Act
Part-time workers are in, but their hours are prorated. A half-time employee gets up to 20 hours a year instead of 40. Independent contractors are not covered, and neither is anyone whose worksite falls below the 25-employee threshold.
How Many Hours and Whether They’re Paid
The annual cap is 40 hours, and no more than eight of those can fall in any one calendar month.1California Legislative Information. California Labor Code LAB 230.8 The monthly cap bites more often than people expect. If a conference, an open house, and a field trip all land in October, eight hours is your ceiling for the month even if your annual balance is untouched.
The time off is not automatically unpaid. You first have to use any vacation, personal leave, or compensatory time you have accrued. Unpaid leave is available only if your employer separately allows it. The choice among the paid options you’ve already earned is yours, not your employer’s.2California Department of Human Resources. 2108 – Family School Partnership Act
The 40 hours belong to you, not to each child. A parent with three kids in three schools still gets 40 hours total.
What Activities Count
Two broad categories qualify. The first is participation in school or licensed childcare activities: volunteering in a classroom, going to parent-teacher conferences, attending open houses, chaperoning field trips, and joining school-sponsored events. Time spent finding, enrolling, or re-enrolling a child in school or licensed childcare counts too.2California Department of Human Resources. 2108 – Family School Partnership Act
The second category is childcare or school emergencies. If a provider closes unexpectedly or the school calls you about an urgent problem, you can use leave to respond. You still need to notify your employer, but you don’t need to have planned it in advance.3California Legislative Information. California Labor Code Section 230.8
Attending school disciplinary proceedings, including suspension or expulsion hearings, also qualifies.4California Department of Education. Replacing Discipline With Supports
Giving Notice and Showing You Attended
For planned activities, you must give your employer reasonable advance notice. In practice that means telling them as soon as you know about the event. Verbal notice is generally fine unless a written company policy specifically requires something in writing.
Your employer can ask you to document that you actually attended. A note from the school or a confirmation of the event will usually do. The request has to be reasonable: your employer cannot demand your child’s academic records or other private information to verify a conference.1California Legislative Information. California Labor Code LAB 230.8
If Both Parents Work at the Same Place
When two parents of the same child work for the same employer at the same worksite, only the parent who gives notice first can take a planned absence for that child at any given time. The second parent can take leave for the same child at the same time only with the employer’s approval.1California Legislative Information. California Labor Code LAB 230.8 The restriction only applies when both of you want time off at the same time for the same child. Different children or different dates? No conflict.
If Your Employer Retaliates
Employers cannot fire, threaten to fire, demote, suspend, or otherwise discriminate against you in the terms and conditions of your employment because you took this leave.1California Legislative Information. California Labor Code LAB 230.8 The “otherwise discriminate” language is wide enough to reach less obvious moves: cutting your hours, shifting you to worse schedules, or suddenly papering your file with performance complaints that never came up before.
You have two ways to push back. You can file a retaliation complaint with the California Division of Labor Standards Enforcement, which investigates and can order reinstatement, back wages with interest, removal of negative entries from your personnel file, and a posted notice acknowledging the violation.5Division of Labor Standards Enforcement. Retaliation and Discrimination Complaints You can also file a civil lawsuit; if you win, the court can order reinstatement and reimbursement for lost wages and benefits, and may award reasonable attorney’s fees.1California Legislative Information. California Labor Code LAB 230.8
Penalties grow when employers refuse to comply after being told to. If an employer willfully refuses to rehire, promote, or restore an employee after a grievance procedure, arbitration, or hearing determines the employee is entitled to be restored, the employer faces a civil penalty equal to three times the employee’s lost wages and work benefits.2California Department of Human Resources. 2108 – Family School Partnership Act
Watch the clock. You have one year from the retaliatory act to file a complaint with the DLSE.6Division of Labor Standards Enforcement. How to File a Retaliation/Discrimination Complaint Miss that window and the administrative route closes. Document anything suspicious right away rather than waiting to see whether things settle down.
How This Interacts With FMLA
The Family School Partnership Act is not your only option. If your child has a serious health condition and receives services through an Individualized Education Program, you may also qualify for federal Family and Medical Leave Act leave to attend IEP meetings; the U.S. Department of Labor has concluded that attending these meetings is a qualifying reason for intermittent FMLA leave, and the child’s doctor does not need to be present.
FMLA carries its own protections, including up to 12 weeks of job-protected leave per year and continued health insurance during the leave. When a situation qualifies under both laws, the rights are cumulative; one does not cancel out the other, and you can use whichever gives you more.1California Legislative Information.
